5.12.2-remains unchanged.

ANSWER: No, the Government will not add a Loss of Use (LOU) CLIN
8. Licensing Requirements - How does the GOV plan to ensure that offerors are compliant with State of South Carolina Board of Pharmacy requirements for licensing to distribute/wholesale Medical Grade Oxygen (a prescription drug)?
This is a requirement for the Contractor (Awardee) to be licensed by the South Carolina Board of Pharmacy, which cannot be delegated (to a SUB CONTRACTOR). Succinctly, the awardee is hired by the GOV to be the accountable entity, and not the subcontractor, hence, if for instance there was any contamination of Gas, it is the Prime SDVOB contractor that is responsible, i.e. Medical Gas is classified by the FDA as a Prescription Drug (Pharmaceutical), and given the RFQ states no licensing requirement, the only unlicensed entity in the Pharmaceutical Chain of Custody, could be the Awardee/Contract holder?
ANSWER: Licensing requirement are the responsible for the offeror to maintain according to the State and Federal regulations and laws.
How is the GOV going to discern that the offeror is properly insured for NAICS 325120/221210? This is important because there are very few underwriters that will insure small businesses for compressed gases. To be covered, the Insurance Certificate should list the applicable NAICS. FAR 52.228-5 Insurance Work on a GOV Installation:
ANSWER: Insurance requirements is the responsible of the Offeror. FAR 52.228-5 is not a requirement for this RFQ.
