52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
• See below Addendum to FAR Clause 52.212-2 Evaluation-Commercial Items (OCT 2014)
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
ADDENDUM TO FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014)
The Government will award a contract resulting from this solicitation to the responsible offeror submitting the Lowest Priced, Technically Acceptable offeror that satisfies all terms and conditions of this solicitation. Technical plus past performance equal price.
Award will be made to the responsible Offeror submitting the Best Value Lowest Priced, Technically Acceptable (LPTA) offer that satisfies all terms and conditions of the solicitation. Offers will be evaluated for acceptability, but not ranked using the non-price factors/subfactors. All non-price factors and subfactors will be rated as either “acceptable” or “unacceptable”. In order to be considered for award, there must be an “acceptable” rating in every non-price factor/subfactor. In other words, a rating of “unacceptable” for any factor or subfactor will result in the entire offer being rated “unacceptable”.
The following ratings will be used in evaluating all non-price factors and subfactors:
Acceptable
Proposal meets the requirements of the solicitation
Unacceptable
Proposal does not meet the requirements of the solicitation
The following ratings will be used in evaluating Past Performance:
Acceptable
Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown (See note below).
Unacceptable
Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a) (2) (iv)).
Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.
FACTOR I. TECHNICAL CAPABILITY: Offeror’s qualification is in accordance with PWS Para 4. Each factor and sub factor will be rated either acceptable or unacceptable. A rating of unacceptable for any factor or sub factor will result in an overall unacceptable rating. If an offeror fails to meet the minimum requirements outlined in one of the two (2) subfactors below, and overall proposal will be rated unacceptable and will not be eligible for award.
Sub-Factor 1: Pianist’s Certification. The Offeror will be evaluated on provided a copy of certification a minimum of two (2) years studies or formal training as an Undergraduate of Piano performance major (verified by transcript).
Sub-Factor 2: Pianist’s Prior Experience The Offeror will be evaluated on provided pianist’s resume with at least two (2) years of experience in pianist service at chapel or church within the last five (5) years from the issuance date of this solicitation. The resumes must clearly identify as required below:
- Pianist full name
- A description of qualifying work experience
- Company Name/Employer, email/phone number of validating Point of Contact (POC)
- Length of work experience (year/month/date – year/month/date)
FACTOR II. PAST PERFORMANCE: Past performance will be evaluated on an acceptable/unacceptable basis. Offerors are authorized to provide information on the problems encountered on the identified contracts and the Offeror’s corrective actions. The Government may ascertain past performance information on the Offeror from sources other than the references provided. The offeror shall provide recent and relevant past performance as Pianist Service. Recent past performance is within the last five (5) years from the issuance date of this solicitation. Relevant past performance are those that are the “same or similar” services based on size, scope, complexity, and contract type. The past performance will be evaluated for all offeror’s proposals in the following manner:
(1) Review of the detailed explanation submitted by offerors demonstrating the relevance of the references to the requirements of the solicitation.
(2) References will be contacted by phone or email to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.
(3) The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance.
NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (See FAR 15.305(a)(2)(iv). Therefore, the offeror shall be determined to have unknown (or "neutral") past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable”.
FACTOR III. PRICE. Price analysis will be conducted for each proposal to ensure completeness and reasonableness IAW FAR 13.
END OF ADDENDUM TO FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014)
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
