Sole Source Justification for Acquisitions under the Simplified Acquisition Threshold
(Simplified Acquisition Threshold is $150K)
1. Contracting Activity: U.S. Army Medical Command, Northern Regional Contracting Office, Womack Army Medical Center (WAMC), Building 4-2817, Reilly Rd, Fort Bragg, North Carolina 28310
2. Description of Action: Approval is requested for a bridge contract to InGenesis Arora Staffing, LLC for a two month period of performance effective 01 April 2015 through 31 May 2015. The bridge contract will avoid an extended gap in Phlebotomists (7 FTEs) services at the Blood Donor Center until the proposals for the long term solicitation, W91YTZ-15-R-0006 can be evaluated, and a new contract awarded. The awardee, InGenesis Arora Staffing, has been performing services on Contract W81K04-09-D-0079-0X08 for the past five years and bridge contract W91YTZ-14-P-0319, for the past 10 months, expiring 31 March 2015, with good past performance history. This requirement will be a sole source, Firm-Fixed Price (FFP) type contract utilizing the incumbent contractor, InGenesis Arora Staffing. FAR 52.217-8, “Option to Extend Services” will not be included in the bridge contract. The new base and 4 option year contract will be awarded on or about 30 April 2015. FY 15 CORE funds will be utilized.
Requirement: New Repeat Bridge Pricing: Firm-Fixed Price Time & Materials Cost Funds: OMA Other Funds: _DHP____ Total Dollar Value: $85,433.80
Name of Intended Contractor: InGenesis Arora Staffing, LLC Street Address: 6609 Blanco Rd. STE 330 City, State, Zip: San Antonio, TX 78216-6152
Phone: 210-366-0033
3. Description of Supplies/Services: To provide Phlebotomist (7 FTEs) service coverage in support of the Blood Donor Center, Ft. Bragg, NC, for military members and their families. This is a personal service contract. Funds in the amount of $85,433.80 are available for the estimated period of performance of 01 April 2015 through 31 May 2015.
4. Authority Cited:
(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR
(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR
(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR
(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.
5. Reason for Authority Cited: As prescribed in Federal Acquisition Regulation (FAR) 13.106-1, the issuance of a contract without competition is the only option available to the U.S. government that meets the present requirement. The incumbent for current contract, W91YTZ-14-P-0319, is InGenesis Arora Staffing. With a commencement date of 01 April 2015, it is requested that InGenesis Arora Staffing continue to provide Phlebotomist Services while the long term (base plus four 12 month option periods) contract is negotiated through the competitive acquisition process. The bridge will avoid an extended gap in services due to review and evaluation of solicitation W91YTZ-15-R- 0006. This two month bridge will allow this office ample time to properly evaluate the proposals and proceed with the award process and to continue with the heavy additional work load due to shortage of personnel. The new award will begin on 01 June 2015 and end 30 September 2015 with four 12 month option years.
6. Efforts to Obtain Competition: There are currently no efforts to obtain competition for this bridge contract, as a determination has been made that it is in the Government’s best interest to approve a short term bridge contract to the incumbent until such time as when the follow-on contract has been awarded.
7. Actions to Increase Competition: There are no practical alternatives available to increase competition for this requirement, given the short performance period of this bridge contract. No action will be taken to obtain or increase competition for the bridge contract; however, this bridge contract will allow enough time to award and allow adequate time for start-up on the long-term 100% HubZone set-aside competitive contract starting on or about 01 June 2015.
8. Market Research:
9. Interested Sources: To date, no other sources have written to express an interest in the short term requirement; however, interest has been expressed in the long term requirement. The interim contract action is primarily a vehicle to continue vital services until the long term contract is awarded.
The notices required by FAR 5.201 will be published and any proposals received will be considered.
10. Other Facts:
Procurement History
a. Previous Contract or Purchase Order Number:
1) W81K04-09-D-0079-0X08 –Competitive acquisition awarded under the Army Direct Care Medical Services (ADCMS) Multiple Award Contract
A new procurement package was submitted for FY15. This packet includes market research through GSA federal supply schedules. A copy of the market research is attached.
2) W91YTZ-14-P-0319 – Sole source bridge contract with extensions to 31 March 2015.
b. Proposals for solicitation W91YTZ-15-R-0006 were received and evaluated by the technical review team. Due to concerns of some of the offerors pricing, assistance from the NRCO cost/price analyst was requested and completed on 09 March 2015. Delay of the new award was not caused by the lack of advanced planning but resulted from the following unexpected events: (1) protest of the solicitation, (2) several days of Government shut down due to inclement weather; (3) necessity to conduct extensive discussions relating to the follow-on-contract. The price negotiation memorandum can now be completed but not in sufficient time to allow legal and policy review and time to allow small businesses to request debriefings and award a contract before 01 April 2015. Contract award is anticipated not later than 30 April 2015 with a new contract start date of 01 June 2015.
