Control Number:
For Official Use Only (See FAR 2.101 and 3.104-4)
(1 October 2015)
Justification and Approval Under FAR 13.501
1. Contracting Activity: Regional Health Contracting Office - Atlantic, Gordon Health Contracting Cell, Fort Gordon, Georgia 30905-5670
2. Description of Action: Approval to award a twelve-month firm-fixed price non-personal services bridge contract for the fabrication of military eyewear to prevent a break in service at the Moncrief Army Health Clinic, Fort Jackson, South Carolina. The period of performance will be April 2019 through 31 March 2020. The requirement will be funded with DHP funds.
3. Description of Supplies/Services: This is a non-personal services requirement to provide continuity of Optical Fabrication Services in support of the Optical Laboratory based at Fort Jackson. The Optical laboratory requires additional support to meet the demands for 24 hours completion of military eye wear. The Optical Lab fabricates spectacles for the Training and Doctrine Command (TRADOC) basic training installation and over 40 Optometry Clinics in the Atlantic Region inclusive of nine states and produces an estimated 14,000 to 16,000 spectacles per month.
4. Authority Cited: 41 United States Code 1901 as implemented in the Federal Acquisition Regulation 13.501(a) (1)(ii), sole source (including brand name) under the authority of the simplified procedures for certain commercial items.
5. Reason for Authority Cited: The Atlantic Region facilities have experience problems receiving allocation of FY19 funding which has impacted receipt of funded requisitions for new and follow-on requirements. The incumbent is the only responsible source that can perform the services for this time period with the contractor personnel already in place and to ensure no interruption in services. Douglas Resources, an 8a woman owned small business is qualified to provide services temporarily until a follow-on contract is in place. The competitive follow-on contract for these services will be processed. The bridge contract will allow the health clinic time to define the requirement clearly and afford contracting personnel time to complete the long term procurement.
6. Efforts to Obtain Competition: A synopsis was posted on the Federal Business Opportunities website 1 March 2019 and there were no responsible interested vendors other than the incumbent. There were two inquiries via email, but they assumed they were night vision goggles or ballistic rated glasses.
a. Effective competition. Based on the feedback from the Synopsis, the requirement is was not clear and therefore hindered adequate competition. Once the health clinic has revised their requirement, effective competition will be provided for on the long term contract as a 100% small business set-aside acquisition.

(See FAR 2.101 and 3.104-4)
(25 February 2016)
b. Subcontracting competition. The follow on requirement will be a small business set aside, therefore, subcontracting competition is not required.
7. Actions to Increase Competition: The long term requirement will be solicited on the Federal Business Opportunities website as a 100% small business set-aside;
therefore competition will be achieved at that time.
8. Market Research: An SBA Dynamic search using NAICS 339115, Ophthalmic Goods Manufacturing found five companies including the incumbent. A synopsis was posted on the Federal Business Opportunities website 1 March 2019 and there were no responsible interested vendors other than the incumbent. There were two inquiries via email, but they assumed they were night vision goggles or ballistic rated glasses.
9. Interested Sources: A synopsis was posted on the Federal Business Opportunities website 1 March 2019 and there were no responsible interested vendors other than the incumbent. There were two inquiries via email, but they assumed they were night vision goggles or ballistic rated glasses.
10. Other Facts:
a. Procurement history. The current contract, W81K00-14-C-0047, has been in place since 2014. During the performance of this contract, various CORs have assumed the responsibility for contractor performance.
(1) DADA08-04-F-0010, 14 Oct 2003, Small Business Set Aside, $80,637.00
W91YTV-08-P-0192, 29 Feb 2008, Unrestricted, $1,128,307.40
W91YTV-11-P-0164, 31 Mar 2011, 100% Small Business Set Aside, $1,766,316.45
(2) All of the previous contracts were competitive unrestricted or competitive among small businesses.
(3) There was no authority previously cited for less than full and open competition.
(4) A justification was not prepared to support the procurement made before this one.
(5) W91YTV-08-P-0192 was unrestricted. The dollar value between the period of 2008 and 2013 infers that the production volume was much lower than what is required at the present time.

(6) An explanation of any unusual patterns that may be revealed by the history, is that the PWS that was submitted with the follow on requirement was not clear. Feedback from the initial synopsis proved as such. There were two inquiries via email, but they thought the requirement was for night vision goggles or ballistic rated glasses.
(7) There is no record of a justification to support the procurement made before this one.
