Justification And Approval
For Other Than Full And Open Competition

2. Description of Action: This justification and approval (J&A) document has been prepared in order to obtain authorization to extend the existing Firm Fixed Price contract number
W91WAW-12-C-0085 with Science Applications International Corporation (SAIC) for a total of six (6) months. This six-month extension will include a base period of three (3) months and three (3) one-month option periods. This transition allots time for full and open competition for a new follow-on contract. The total value is approximately $915,570.00 and fiscal year (FY) 15
Operations and Maintenance Army (OMA) funds will be used.
3. Description of Supplies/Services:
A. The non-personal services to be performed under contract W91WAW-12-C-0085 will provide programmatic staffing solutions to perform strategic analysis, policy formulation, and program support to two offices within Army Headquarters (HQ) as well as an office at Army
Space and Missile Defense Command (SMDC). These services encompass three broad areas within the Combating Weapons of Mass Destruction framework – Nonproliferation, Counter proliferation, and Consequence Management – as well as Resource Management for the Army
Arms Control Program.
Currently, the contractor provides support in reviewing OMA actions in the DAMO-SSD office to ensure continuity of operations, specifically providing the following support for nonproliferation, counter proliferation and consequence management.
Nonproliferation provides the following support:
Continuously study and assess the scope of USG, DoD, Army, and international implementation and compliance reporting and certification requirements; inspection and visit requirements; data exchange and declaration requirements; and notification requirements in accordance with U.S. laws, regulations, Nonproliferation policy; security cooperation and partnering activities; arms control treaties, agreements, and initiatives;
confidence and security building measure (CSBM) regimes; export control regimes;
conventional weapons and emerging arms control initiatives.
Continuously assess the impact of both USG and international Nonproliferation negotiations on Army operations, plans, force structure, training, and resources. The
Contractor shall continuously monitor and assess the status of negotiations in strategic treaties and other Nonproliferation fora.
Identify any impacts on Army policy development, Nonproliferation activities, operations, force structure development, training, and resource management considerations that are discovered.
Counter proliferation provides the following support:
Provide continuous support to DAMO-SSD to include study and assessment of USG, DOD, Joint, and Army CWMD Counter proliferation policy issues. The Contractor shall review and provide comment on CWMD-related and general requirements documents, e.g, Army Campaign Plan and Army Strategic Planning Guidance portions of The Army
Plan, Quadrennial Defense Review, Unified Command Plan, combatant commands and
ASCC plans. The Contractor may also provide research and analysis of USG, DOD, Joint, and Army CWMD policy and doctrine, e.g., DoD Directive 2060.2.
The Contractor shall provide operations, program management, and information technology staff support to DAMO-SSD to assist the office in the execution of its responsibilities for developing Counter proliferation policy using database management computer systems;
collecting, analyzing, presenting, communicating, and filing information related to Counter proliferation policy, implementation and compliance planning; and attending meetings, conferences, and briefings, as required. Prior to being assigned to work in an independent capacity at the Government site, Contractor personnel will be fully cognizant of the basic provisions of all existing and emerging Counter proliferation issues and initiatives that have a known impact upon the Army.
Consequence Management provides the following support:
Provide continuous support to DAMO-SSD to include study and assessment of USG, DOD, Joint, and Army CWMD Consequence Management and Surety policy issues, to include determining the impact of domestic, foreign and combat-related consequence management and nuclear, biological, chemical (NBC) surety on Army operations, plans, force structure, training, and resources.
The Contractor shall provide operations, program management, and information technology staff support to DAMO-SSD to assist the office in the execution of its responsibilities for developing Consequence Management and Surety policy using database management computer systems; collecting, analyzing, presenting, communicating, and filing information related to Consequence Management and Surety policy, implementation and compliance planning; and attending meetings, conferences, and briefings, as required. Prior to being assigned to work in an independent capacity at the Government site, Contractor personnel will be fully cognizant of the basic provisions of all existing and emerging Consequence Management and Surety issues and initiatives that have a known impact upon the Army.
This modification will serve as a bridge to ensure the continuity of both HQDA and SMDC support services until a new competitive contract vehicle can be established. The estimated amount for this 6-month period is $915,570.00.

B. Requiring Activity: Office of the Deputy Chief of Staff, Army G-3/5/7; Combating Weapons of Mass Destruction Policy Division (DAMO-SSD), 400 Army Pentagon, Washington DC
20310.
C. Option quantities and/or performance periods:
The period of performance on the proposed modification is a Base period of three (3) months beginning 29 March 2015 through 28 June 2015, with three (3) one (1) month options beginning
29 June 2015 through 28 September 2015.
4. Authority Cited: The authority for this modification to the existing contract is 10 USC
2304(c)(1) as implemented by FAR 6.302-1; Only One Responsible Source and No Other
Supplies or Services Will Satisfy Agency Requirements
5. Reason for Authority Cited: The contractor to provide the requested services is Science
Applications International Corporation, 1710 SAIC Dr. McLean Virginia 22102. SAIC represents the only responsible source capable of providing the required services from the time period of performance of the current contract ends until a competitive contract is awarded.
SAIC is the currently performing the services under this contract and the Government does not have adequate time to hire a new contractor and have them trained up on this requirement by the contract end date of 28 March 2015. This contract will expire on 28 March 2015 and despite the best efforts of the Government to award a competitive follow-on contract by 29 March 2015, this will not be obtained. The Army has experienced delays in developing the competitive package due to a number of factors, listed below:
There is currently only one Contracting Officer Representative (COR) under this contract due to the fact that he is the subject matter expert (SME) within the Army for a classified Weapons of
Mass Destruction (WMD). The COR has other duties that have taken priority over preparing the new requirements package for new contract.
The G 3/5/7 has an internal process that does not allow the COR’s to submit any documentation to the Contracting Office until the Services Contract Approval Requirements (SCAR) Form has been approved. This process does not allow the Contracting Officer to receive any other documents, such as the Performance Work Statement, Independent Government Estimate or
Acquisition Strategy that would allow the Contracting Office to begin the initial stages of the new competition. The package for initiating the process to advertise for a replacement contract was prepared and awaiting final HQDA G-3/5/7 approval in September 2014. In early October
2014, ASA (M&RA) issued an updated version of the SCAR Form that was required to be incorporated into all new contract approval packages. DAMO-SSD was made aware of this change mid-October. Because this new form contained a section entitled “Critical Functions” which asked questions that had not been addressed on previous forms, research had to be conducted to determine what functions were considered “critical” and “long-term.” Despite frequent attempts to hasten the process, it took more than two months to obtain clarification of the HQDA position on what constituted a critical function. Once that determination was made, the entire package had to be re-submitted for review and approval by senior HQDA G-3/5/7 leadership. The package with a signed version of the new form was submitted to ACC-APG in late December 2014. Additional time was lost due to holiday season minimum manning. In
January 2015, it was determined that there was not sufficient time remaining to award a replacement contract prior to the 28 March 2015 expiration of the period of performance.
Because of this, new documentation was accomplished to support a 6-month extension. All documents have been received as of 05 February 2015 and are in review.
The follow-on effort is being solicited under full and open competition, under solicitation number W91CRB-15-R-0015.
The original contract for this requirement was competitively awarded to SAIC 30 September
2012. The final option period expires 28 March 2015.
The following timeline outlines the procurement acquisition lead times for the new requirement.
The acquisition lead times further support the need for a 6-month extension:

6. Efforts to Obtain Competition: Sources Sought W91CRB-15-R-0015 was posted to
FedBizOpps via the Army Single face to Industry (ASFI) and to General Services
Administration (GSA) on 06 January 2015 in reference to the recompete of this effort. Both sources sought announcements closed on 13 January 2015. Eleven (11) responses were received, four (4) originating from the GSA announcement and seven (7) originating from the FedBizOps announcement. Of the total eleven responses received, at least six (6) were deemed technically capable. As a result of the sources sought responses the Government plans to release a solicitation using full and open competition. An intent to sole source was posted to Federal
Business Opportunities (FedBiz Opps) website on 03 February 2015 for the extension only. To date no responses have been received.
7. Actions to Increase Competition: Competition is being sought for the follow-on procurement as described in Paragraph 6. The requirements for the new contract have been established by the
Government. These requirements are included in the revised Performance Work Statement for the recompete solicitation.
8. Market Research: Sources Sought W91CRB-15-R-0015 was posted to FedBizOpps via the
Army Single face to Industry (ASFI) and to General Services Administration (GSA) on 06
January 2015. The sources sought closed on 13 January 2015. Responses were received from the following eleven (11) companies;
Of the responses, there were no 8(a) respondents, three (3) Small Business respondents and eight
(8) Large Business respondents. Based on the review of the submitted Capability Statements, it was determined that six companies are capable to perform this effort. Out of the six only one (1) was a small business. Per FAR 19.502-2, there must be at least two known Small Business capable in order to make this a Small Business Set a Side. Since there is only one known Small
Business capable, this will be solicited as Full and Open Competition.
9. Interested Sources: As stated in paragraph six and eight above eleven companies provided a capability statement showing their interest in the requirement. At least six of the companies were determined capable. In addition, future requirements will be competed to the maximum extent practicable as described in paragraphs 6 and 8 above.
10. Other Facts:
a. Procurement History: The DAMO-SSD originally procured this requirement through a firm fixed price type contract, W91WAW-12-C-0085, with SAIC. The contract period of performance was for one six (6) month base year with two (2) one (1) year option periods beginning 29
September 2012. The contract expiration is 28 March 2015.
b. Acquisition data availability: The solicitation for the follow-on contract to W91WAW-12-C-
0085 will be posted for full and open competition via the Army Single Face to Industry website under solicitation number W91CRB-15-R-0015.
c. Unusual and compelling Urgency: Not applicable to this action.
d. Subcontracting competition: Offerors will be required to address competition in subcontracting in their proposals. The appropriate subcontracting clauses are included in the solicitation and will be incorporated into the resulting contract.
e. Follow-On Contracts: Despite the best efforts of the Government to award a competitive follow-on contract prior to the current period of performance expiration, a follow-on contract will not be in place. In order to compete this six (6) month extension, the Government would realize unacceptable delays as it would take just as long, if not longer, to award a six (6) month bridge contract than the time required to award the competitive follow-on contract that is currently open for solicitation.
15. Competition Advocate for the Procuring Activity:
I hereby certify that this justification is accurate and complete to the best of my knowledge and belief. Based on the foregoing, I approve this sole source justification subject to availability of funds, and provided that the services and supplies herein described have otherwise been authorized for acquisition.
