Question and Answers for Solicitation W91YTZ-19-R-0005
1) There are provisions in the contract that require us under some circumstances to hire personnel employed by the entity that previously held this contract. Can you find out whether there was a prior contract? This provision is not as bad as it may sound, but it would give me comfort to know that there was no such prior contract.
Answer. FTCC is the only vendor to perform this requirement. This is a new requirement that includes three separate courses of study EMT -B, EMT-P and Distant Learning Paramedic training (online). The previous courses was for EMT-P only. Please see contract numbers W91YTZ18P0244, W91YTZ18P0190, and W91YTZ18P0244.
2) There are specific requirements for the hourly wages of those employed by virtue of this contract. The minimum hourly rate is between $27 and $28 for instructors and about $16 per hour for secretaries. We need to exercise care to make certain we comply with the wage requirements for all associated with this contract (and some secretaries and records clerks hired in the last year or so may not have that level of wages.) We either need to put long time personnel on this contract or raise some workers' wages to comply.
Answer. Wage determinations will not affect this requirement. Wage Determination No.: 2015-4377 states “Under Executive Order (EO) 13658, an hourly minimum wage of $10.35 for calendar year 2018 applies to all contracts subject to the Service Contract Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015.” If your organization is paying at minimum $10.35 for positions directly supporting the pending contract, then this is a non-issue.
3) Price information needs to be entered on the Continuation Sheet which starts about the 3rd or 4th page in the big contract document.
Answer. Please enter price information in the designated CLIN to include unit and total price. If you do not charge for Contract Manpower Reporting, then the CLIN line should be left blank.
4) There is a HIPPA/HiTECH Business Associate Agreement included in the contracting documents. I do not believe we would meet the definition of a business associate under the law and believe this should be removed.
Answer. This is a local policy and is required in the Fort Bragg Contracting Office Performance Work statements.
5) On page 74 of 87, there is a requirement that we make certain representations through the SAM website. Do we currently do this?
Answer. Yes. Please ensure your SAM registration is current and that it represents your organizations.
6) Also beginning on page 74 of 87, there are many pages of representations we may need to make regarding our status as a business. Generally, we would need to say we are none of those items listed except a governmental entity. Can someone check and determine whether we need to check all those boxes and if so, we need to check the appropriate boxes before Dr. Keen signs.
Answer. Please check all the boxes that pertain to your organization. The contracting Office will confirm your status through the System of Award Management (SAM).
7) Does the Combined Synopsis/Solicitation posted as solicitation number W91YTZ19R0005 on FBO contain requirements similar to an existing contract or will this be a new requirement?
Answer.
