ADDENDUM TO 52.212-2
Paragraph (a) supplemented with the following:
The Government will award a Firm Fixed Price contract using the Lowest Price Technically Acceptable (LPTA) source selection process. Award will be made to the responsible offeror that proposes the lowest evaluated price of those proposals conforming to the solicitation and meeting the acceptability standards for the non-price factors. The Government intends to award without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary.
In order to be considered for award, an offeror must receive an Acceptable rating in the technical factor and be the lowest price offeror. The following factors shall be used to evaluate offers:
FACTOR I: Technical Capability FACTOR II: Price The Government will not conduct a trade-off between Technical Capability and Price. Proposals will not be rated more highly for exceeding the minimum requirements for technical acceptability. Consequently, the government will not select a higher priced, technically acceptable proposal over a lower priced technically acceptable proposal, assuming both proposals have conformed to the requirements of the solicitation and have been submitted by responsible offerors.
In accordance with FAR 15.304(c)(3)(iii) the Contracting Officer has determined that past performance is not an appropriate evaluation factor and will not be used for this acquisition.
If five (5) or fewer offers are received, the Government will evaluate all for technical acceptability. If more than five
(5) offers are received, the Government will then evaluate the five (5) lowest priced proposals for Technical Acceptability. However, the Government reserves the right to evaluate additional offers for technical acceptability if deemed to be in the Government’s best interest. If additional offers are evaluated for technical acceptability, they will be evaluated in the order of increasing total evaluated price, when the agency determines that none of the initial five (5) lowest priced quotes are qualified as acceptable. The agency may reject and not consider for award any offer found technically unacceptable and ineligible for award under the terms of this RFP.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the base year. The Government will determine whether prices are unbalanced utilizing FAR 15.404-1(g). An offer may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
FACTOR I – Technical Capability Offerors shall submit the documentation required in the addendum to 52.212-1 of this solicitation and in the deliverables section of both PWS’s.
Subfactor 1 – The Contractor shall submit a Technical Capability Statement demonstrating the capability to furnish all personnel, linen, equipment, labor, transportation, supplies, and supervision, except as specified herein as Government furnished, to provide bulk laundry services necessary to perform laundry services for EAMC and MACH. The information provided by the offeror will be a significant factor in the Government's determination of technical acceptability. The contractor shall adhere to all the terms and conditions that are outlined in the Eisenhower PWS but provide details in their technical capabilities statement for the following sections of the Eisenhower PWS: 1.3, 1.4, 1.5.1, 1.5.1.1, 1.5.1.2, 1.5.4.3, 1.5.4.3.1, 1.6.2, 1.6.3, 1.6.4, 1.6.4.1, 1.6.6, 1.7, 1.9 – 1.9.2.9, 1.10, 1.14, 1.15 – 1.15.1.2, 1.17 – 1.17.5, 4 – 4.5, 5.1 – 5.4.1. The contractor shall adhere to all the terms and conditions that are outlined in the Moncrief PWS but provide details in their technical capabilities statement for the following sections of the Moncrief PWS: 1.3, 1.4, 1.5 – 1.5.1.2, 1.5.4 – 1.5.4.3.1, 1.6.2, 1.6.3 – 1.6.6, 1.8, 1.10, 1.11, 1.12.1, 1.12.2, 1.20, 1.21, 1.21.1.1, 1.23 – 1.23.5, 4 – 4.3, 5 – 5.4.1. Contractor Support Hours: The Contractor shall provide support between the hours of 7:30 am to 5:00 pm Monday through Friday.
Technical Capability will be evaluated and rated as either Acceptable or Unacceptable.
The following adjectival ratings will be used in evaluating each Offer’s Technical capability.
ACCEPTABLE: Proposal meets the requirements of the solicitation.
UNACCEPTABLE: Proposal does not meet the requirements of the solicitation.
FACTOR II - PRICE
Submit proposed pricing for all contract line item numbers identified in the Request for Proposal (Form 1449), unless otherwise noted. Include the "Unit Price" and total "Amount" for each line item (base and all option years). If the prices are the same for each contract period, provide one schedule and state that the schedule applies to all contract periods. The information provided in this schedule will be used to assist in the price analysis described in EVALUATION OF THE PROPOSED PRICES, in ADDENDUM TO FAR 52.212-2, EVALUATION – COMMERCIAL ITEMS. The Government will not assign an adjectival rating to Price. Price including options will be evaluated to determine whether they are fair, reasonable and balanced using price analysis techniques in FAR 15.404-1.
