Action: Exception to Fair Opportunity

II. Nature And/Or Description of the Action Being Approved

The purpose of this Fair Opportunity Exception (FOE) is to seek authority to add an additional six-month period of performance option and a pre-priced, six-month Extension of Services (EOS) for the Information & Resource Support System (IRSS) Program, W91QUZ-06-D-0016, 6H36, to continue sustainment and maintenance support efforts. Currently the IRSS prime contractor, performs baseline software maintenance and functional system administration for systems and applications that are currently in sustainment. The proposed period of performance (PoP) for the six-month option is 26 September 2015 – 25 March 2016 and an EOS option period of performance for a maximum of six-months (26 March 2016 – 25 September 2016). The proposed six-month option and EOS periods are contemplated to provide time for the Government to put in place a new task order for the competitive effort awarded under the NETCENTS-2 Small Business Companion Contract.

III. Description of the Supplies/Services Required To Meet the Agency’s Needs

The Legacy Support Systems Branch, Air Force Materiel Command (AFMC) Air Force Life- Cycle Management Center Business Enterprise Systems AFLCMC/HIBB, located at Wright- Patterson Air Force Base (WPAFB), OH, is responsible for sustainment of certain Secretary of the Air Force (SAF) Information Technology (IT) programs. AFLCMC BES/HIBB is the Program Management Office (PMO) for IRSS. IRSS is a web-based application running on the Global Combat Support System – Air Force (GCSS-AF) Integration Framework (IF), accessed via the AF Portal. IRSS is deployed on the Secure Internet Protocol Router Network (SIPRNET) instantiation of GCSS-AF. IRSS exists to automate the Joint Capabilities Integration & Development System (JCIDS) process for the approval of new war-fighting requirements.

Management of the IRSS application follows the Business Enterprise Systems (BES) Process Directory (BPD), formerly the BES Standard Engineering Process (SEP).

IV. Authority Permitting a Fair Opportunity Exception

FAR 16.505(b)(2)(i) requires the Contracting Officer to provide each awardee under a multiple award contract, a fair opportunity to be considered for each order exceeding $3,000.00 unless a statutory exception applies. The specific exception that precludes the fair opportunity process for this acquisition is FAR 16.505(b)(2)(i)(C); logical follow-on. The agency need for the services must be ordered on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract. All awardees were given a fair opportunity to be considered when the original order was issued.

V. Demonstration of the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above to Provide the Required Supply/Service (Applicability of Authority)

FAR 16.505(b)(2)(i)(C) The agency need for the services must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

Work that will be performed under this task order modification is identical to the work that is now being performed under the current task order W91QUZ-06-D-0016-6H36. This was a competitive acquisition awarded 26 September 2012 under the Army’s Information Technology Enterprise Systems – II (ITES-2S) Indefinite Delivery Indefinite Quantity (IDIQ). Therefore this acquisition is for continued performance of the function listed in aforementioned Section III.

An additional six-month option period will provide the Government the minimum time to put in place a new NETCENTS-2 competitively awarded task order. If the additional option period is not approved, a break in service will occur (current period of performance ends 25 September 2015). The soonest possible time for a competitive award for the new period of performance is 26 March 2016. The incumbent is currently performing services required to support IRSS and is qualified to continue to provide the same level of support during the proposed new option period.

In addition to performing the services for the current task order, the incumbent also maintains government furnished property (GFP) for use on IRSS. A decision to not sole-source for this period of service would result in a loss of economies and efficiencies for the government as the transition period to a new contractor will take approximately forty days to occur. During this transition period, both the new awardee and incumbent will be on contract to accomplish the transition. Should the government decide to compete the six month option, within the time it would take a new contractor to become efficient, the PoP would be completed. A second transition period will also be required in order to transition the GFP to the new awardee under the mandatory use NETCENTS-2 contract at the end of this period of performance. Additionally, issuing the proposed extension as a logical follow-on to the incumbent would preclude any unacceptable delays in maintaining the current support pending the completion of a competitive award under NETCENTS-2. The other alternative to sole-sourcing this action is a break in service. A break in service would result in both operational and security impacts to the system as explained in Section IX.

VI. Description of Efforts Made To Ensure Competition Between All Awardees

In accordance with FAR 16.505(a)(1) and FAR 5.202(6) orders under indefinite-delivery contracts are not required to be synopsized. Paragraph V above justifies why competition among all awardees is not possible for this acquisition. The combination of the proposed six-month option period and the (up to) six-month extension of services period of performance will allow sufficient time for the competitive effort to be awarded under NETCENTS-2.

VII. Determination by the Contracting Officer That The Anticipated Cost to the Government Will Be Fair and Reasonable

The current task order, 6H36, awarded off the ITES -2S IDIQ (W91QUZ-06-D-0016), includes negotiated labor categories and rates detailed in the B-Tables. The incumbent has adhered to the negotiated rates on all of task order 6H36’s option periods thus far. It is anticipated that the contractor will propose pricing for the additional option periods based off these B-Tables of the basic contract. The rates used for the current task order were discounted from the maximum labor rates listed in the B-tables. It is anticipated that discount the rates will be used for this logical follow-on as well. The Government will evaluate the proposed quantity and mix of labor hours and proposed rates for this effort and make a determination that the total price is fair and reasonable. In accordance with FAR 52.217-8, the Government will require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. Therefore, the contracting officer hereby determines that the anticipated cost to the Government will be fair and reasonable.

VIII. Description of Market Research Conducted Among All Awardees and the Results Or A Statement of the Reason Market Research Was Not Conducted

Market research was conducted for the initial task order which was competitively awarded under the Army’s ITES-2S IDIQ as mentioned previously. The competitive award resulted in significant total costs savings during execution of the program which consisted of a one year base year and two 1-year option periods. The extension of services clause was included in the task order but was not evaluated prior to award.

Based upon the initial contract market research that was performed and the six month option with t EOS PoP being a logical follow on with the same work requirements, no additional market research was conducted. In order to prevent a break in service, an additional option period must be added and exercised by 26 September 2015.

IX. Other Facts Supporting the Justification

If the FOE to add a six-month option and evaluate the EOS is not approved, IRSS will experience a work stoppage. This break in service will have both operational and security impacts to the system.

Operationally, the IRSS system will suffer a loss of all baseline software maintenance and experience a work stoppage of Help Desk Support levels one and two. This will have a negative impact on the timeliness and effectiveness of Air Force Senior Leaders’ decision making.

Additional repercussions will be felt as the work stoppage will cripple the Air Force Requirements Oversight Council and Joint Requirements Oversight Council (AFROC/JROC) process, diminishing the capability to provide new operational capability to the warfighter in a timely manner. GCSS-AF IF will lose both their program management and support from IRSS.

A contract break-in-service for IRSS would adversely impact the confidentiality, integrity and availability of the application.

The security of IRSS will be impacted because system sustainment is totally dependent on Contractor support. Government personnel do not have sufficient knowledge or expertise to accomplish this requirement in the absence of Contractor support.

X. List of Any Awardee That Expressed Interest in the Acquisition

XI. Actions the Agency May Take to Remove or Overcome Any Barriers To Increasing Fair Opportunity Before Any Subsequent Acquisition For the Supplies or Services

The competitive effort for sustainment services is currently being competed using the NETCENTS-2 vehicle FAR 16.5 IDIQ based on Market Research conducted by the NETCENTS-2 team. Additional market research for the competitive IRSS effort was conducted among the NETCENTS-2 Application Services, Small Business Companion awardees by issuing a questionnaire on 2 October 2014. A final report was completed on 27 October 2014.

Currently a draft RFP is expected to be released to the NETCENTS-2 Application Services, Small Business Companion awardees by 10 July 2015 for the follow-on competitive effort.

Additional file reviews and approval levels have been added to the BES acquisition process, which has extended the time period to complete the award of the competitive effort.
