SOURCE SELECTION INFORMATION
(See FAR 2.101 and 3.104-4)

Limited Sources Justification for Other Than Full and Open Competition
1. Contracting Activity: Regional Health Contracting Office – Atlantic, (RHCO-A), Fort Drum Health Contracting Cell, Fort Drum, NY.
2. Nature and/or Description of Action: The Guthrie Ambulatory Health Clinic, Fort Drum, NY has a follow-on requirement to issue a firm-fixed price Blanket Purchase Agreement (BPA) effective 01 December 2016 against BioMerieux, Inc.’s Federal Supply Schedule (FSS) contract V797P-7128A for Vitek 2 Compact 30, Microbiology Analyzer Cost per Test Lease. The BPA ordering period will be for a period of five years. CORE funds will be used for the acquisition of the commercial items. Funds will be provided as orders are placed.
3. Description of Supplies/Services: Guthrie Ambulatory Health Clinic, Fort Drum, NY has a requirement for Vitek 2 Compact 30, Microbiology Analyzer Cost per Test Lease.
The BPA Master Dollar Limit is $250,000.00 for the life of the BPA. FAR 52.217-8, “Option to Extend Services” will not be included in the agreement.
4. Authority Cited and Reason: FAR 8.405-6(a) (1) (i) (B), “Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized”.
The requirement is for a microbiology analyzer to support the Laboratory at Guthrie Ambulatory Health Clinic, Fort Drum, NY. This requirement was written to promote competition. Market research determined that the analyzer had four potential sources through GSA. Solicitation W91YTZ-16-R-0106 was posted to GSA eBuy for 30 days.
Two proposals were received. Both proposals were found technically unacceptable. The solicitation was reposted under W91YTZ-17-R-0004. Two proposals were received.
One vendor was found non-responsive. Clarifications were conducted with the other vendor. Clarifications revealed that the proposed analyzer could not identify Campylobacter species, a specification of the requirement.
A review of the requirement was conducted. Having an analyzer that performs campylobacter identification significantly reduces costs and time. Alternate analyzers that do not perform campylobacter species requires the laboratory to send out the sample for evaluation and requires an average 30 day turn around. The wait for results will impact the diagnosis of the patient.
The Vitek 2 Compact 30 is the only analyzer that can perform campylobacter species identification.

5. Best Value Determination. I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Fair and reasonableness is determined by a comparison of historical prices paid for the same or similar equipment in accordance with FAR 15.404-1(b) (2) (ii). Certified cost and price data is not required in accordance with FAR 15.403-1(b) (3). Specifically, the results of this comparison are as follows:
W91YTZ-11-F-0019 - This buy was for the base ordering period of a Microbiology Analyzer Cost per Test Lease located at Guthrie Ambulatory Health Clinic, Fort Drum, NY. The reagents associated with the analyzer Cost per Test Lease are on BPA W91YTZ-12-A-0073. A review of the pricing reveals like pricing for like items in the instant acquisition.
6. Market Research: Market research conducted in accordance with FAR Part 10.
Market Research was performed by reviewing available information in Procurement Desktop Defense (PD2), Paperless Contract Files (PCF), Dynamic Small Business Search, Google search, and required sources. Market research identified that the requirement was available through GSA, a required source under FAR 8.004. GSA listed four vendors under the Category 605-5A High Maintenance/Complexity Analyzers. It was anticipated that two or more proposals would be received.
7. Other Facts Supporting the Justification:
a. Procurement history. Reasonable efforts to retrieve the following items from computer records, contract files, competition advocate office files or other sources are expected:
(1) W91YTZ-11-F-0019, awarded on13 December 2010.
(2) Full and Open Competition.
(3) Authority previously used for less than full and open competition- N/A.
(4) If a justification was prepared to support the procurement made before this one, a summary of the actions taken to remove/overcome barriers for that procurement and an explanation of the results – N/A.
(5) Prior contract was awarded competitively. This contract was under the simplified acquisition threshold. Period of performance was for 12 months. All records were destroyed three years after the final payment.
(6) An explanation of any unusual patterns which may be revealed by the history, e.g., several consecutive, urgent buys – N/A.
Page 3 of 4 (25 February 2016)
(7) If a justification was prepared to support the procurement made before this one, briefly describe the circumstances justifying the buy and whether there have been any significant changes- N/A.
b. Acquisition data availability. A statement of work with salient characteristics was developed with minimum requirements expected to be suitable for full and open competition. After two solicitations did not result in award, a review of the salient characteristics was conducted. The necessity to have an analyzer that performs Campylobacter species identification has restricted competition. Due to significant factors including time and cost, it is in the best interest of the Government to maintain the salient characteristics as previously written.
c. Unusual and compelling urgency. N/A.
d. Subcontracting competition. There are no known subcontracting possibilities.
8. Actions Taken to Remove/Overcome Barriers to Competition: There are no actions identified that can be taken to remove/overcome barriers to competition as described above. The Military Treatment Facility has no concerns/issues at this time to compete future contracts for the services to be provided under this limited sources justification. If another potential source emerges, the Government will compete future requirements as feasible. The notice required by FAR 8.405-6(a) (2) will be published.
