5.1.OILY WASTE REMOVAL (TRUCK AND BARGE)

5.1.1.Oily Waste is defined as any liquid petroleum product mixed with wastewater and/or oil in any amounts, which if discharged overboard, would cause or show sheen on the water. The HSP shall dispose of any combination of oily waste and grey water as waste.

5.1.2.Oily Waste is measured by Cubic Meter (1CM = 264.2 Gallons). The Contractor shall submit, as an attachment to the invoices for disposal services, a document verifying the quantity collected and the name of the disposal plant where the oily waste have been or will be disposed. The Contractor shall include a written statement with the invoice package that describes the method it used to determine the liquid quantities off-loaded from the ship.

5.1.3.The Contractor shall comply with the environmental requirements of each country where oily waste is disposed and shall be liable for any costs incurred as a result of the Contractor’s failure to comply with such requirements. The Contractor shall keep all disposal certificates and shall make them available to Contracting Officers upon request. If the ship concurs with the volume, the ship will pay for the entire amount. If the ship contests the volume, the ship will pay for the amount it actually believes was pumped.

The HSP will submit a request to the Contracting Office for the difference, accompanied by disposal certificates. The Contracting Officers will investigate and resolve the issue, and will arrange for the ship to pay any amounts determined to be due.

5.1.4.Oily Waste Removal involves the collection of Oil and Aggregate Water generated by the ships. The requiring vessel will pump this waste into HSP-provided tanks or barges. The Contractor shall provide all equipment and facilities required to remove oily waste, including hoses and connections compatible with the ship being serviced. The Contractor shall provide hoses of sufficient length from equipment to the ship with either 2.5” or 4” quick disconnect cam lock fittings.

5.1.5.In all cases when a ship orders oily waste disposal services, the Contractor shall invoice and will be paid for the oily waste quantity pumped and disposed. The Contractor shall not invoice any charge for ships that do not order disposal services.

5.1.6.In the event the Contractor subcontracts oily waste disposal, the primary Contractor shall be liable for any costs incurred as a result of the disposal operator’s failure to comply with local requirements.

5.1.7.The Contractor shall accurately measure oily waste and aggregate water removed from the ship.

The ship’s duty engineer shall verify in writing the amount removed. The Government reserves the right to independently verify the volume of discharge using certified flow measuring devices.

5.1.8.When removal is done via barge, the Contractor shall provide a barge with fendering and a minimum of four (4) mooring lines to secure alongside the ship. The Contractor shall pre-position Oily Waste barges/trucks when necessary in accordance with Force Protection or other requirements. If sea state, weather, or other conditions, to include but not limited to the configuration of the vessel, the pier, or the barge, require any additional fendering between the barge (or other vessel provided in lieu of a barge) and the ordering vessel to supplement the barge’s self-fendering system so as to prevent damage to the vessel, the additional fendering shall be provided by the Contractor at no additional charge.

5.2.BREASTING BARGE.

5.2.1.The Contractor shall provide a breasting barge alongside the ship. The barge shall be able to tie up water taxis, have a non-slip surface for passengers entering or leaving water taxis, and have a surface smooth enough to allow the accommodation ladder to roll freely. The barge shall have suitable self-fendering to prevent damage to the ship a minimum of four (4) mooring lines suitable to withstand extreme weather conditions. If sea state, weather, or other conditions, to include but not limited to the configuration of the vessel, the pier, or the barge, require any additional fendering between the barge and the ordering vessel to supplement the barge’s self-fendering system so as to prevent damage to the vessel, the additional fendering shall be provided by the Contractor at no additional charge.

5.2.2.The Contractor shall place additional fenders between the breasting barge and the ship when requested.

5.2.3.Breasting barge or barges shall have a minimum length of 240 ft. and width of 80 ft. The Contractor is responsible, as part of its understanding of the requirement, for determining the appropriate barge size for each combination of vessel class and berthing configurations required at each lot. Barges provided shall be appropriate and safe for the class of ship and pier configuration combination. The barges provided shall be safe and usable for the intended class of ship at all locations specified by the lot.

CLAUSES INCORPORATED BY FULL TEXT

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JAN 2017)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.

Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)

1. CONTRACT AWARD

1.1 The Government intends to execute a Firm Fixed Price contract for De-fueling and Disposal of Waste/Oily Water and Lease of Breasting Barge. Award will be made to the responsible Offeror submitting the Lowest Price Technically Acceptable (LPTA) offer in accordance with the Federal Acquisition Regulation (FAR) Parts 12 and 13"Simplified Acquisition Procedures" that satisfies all terms and conditions of the solicitation. Offers will be evaluated for acceptability, but not ranked using the non-cost factors/subfactors. All non-cost factors and subfactors will be rated as either "acceptable" or "unacceptable". In order to be considered for award, there must be an “acceptable” rating in every non- price factor/subfactor. In other words, a rating of “unacceptable” for any factor or subfactor will result in the entire offer being rated “unacceptable.”

1.2. The Government reserves the right, based on the Government’s best interests, to make a determination to: 1) award without discussions; 2) make multiple awards for this requirement; 3) Establish a competitive range in order to conduct discussions. If an award cannot be made on initial offer and the Government determines discussions to be necessary, the competitive range will be established in considering technical, past performance and price evaluation factors to conduct discussions in accordance with FAR 15.306(a)(3); and/or 4) make no award if, upon evaluation, none of the proposals are deemed likely to meet the requirements.

2. REQUIRED SUBMITION AND INSTRUCTION:

1). These instructions are designed to ensure submission of essential information in order for the Government to understanding and evaluate proposals. Offerors are cautioned to follow the detailed instructions fully and carefully, as the Government reserves the right to make award based on initial offers received, without discussions with Offerors.

2). Offerors are cautioned to submit adequate information to enable the Government team to fully ascertain each Offeror’s capability to perform all of the requirements identified in the solicitation. All commitments made in the proposal shall become a part of the resultant contract.

3) Offerors are required to submit the following information requirements through Federal Business Opportunities (FBO) https://www.fbo.gov by 1300 hours (1:00 P.M.) Local Standard Time on the closing date: 24 March 2017. Confirmation of proposal submission prior to the closing date and time of solicitation is offeror's responsibility. Submitting proposal other than FBO will not be considered for an award. The offeror(s) shall round off all unit price to the nearest to the whole Korean Won (KRW), thereby eliminating the use of any decimal points.

Note: The Government intends to evaluate and make award without discussion with the offerors (other than minor clarifications), unless discussions are determined to be necessary. If discussions are determined to be necessary, then the Contracting Officer reserves the right to limit the competitive range for the purposes of efficiency.

FACTOR I – TECHNICAL: All subfactors under technical factors are equally important and shall be evaluated on an acceptable or unacceptable basis. A rating of uncceptable for any factor or subfactor will result in technically unacceptable rating. Failure to provide documents addressed below will result in a rating of unacceptable.

Sub-Factor 1 - Contractor Business License: The offeror shall submit a copy of valid ship agency license

(해운 대리점업 or 해운중계업 등록증) granted by the Government of Republic of Korea (ROK) authorities. The license shall provide a copy of both the English and Korean version.

FACTOR II - PRICE

The offeror shall provide complete the pricing information for each Contract Line Item

Number (CLIN) identified to include:

(a) Schedule of Services (CLINs);

(b) Prices shall be in local currency (Korean Won)

Pricing shall be included for all CLINs (Prices shall be in Korean Won). Price analysis will be performed to determine the total evaluated price is fair and reasonable to support the selection of the lowest priced technically acceptable offeror. To determine total evaluated price, all fixed priced CLINs will be added to the total extended prices of requirements.

4). Signeded Solicitation and Amendment: Signed first page of the solicitation (SF1449) and each amendment (SF30) (if any amendment were issued).

5) Local Clause 5152.204-4032, Representations and Certifications: The offeror shall submit completed Local Clause 5152.204-4032, Representations and Certifications. The offeror shall indicate specific types and quantities of POL products upon which offeror's based and for which tax exemption is allowed in the "Represenations and Certificates."

6) The offeror shall provide point of contact (POC) name and phone number.

NOTE: Questions will be addressed to SSG Min C. Jhun, Contract Specialist at min.c.jhun.mil@mail.mil or Ms.

Chong, Hyon Suk, Contracting Officer at .hyonsuk.chong1.ln@mail.mil. All written questions must be received no later than 10:00 hours on 23 March 17 (local time). Questions received after this date and time may not be answered.

3. PRE-AWARD SURVEY

A pre-award survey may be conducted on all firms, to include joint venture partners and subcontractors indicating firm commitments to this acquisition, submitting proposals. The pre-award survey is to determine the prospective contractor’s responsibility in accordance with FAR Part 9.104-1. Information may be requested as required by the Contracting Officer and the information shall be submitted within three working days of the request.

NOTE: The proposals are intended to be evaluated, and award made, without discussions with the offerors (other than minor clarifications) unless discussions are later determined to be necessary.
