However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. Addendum to FAR 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (MAR 2020).
1) BASIS FOR AWARD:
1.1. The Government intends to award a single Firm Fixed Price (FFP) contract with Requirements CLINs for task orders for the Maintenance and Repair of Electronic Security Closed Circuit Television (CCTV) Eight Army, Korea Wide. Award will be made using source selection procedures in accordance with Federal Acquisition Regulation (FAR) Part 12 “Acquisition of Commercial Items” in conjunction with the policies and procedures prescribed in FAR Part 13.5 “Simplified Acquisition Procedures for Certain Commercial Items” as appropriate and the Department of Defense Source Selection Procedures and Army Source Selection Supplement.
This acquisition will be conducted using the Lowest Price Technically Acceptable (LPTA) process; therefore, award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. In order to be considered for award, there must be an “acceptable” rating in every non- price factor/sub-factor. In other words, a rating of “unacceptable” for any factor or sub-factor will result in the entire offer being rated “unacceptable”.
1.2. To be determined technically acceptable, all factors must be acceptable to obtain an acceptable rating for the technical proposal. The proposals are intended to be evaluated, and awarded without discussion with offerors.
However, if the award cannot be made on initial proposals, the Government will negotiate with all offerors in the competitive range. The Government reserves the right to limit the number of most highly qualified offerors selected for the competitive range negotiations for the purposes of executing an efficient competition. Offerors are required to submit the following information: 1) Technical Capability, 2) Past Performance, and 3) Price Proposal, by the closing date/time of RFP. Failure to submit as required shall be grounds for determining the offeror to be technically unacceptable and ineligible for contract award.
NOTE: A RATING OF UNACCEPTABLE FOR ANY FACTOR OR SUB-FACTOR WILL RESULT IN
AN OVERALL UNACCEPTABLE RATING.
FACTOR A: TECHNICAL: The Offeror’s proposal shall contain all technical factors/subfactors of their technical capability which demonstrates a clear understanding and ability to execute all PWS requirements. All sub-factors under Technical factors are of equal importance and shall be evaluated on an acceptable or unacceptable basis. A rating of unacceptable for any factor or subfactor will result in a technically unacceptable rating. Failure to provide documents addressed below will result in a rating of “Unacceptable”.
Sub-factor 1- Prime Contractor’s Business License and Certificate: The Offeror shall submit both English and Korean versions of all valid and current Certificates and Licenses issued by the Republic of Korea (ROK) for requirements identified below:
1) License of registration of Information and Communication Construction Business
(정보통신공사업사업증)
2) License of registration of Electrical Construction Business (전기공사업등록증)
Sub-factor 2- Quality Control Plan (QCP): The Offeror shall submit a Quality Control Plan (QCP) that demonstrates the Offeror’s approach to conducting comprehensive quality control. The QCP shall clearly describe the Offeror’s quality control methods and practices such as standardized procedures to monitor performance, identify discrepancies, and take corrective action to prevent re-occurrences. As part of the QCP, the Offeror shall identify what items the Offeror will inspect under its comprehensive QCP for each task listed in the PRS table.
FACTOR B – PAST PERFORMANCE: The past performance factor considers the offeror’s demonstrated recent and relevant record of performance in supplying services that meet the contract requirements.
