SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

AMENDMENT 1

1. The purpose of this amendment is to;

A. Change Contracting Officer’ e-mail address to ADDENDUM TO FAR 52.212-1

INSTRUCTION TO OFFEROR – COMMERCIAL ITEMS; 5. GENERAL INSTRUCTIONS

FOR PREPARATION OF PROPOSAL; 2. SUBMISSION REQUIREMENT from Ms.

Nateeta Taylor to Mr. Pon Tran email: pon.v.tran.civ@army.mil.

B Change Technical Factor and responses to the questions as following.

ADDENDUM TO FAR 52.212-1 INSTRUCTION TO OFFEROR – COMMERCIAL ITEMS; 5. GENERAL

INSTRUCTIONS FOR PREPARATION OF PROPOSAL; (1) TECHNICAL FACTORS; Sub-factor 4.

Equipment Plan is revised as following.

FROM: The prime offeror shall submit copies of certification of vehicles (자동차등록증) with having capability to support bus services more than 1,200 passengers concurrently. The list shall be with owner’s name, bus plate number and manufacture. The buses shall be passenger type (commercial design) with seating capacity of 41 – 45, and the model year of the buses shall not exceed 7 years old from issuance date of this solicitation to meet the requirement.

TO: The prime offeror shall submit copies of certification of vehicles (자동차등록증) with having capability to support bus services more than 600 passengers concurrently. The list shall be with owner’s name, bus plate number and manufacture. The buses shall be passenger type (commercial design) with seating capacity of 41 – 45, and the model year of the buses shall not exceed 7 years old from issuance date of this solicitation to meet the requirement.

Question 1:

Given the annual budget of only about 500 million won, it is questionable whether it is necessary to include the condition of transporting 1,200 people simultaneously (approximately 28 buses) in the O&M Fund BPA BUS contract. With at least four companies expected to be selected through multiple choices, if each company can accommodate 1,200 people simultaneously, the total would be 4,800 people, which seems to be an oversupply.

We sincerely request that you consider lowering this requirement to 600 people, with its long-standing partnership with the USFK and unparalleled expertise and passion, may have the opportunity to be selected as the contractor.

Response 1. Please see the above.

Question 2.

It is heard that a current BPA contractor does not provide its owned buses as a prime contractor, instead its subcontractors are providing 100% of the required buses.

When an offeror is awarded this solicitation, will this kind of contract performance be acceptable?

As you know, this kind of subcontracting is illegal in Korea.

In addition, it is not clear whether the subcontractors are fully qualified for the current BPA requirements.

Response 2.

The Government will award to a prime contractor and the prime have all responsibility to perform the service.

2. All other terms and conditions remain unchanged.

SECTION SF 1449 - CONTINUATION SHEET

The following have been modified:

NOTE

INVITED CONTRACTOR STATUS IS NOT AVAILABLE FOR THIS REQUIREMENT:

All sources may submit a proposal or quote as applicable. However, the Republic of Korea (ROK)-United States (U.S.) Status of Forces Agreement (SOFA) precludes the U.S. Government from granting Invited Contractor or Technical Representative status to any offeror, for this requirement. All sources submitting a proposal or quote, as applicable, including U.S. sources, must already have, or obtain the requisite business license directly from the ROK Government, and conduct business in accordance with all applicable ROK laws, including but not limited to, rules and policies regarding labor, taxation, and immigration. If the initial proposal does not fully demonstrate this authorization and capacity, it will not be further considered for award. Whether an offeror demonstrates this authorization and capacity shall be determined by the Contracting Officer.

* The Price Proposal should be Korean Won (₩).

5.3. On/Off Ramps

5.3.1. The Government has the flexibility to remove (i.e., “Off Ramp”) and/or add (i.e., “On

Ramp”) contracts from the original BPA pool of vendors after the initial contract awards are made. The intent of the Government is to award to multiple vendors with the ability to add and/or remove awarded contracts during the contract period of performance in order to maintain a viable competitive environment.

a. Off Ramp - The Government may cease to award a call to a particular contractor if and when a contractor fails to submit an offer in response to an RFP for three (3) consecutive times without prior notification of “no offer” to the Contracting Officer or ten (10) times refusal to MCT ordering officer’s call per months or based on the Contracting Officer’s discretion. If this occurs, the Contractor will be suspended from submitting offers. Contractor performance under the call under the BPA will also be evaluated at the end of each year and that will be a factor in determining whether or not to be off ramped from the original BPA pool.

b. On Ramp – Even if off ramps are not implemented, new sources may be awarded new contracts. The Government will determine if it is in Government’s best interest to “on-ramp” and reopen the original solicitation to conduct a competitive solicitation process that may result in the addition of new contractors.

5.3.2. The Government to reserves the right to increase the total number of active contracts above the number of contracts originally awarded if it is determined to be in its best interests to maintain a viable competitive environment using the On Ramp procedures.

5.3.2.1. On Ramp Procedures - The Government reserves the right to reopen competition for awardees during the period of performance of the original contract. In the event an on-ramp procedure is used, the Government will advertise the reopening of the competition on https://sam.gov and awardees shall meet the same criteria established in the initial solicitation and any amendments. The evaluation and selection of awardees for any on-ramp will be exactly the same evaluation and award criteria used for the initial basic agreement.

5.3.2.2. Any new awardees will compete with the remaining original contractors over future requirements within the fair opportunity ordering procedures in the original BPA.

The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
