Limited Sources Justification or Sole Source Justification for Acquisitions under the Simplified Acquisition Threshold (Simplified Acquisition Threshold is $150K)

CONTROL NUMBER: 15-064

1. Contracting Activity: This requirement is for Irwin Army Community Hospital (IACH), Fort Riley, Kansas. The contracting activity is Western Regional Contracting Office, Evans Contracting Cell.

2. Description of Action:

Total Dollar Value: $150,000.00

Name of Intended Contractor:
AMO Sales and Service, Inc.
Street Address:
1700 East St. Andrew Place
City, State, Zip:
Santa Ana, CA 92705-4933

3. Description of Supplies/Services: IACH is requesting a sole source contract to AMO Sales and Service, for the scheduled maintenance and repair service of the Excimer Ophthalmic Laser and Ophthalmometroscope Systems located in the Ophthalmology Department at the IACH. This requirement is a base year and two one year base periods for the maintenance and repair. The total acquisition cost for a base period and two option years is $150,000.00.

4. Authority Cited:

|X| (a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR

|_| (b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR

|_| (c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR

|_| (d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR

|_| (e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.

5. Reason for Authority Cited: The Excimer Ophthalmic Laser and Ophthalmometroscope Systems are currently in use at IACH. AMO Sales and Service offers the only maintenance services available for these unique patented, propriety systems, manufactured in the United States and commercially available. Maintenance service, software, and repair parts for the Excimer Ophthalmic Laser and Ophthalmometroscope Systems are proprietary and available only through AMO Sales & Service Inc. This is to ensure that optimum operation and efficiency of the equipment is maintained and that proper functioning of the equipment conforms to the Original Equipment Manufacturer (OEM) standard specifications. Other vendors are not able to perform the repair services to manufacturer’s specifications on the Excimer Ophthalmic Laser and Ophthalmometroscope System equipment without compromising the manufacturer’s full factory OEM warranty. If a third party vendor completes the repair services, this will void the manufacturer’s warranty on the laser system equipment/units, plus optimum operation of equipment would be in jeopardy.

6. Actions to Increase Competition: As technology becomes available, research will be performed to consider other products that meet or exceed the current equipment requirements for Ophthalmic Lasers and Ophthalmometroscopes.

7. Market Survey: There were no additional sources found that could provide the maintenance service of the OEM. The Contract Specialist did a dynamic small business search to determine the number of vendors that are found under NAICS 811219, Other Electronic and Precision Equipment Repair and Maintenance and several vendors were identified. However, other vendors are not able to perform the repair services to manufacturer’s specifications on the Excimer Ophthalmic Laser and Ophthalmometroscope Systems equipment without compromising the manufacturer’s full factory OEM warranty. If a third party vendor completes the repair services, this will void the manufacturer’s warranty on the laser system equipment/units, plus optimum operation of equipment would be in jeopardy. Using AMO Sales & Service Inc. will guarantee IACH’s laser equipment performs to the highest standard possible. Fair and reasonable pricing has been completed by comparing the prices from the current contract W91YU0-11-P-0259. The price for the new contract is expected to be the same as the current contract ($50,000/year). Ft. Carson, CO has the same equipment, but only a quantity of two, and their contract (W91YU0-12-P-0172) with AMO Sales & Service Inc., price is $90,000/year/unit—slightly below the price per unit as contract W91YU0-11-P-0259. Possibly due to volume discount. Thus, it is determined that AMO Sales & Service Inc. has reasonable prices for their repair services, travel, parts, labor, and onsite preventive maintenance/calibrations. This equipment is critical as the Laser system equipment/units are used at Irwin Army Community Hospital is in support of the mission of patient care.
