FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items – Sole Source Justification and Approval
1. Contracting Activity: ACC APG Huachuca
Bravo Branch 2133 Cushing Suite 3410 Ft Huachuca, AZ 85613
2. Description of Action: Rock Island Arsenal (RIA) Network Enterprise Center (NEC) requests a Firm Fixed Price contract with 1 base year and 3 option years with Harris offering genuine hardware (HW) and software (SW) support for the RIA Harris “P25” Land Mobile Radio (LMR) emergency responder system supporting RIA. The Government projects award for July 2018 and fiscal year 2018 O&M funds will be used.
An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
approved an acquisition plan in accordance with DFARS 207.103(d)(i)(B) on.
The required acquisition plan in accordance with DFARS 207.103(d)(i)(B) is currently awaiting approval.
3. Description of Supplies/Services: This requirement is for HW and SW support of the Harris “P25” LMR emergency responder system (e911) installed at RIA in 2016 that came with 2 years of support built into the installation project. That support expired April 2018. This system is the receiving end of a 911 call on RIA. It accepts the calls, locates the caller, notifies and routes appropriate responders, tracks the progress of the call and keeps the responders in communication with each other and the home base.
The system is a complicated combination of different brand name servers, routers, switches, storage area devices, consoles that provide first responder communication services supporting RIA. The system is maintained by Harris or their designated geographical partner for HW and SW (operating system) support that is proprietary to Harris. RIA is requesting 1 base year and 3 option years with a projected period of performance to start 01 July 2018 or as required for required solicitation time.
Base Period: 01 July 2018 to 30 June 2019 Value: $164,893 approximate Option Period 1:01 July 2019 to 30 June 2020 Value: $170,489 approximate Option Period 2:01 July 2020 to 30 June 2021 Value: $178,350 approximate Option Period 3:01 July 2021 to 31 June 2022 Value: $185,450 approximate
Total Value: $699,182 approximate
The solicitation for the option periods above will also include reinstatement fees as applicable on a monthly basis so the requiring activity can plan for additional costs if funding is not programed timely for option execution. As of this writing, the reinstatement fees are unknown. Preliminary market research indicates that Harris does not charge reinstatement fees, however, the solicitation will provide the opportunity if necessary.

4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 (or 41 U.S.C. 1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5:
Unusual and compelling urgency Exclusive licensing agreements Industrial mobilization Other:
5. Reason for Authority Cited:
The LMR system supporting the emergency responders on RIA was installed by Harris Corporation in 2016. It is a complicated system of 53 individual components of assorted brand name information technology (IT) HW and SW appliances and applications that was engineered and custom designed to work together as one integrated system providing first responders’ communication support.
As the system is only 2 years old, it is still supported by Harris with Army Information Assurance Vulnerability Alerts (IAVA) which provides security and stability for the system. The proprietary support provides SW support for each integrated appliance, operating system (OS) patches and updates for servers and storage area network (SAN), firmware updates and HW support for failed replacements. This hardens the system against intrusions and vulnerabilities on a monthly or quarterly basis, as applicable.
As the system is still supported by Harris and not end of life, the proprietary system cannot be maintained by general IT HW and SW technicians or non-Harris partners.
Attempting to do so would violate the integrity of the overall system, security protocols, and Harris’ exclusive proprietary design of the system. This could cause system failure.
The system was designed and installed by Harris. Harris is a known leader in Emergency Communication systems and has active Government Wide Acquisition Contract (GWAC) vehicles to update and replace aging infrastructure emergency radio response systems on Army installations nationwide. Harris provides LMR systems to cities, counties, states and other federal agencies.
Harris has no retail partnerships to market their services. They deal direct with each customer. Should the government elect to obtain the services from another retailer, the services will increase in cost as there is no preferred pricing source or value added retailer authorized by Harris. Harris is the only entity authorized to provide SW and OS updates to the databases and SW applications. While other IT technicians might be able to replace a hard drive or power supply on the appliances and servers, Harris designed the system to function as a whole. The HW was configured to integrate with other HW specifically for the functionality of LMR using proprietary OS and SW systems written, maintained and controlled by Harris.

Alternatives to Sole Source:
The alternatives to purchasing support from Harris are not cost effective. The LMR system is not end of life and should not be individually maintained by each respective brand name manufacturer or a generic IT technician. It was engineered and specified to work together as a whole system providing a specific functionality with customized coded SW and OS systems integrated for emergency responder communications.
IF the system were end of life, individual HW support from each respective brand name manufacturer might be the only effective solution to maintain HW support while waiting for a new LMR installation.
However, RIA has a relatively new updated system and there is no value to the government to undermine the system effectiveness and proprietary design of the current LMR system. It would be to the government’s detriment to undermine the proprietary system that was installed at cost of $2,775,000.00 in 2016.
Discontinue Maintenance:
Should RIA or NETCOM leadership decide to not purchase maintenance and “accept the risk” of no support, the HW and SW platforms would be vulnerable to outages from failed HW and security SW vulnerabilities and threats. “Accepting the risk” of no HW/SW support could cripple a functioning system with no trade off benefit to the government.
Impact:
LMR supports first responders: fire, police and medical personnel responding to emergencies at RIA. There are over 6000 people employed by RIA and several hundred residents on RIA a 900 acre installation. The installation would be without emergency communication if the LMR system fails due to insufficient maintenance.
6. Efforts to Obtain Competition: This contracting office did market research for Harris authorized partners on Computer Hardware Enterprise Software and solutions (CHESS) and GSA for this opportunity. Harris confirms that if another vendor is used, there is no cost savings to the government as there are no preferred pricing retailers; any retailer acting on behalf of Harris in response to this opportunity would be marking up the Harris original quote with no added value to the government. Harris does not offer any retailer preferred pricing. It is anticipated to be solicited as a combined notice/solicitation to Harris direct. Option years will be requested and evaluated.
7. Actions to Increase Competition: The system as configured includes many IT manufacturers which benefit from continued partnerships with Harris. None of the system is 100% Harris manufactured except for the OS and SW configuration. In this case, Harris would be the prime and the assorted HW and SW manufacturers would be subcontracted under Harris. Any external retailer acting as a partner to Harris for this

For Official Use Only opportunity will only increase the cost, as Harris does not offer preferred pricing for retailers.
8. Market Research: This Contract Specialist reviewed the Harris website, RACOM website (regional partner of Harris), GSA and CHESS for Harris partners. GSA has a number of Harris contracts; none were found on CHESS. In addition, several CHESS retail representatives were called to inquire if there were existing Harris partnerships in place not evidenced by the CHESS catalogs. Several CHESS vendors indicated they had relationships for specific Harris HW appliances but none for the P25 system as a whole at RIA. This Contract Specialist reviewed other similar purchases for Harris LMR system renewals and found no alternatives to sole source.
9. Interested Sources: Harris does not offer preferred pricing to other retailers. Other sources would increase cost (overhead mark-up) at no additional value.
10. Other Facts:

13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable.
A review of previous contracts for other recent Harris systems found pricing for Ft.
Bragg’s system (W91RUS-17-P-0244) at $377,263 (+-) per year and Ft. Leavenworth’s system (W91RUS-16-P-0461) at $360,816 (+-) per year, both with option years included.
Ft Bragg is the largest military installation in the world with more than 50,000 active duty personnel and a residential population of 29,183. It covers over 251 square miles. Ft.
Leavenworth is the oldest with 12733 (approximate) personnel and residents and is more comparable to RIA in square miles. To compare:
As indicated above, both Bragg and Leavenworth’ s yearly costs while over double the estimated cost of RIA’s support, due to the large size and economies of scale, the per square mile cost is cheaper for the larger facility. The Ft. Bragg list of equipment was much more extensive with hundreds of components compared to RIA’s 53. On a per person evaluation, Leavenworth’s cost at $28.34 per person establishes fair and reasonable cost for RIA.
The system is customized for each facility; there are no catalog or standard off the shelf pricings for customized support of IT HW/SW performing as an integrated LMR system.
The IGCE for the system was estimated at $187,000.00 for the base year only.
This determination will be made using the following: price analysis cost analysis IGCE audit: other:
As a part of this basis, certified cost or pricing data is not required because the item and/or services being acquired are considered commercial.
14. Contracting Officer Certification and Approval: I certify that this justification is accurate and complete to the best of my knowledge and belief.
Based on the foregoing justification, I hereby approve the procurement of Rock Island Arsenal renewal of Land Mobile Radio Hardware and Software renewal (1 base and 3 option years) on a sole source basis pursuant to the authority of the Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5, subject to availability of funds, and provided that the services or supplies herein described have otherwise been authorized for acquisition.
