CONTROL NUMBER: JA-11-01
ABBREVIATED JUSTIFICATION AND APPROVAL DOCUMENT
FOR OTHER THAN FULL AND OPEN COMPETITION
OF REQUIREMENTS NOT EXCEEDING $550,000 (IAW FAR 6.304)
1. CONTRACTING ACTIVITY: RDECOM Contracting Center, Aberdeen Installation Contracting Division, Installation Contracting Branch, Facilities Team, Aberdeen Proving Ground, Maryland, 21005-3013.
2. DESCRIPTION OF ACTION: This will be a modification to a firm-fixed-price with a labor-hours item requirements contract for locating underground utilities. Approval is requested to extend the current contract, W91ZLK-06-D-0002, for a period of two (2) months from 7 Nov 2010 through 6 Jan 2011 in support of the U.S. Army Garrison, tenant and supported organizations, Aberdeen Proving Ground, FY11 OMA funding will be utilized for this acquisition. This modification will be issued to the incumbent contractor:
InfraMap Corporation
10365 Cedar Lane
Glen Allen, Virginia 23059-1956
3. DESCRIPTION OF SERVICES: The estimated value of the proposed action is $98,206.10. This acquisition is for electronically locating, marking with paint, pin flags, bristles, stakes, map and survey (Global Positioning Satellite (GPS) and conventional). As-built locations drawings of buried utilities both new and existing are provided. Vacuuming excavation test holes and issuing excavation permits are performed.
4. AUTHORITY CITED: The statutory authority permitting other than full and open competition is 10 USC 2304(c)(2) as implemented by Federal Acquisition Regulation (FAR) 6.302-2, “Unusual and Compelling Urgency”.
5. REASON FOR AUTHORITY CITED:
The Government has an urgent need to extend the current utility locating contract W91ZLK-06-D-0002. The current contract expires 7 Nov 2010. This modification will allow sufficient time for the Government to re-compete this service and to prevent mission failure without having another contract in place.
The pre-solicitation notice for the follow-on utility locating contract was posted on 7 Oct 2010 as a 100% Small Business Set-Aside with an anticipated solicitation release date of 20 Oct 2010. Due to a high turnover in contracting personnel, technical issues with our computers and industry questions to the pre-solicitation notice, it is taking the Government longer than originally anticipated to complete the solicitation. This extension will allow the Government sufficient time to compete the solicitation and anticipate award by 7 Jan 2011.
The extension of the contract is the only practical and economical interim measure to provide services necessary to keep construction at the Aberdeen and Edgewood Areas of Aberdeen Proving Ground continuing, keeping the workers safe from electrocution while doing underground work and to alleviate any possibility of claims for Government delay until the follow-on contract can be awarded.
If this contract is allowed to expire, the critical nature of utility locating with it’s dependency for construction projects on Aberdeen Proving Ground could effectively shut down. Any impairment to mission on Aberdeen Proving Ground will present an unacceptable risk to construction work for all relocation projects and could compromise the warfighters’ readiness.
The following additional information supports the cited authority:
a. Harm to the Government if Services are not provided on time:
(1) Suspension of Operation: This is not an acceptable option because of underground safety hazards to the construction workers, not knowing what lines, electrical or fiber optics, are underground. Electrical outages also cause problems concerning heat, air conditioning, computer problems, etc.
(2) Use of In-House Resources: Using Government personnel (military or civilian) to replace contractor personnel in the execution of the duties of locating underground utilities under this contract are not realistic. Human resources and certifications are not available to provide these services using Government forces.
(3) Award a New Contract to Incumbent Contractor: Current contractor has both the manpower and resources to adequately perform these mission critical services for the period. The incumbent contractor has agreed to maintain current contract pricing for a modification for a two-month period.
b. Harm to the Government if contractor doesn’t receive the award:
(1) Due to urgency, the required underground utility locating services can only realistically be procured from the incumbent contractor in time for performance to begin 7 Nov 2010.
(2) It is anticipated that a competitive 100% small business set-aside follow-on requirements contract will be awarded by 20 Dec 2010, which will allow for re-procurement of the service and a 2 week phase-in period if the incumbent contractor is not awarded the new competitive contract.
6. ACTIONS TO INCREASE COMPETITION: The Government is currently preparing a statement of work suitable for a competitive 100% Small Business Set-Aside for the new follow-on contract. The Government will award the follow-on contract as soon as practicable.
7. MARKET RESEARCH: A market survey shows (CCR review) there are ample firms that can perform. However, considering the logistics of a new contractor performing these services, it is not feasible to solicit for a short term interim contract with any source other than the incumbent contractor. At this point, there is no way to do limited competition, make award, allow for a two (2) week startup and start work by 7 Nov 2010.
8. PROCUREMENT HISTORY:
The previous Contract Number is W91ZLK-06-D-0002 with InfraMap Corporation.
The previous contract was competed as a 100% Small Business Set-Aside.
The previous authority for less than Full and Open Competition
