(b) FAR 13.106-1(b) (1) (ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 8.405-6(a) (1) (i) (A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR
(d) FAR 8.405-6(a) (1) (i) (B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR
(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.
5. Reason for Authority Cited: In order to maximize the use and exposure of West Point, the West Point Club (WPC) has partnered with the Directorate of Cadet Activities (DCA) for catering services.
The WPC is West Point's caterer for all non-cadet related events and the entry point for all catering questions. Should the WPC, due to size restrictions or date conflicts, be unable to cater your event there is an agreement in place that allows the WPC to refer you to their partner, DCA, located in Eisenhower Hall. At this time DCA and WPC has proprietary rights for the sale of any food or beverages at West Point Military Academy café located in Eisenhower Hall; no outside food or beverages are allowed to be brought in. Based on the above information, in order for the MTF to provide the needed refreshments to the blood donors they will need to go through WPC or DCA.
Failure to provide the refreshments will halt critical blood drives/donations. We will continue to review our options and if the proprietary status changes, this requirement will be competed.
6. Actions to Increase Competition: This Justification and Approval documentation will be posted on the Federal Business Opportunities (FedBizOpps) website to increase future competition. No additional action will be taken to increase competition for this requirement
7. Market Survey: LTC Sloan, Chief, Blood Services met with the Cadet Catering Office at West Point on 26 September to discuss the quantities and deliveries of catered items. The Cadet Blood Drive menu is based on historical items and quantities since this blood drive was organized in 2003.
DCA has proprietary rights for the sale of any food or beverages.
