JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Agency/Contracting Activity: 411th Contracting Support Brigade Korea Unit#15289, APO AP 96205-5289.
2. Description of Action: This action is to gain approval for sole source procurement of hotel room rental services for USFK Soldiers.
Nature: Follow-on Requirement
Pricing: Firm-Fixed Price
Funds: Military Personnel Amy (MPA)
Fiscal Year of Funds: FY15 or proper fiscal year MPA funds.
Name of Proposed Contractor:
Dragon Hill Lodge (DHL) Street Address: Unit #15335 City, State, Zip: APO AP 96205-5335 Phone: (DSN) 738-2222
3. Description of Services or Supplies:
The total estimated value of the proposed action is $4.8M for 5 years.
This proposed requirement is to provide a renewal Blanket Purchase Agreement (BPA) or a new Requirement Contract to the previous Dragon Hill Lodge BPA W91QVN-09-A-0002. The 19th Personnel Company (19th PC) requests authorization to use Dragon Hill Lodge to provide lodging for all incoming personnel to the peninsula. The contractor (DHL) is to oversee the existing system; to ensure all personnel have adequate temporary lodging going through the 19th PC mandatory three day in-processing.
4. Authority: FAR 13.501(a), Sole Source (including brand name) Acquisitions.
FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements, 10 USC 2304(c)(1)
FAR 6.302-2: Unusual and Compelling urgency, 10 USC2304©(2)
FAR 6.302-5: Authorized or Required by Statute, 10 USC 2304©(5)
Other: FAR 13.501(a), Sole Source Acquisitions
5. Reasons for Authority Cited:
a. The 19th PC policy memorandum “All Incoming U.S. Army Personnel Assigned to the 19th Personnel Company” dated 19 June 2014 states that PVTS –SSGs are not allowed to leave post at any time while in-processing here in Yongsan, Korea.
b. Further, even if the policy were changed, 19th PC personnel conduct physical readiness training, height, weight and taping screening as part of the mandatory in-processing of incoming soldiers, housing soldiers off post prevents them from completing in-processing due to lack of transportation before 0900. Housing soldiers off post would prevent those soldiers from completing the Army Body Composition Program screening, a mission critical activity, at the prescribed time.
6. Efforts to Obtain Competition: No efforts will be made to obtain competition for the reasons stated in paragraph 5 above. The Government cannot solicit this requirement to ascertain information on potential sources because DHL, located on the USAG-Yongsan compound, is the only available source that can provide lodging services to U.S. military personnel in accordance with the 19 June 2014 19th PC policy memorandum.
7. Actions to Increase Competition: No actions were taken to increase competition for this particular requirement on the basis of facts described in paragraph 5 above. The Government does not envision any change in circumstances which would change the sole source
8. Market Research: A review was conducted of other existing hotel BPAs in FSC Group V231 Lodging. Published room rates, commercial hotel business terms and conditions were determined to be comparable to other BPA holders in Korea. However, Dragon Hill Lodge is the only source available to that allows in-processing soldiers to meet the requirements of the 19 June 2014 19th PC policy memorandum.
9. Procurement History:
