Justification and Approval for Other Than Full and
Open Competition Justification
1. Contracting Activity: 182 MSG/MSC, Peoria, IL
Control No:
2. Description of Action: This approval is being requested for an annual HVAC controls services maintenance contract on the Siemen Apogee temperature control system.
3. Description of Supplies/Services: The Heating, Ventilation, and Air Conditioning (HVAC) system is managed and controlled through the Siemens Apogee temperature control system. Maintenance of this system is required to meet Presidential Executive Orders in regard to energy reduction/efficiency as well as for life safety, security, and comfort. Conducting preventative maintenance on this system will extend equipment life, reduce energy consumption, and reduce the risk of costly and disruptive breakdowns in service. Services required in the maintenance agreement include control loop tuning, data protection & data recovery services, network maintenance, preventative equipment/software maintenance, emergency response, customer directed support, operator training (initial and refresher), and software updates. The 182d Civil
Engineer Squadron does not have personnel assigned to perform these required maintenance functions.
Failure to acquire an annual service contract for the Siemens Apogee temperature control system will result in disruptive breakdowns impacting life safety, security, comfort, and energy reduction.
4. Authority Cited: Only one responsible source and no other supplies or services will satisfy agency requirements. FAR 6.302-1 Citations: 10 U.S.C. 2304 (c)(1) or 41 U.S.C. 253(c)(1)
5. Reason for Authority Cited: Siemens is the proposed contractor for the work requested because they are the only authorized company that can work on Siemens equipment/software. It is more cost effective to maintain the current system vs. purchasing an entirely new energy management control system which would also require periodic maintenance to ensure operability. Therefore, this request is for Siemens to provide all materials, tools, equipment, and labor necessary to provide annual maintenance to the Siemens Apogee temperature control system.
6. Efforts to Obtain Competition: Competition was conducted with contractors who provide maintenance on energy management control systems; however, because of copyright laws and patents, Siemens maintains all control and access to their system so no other contractor can maintain the system. Programming and hardware changes cannot be made by any other source.
7. Fair and Reasonable Cost: This cost of performing annual preventative maintenance has been determined to be fair and reasonable when compared to purchasing a new energy management control system which would also require periodic maintenance to ensure operability.
8. Market Research: The Government contacted Mr. Scott Schuetz of Siemens Industry Inc. He confirmed that Siemens maintains all control and access to their system. There are not any other companies which are capable of providing annual preventative maintenance services to the Siemens Apogee controls system.

9. Interested Sources: This service can only be purchased from Siemens Industry Inc.
10. Other Facts: Executive Order 13693, “Planning for Federal Sustainability in the Next Decade”, requires all federal agencies to reduce energy intensity 2.5 percent per year/25 percent total during the period
FY 2015 – FY 2025. The Siemens Apogee temperature control system is a key component of managing energy consumption, measuring consumption, and monitoring progress towards meeting the goals of the executive order. We would not be able to meet the goals of EO 13693 without this system operating at maximum efficiency through periodic preventative maintenance.
