B. General Instructions

1. The selection process for this award will be made on Lowest Price Technically Acceptable (LPTA) basis.

Noncompliance with the Request for Proposal (RFP) requirements may impede the Government’s ability to properly evaluate the proposal and may result in the elimination from further consideration of the proposal.

2. The submission of documentation will constitute the offeror’s acceptance of the terms and conditions of the RFP, concurrence with the Performance Work Statement (PWS), and contract type.

3. It is the Government’s intention to award without discussions. Initial proposal submission should contain the offeror’s best technical proposal and prices. If discussions become necessary, the Government reserves the right to them.

4. The offeror’s proposal shall consist of the following:

a. Solicitation- Each base and option CLIN must have an associated price listed in the document. ECMRA CLINs:

0006/1005/2005/3005/4005 are “Not Separately Priced” (NSP).

b. Pricing Proposal (separate from the SF1449 and the technical proposal) - The Price proposal will include a line-by-line breakout to include fully burdened labor categories, material and equipment costs and all applicable profit/overhead, mobilization and security costs, etc. The price breakdown must include costs for each contract period (base period and all option periods). The prices shall be consistent with the written portion of the technical proposal.

c. Technical Capability Proposal- must include:

1. A detailed/descriptive approach that demonstrates how the vendor can meet/exceed the technical requirements as outlined in the PWS section 5.1 through 5.4.

2. A Quality Control Plan

3. Resumes and CDL’s for each Key Personnel (Program Manager/Alternate Program Manager/Tractor

Operator) which clearly demonstrate that the key personnel proposed have the following:

i. A minimum of three (3) years’ experience as a direct supervisor of grave liners delivery and installation operations in commercial or public site(s).

ii. Experience and knowledge in the grave lines delivery, installation, removal and heavy equipment handling such as flatbed trucks and vault carts for transport and installation with burial section

iii. Key Personnel not yet employed by the vendor must have a letter of commitment signed by the employee stating that he/she will begin employment with the offeror by/before the start of the first period of performance if the offeror receives award of the contract.

d. Past Performance information is not necessary because CPARS is conducted during the evaluation period.

5. All documents for this solicitation are available on the Federal Business Opportunities (FedBizOpps) web site at http://www.fedbisopps.gov.

6. The offeror agrees to hold prices in its offer firm for 60 calendar days from date of receipt of offers.

7. System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. The NAICS code prescribed in the solicitation will also be reflected in the SAMs record for the prospective awardee. If the

Offeror does not become registered in the SAM database in the time prescribed by the KO, the KO will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM.

EVALUATION FACTORS

Evaluation Factors for Award

BASIS FOR AWARD

The award will be made to the lowest priced technically acceptable proposal. All proposals will first be evaluated on technical acceptability – to include past performance. Non-price Factors and Sub-factors will not be used to rank proposals. A proposal must receive an “Acceptable” rating in every non-price Factor to be considered for award.

Proposals receiving an “Unacceptable” rating in any non-price Factor will be deemed ineligible for award.

FACTORS TO BE EVALUATED

The following factors shall be used to evaluate offers: Factor I – Technical, Factor II – Past Performance, and Factor

III – Price.

The following factors shall be used to evaluate offers:

1. Technical (including the below)

a. Demonstrated capability

b. Quality Control Plan (QCP)

c. Key personnel

2. Past Performance

3. Price

FACTOR I – TECHNICAL

A) In order to be found acceptable, the offeror’s technical proposal must demonstrate the capability of the vendor to meet/exceed the technical requirements as outlined in the PWS Part 5. Acceptable proposals will clearly define capability, to include a detailed/descriptive approach with supporting documentation for, at a minimum, PWS paragraphs 5.1, 5.2, 5.3 & 5.4.

B) In order to be found acceptable, the QCP will show clear capability to meet the minimum requirements as outlined in PWS paragraph 1.6.1.

C) In order to be found acceptable, the resumes and CDL certifications of the key personnel (Program

Manager/Alternate Program Manager/Tractor Operator) must clearly indicate that the individuals have:

-- a minimum of three (3) years’ experience as a direct supervisor of grave liners delivery and installation operations in commercial or public site(s);

--experience and knowledge in the grave liners delivery, installation, removal and heavy equipment handling such as a flatbed trucks, and vault carts for transport and installation within a burial section;

--a current, valid CDL

If the proposed key personnel is not yet an official employee of the vendor, in order to be found acceptable, a letter of commitment signed by the employee is required that he/she is committed to begin work with the specifically-named successful offeror by/before the start of the first period of performance. Letters of commitment for the same individuals with multiple offerors that depend on the offeror’s receipt of award of the contract will be found acceptable.

FACTOR II. PAST PERFORMANCE

Past performance will be evaluated to determine whether or not, based on the offeror’s performance record, the

Government has a reasonable expectation that the offeror will successfully perform the required effort. The

Contractor past performance rating will be based on an “Acceptable” / “Unacceptable” basis. Contractor

Performance Assessment Reporting System (CPARS) will be reviewed for each evaluated vendor to determine if the offeror will satisfactorily provide the required services based on relevant experience. A contract is relevant if similar in complexity, value and services provided. Performance must have taken place no more than five (5) years prior to the proposal due date.

***NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have "NEUTRAL" past performance. In the context of acceptability/unacceptability, “NEUTRAL” shall be considered “ACCEPTABLE.”

FACTOR III. PRICE

Price will be evaluated to determine if the offers’ proposed price is fair, reasonable, and balanced in accordance with the guidelines in FAR 15.404.

As part of the price evaluation, to account for the option period(s) possible under Clause 52.217-8 (maximum six months) “Option to Extend Services,” the Government will take the price for all CLINS of the final option period, prorate it to a six-month value, and add it to the sum of all CLINS (base plus four (4) option periods). This amount will be the Total Evaluated Price (TEP).
