4. Authority:

ORDER AGAINST MULTIPLE AWARD ID/IQ CONTRACT: Section 803 of the

National Defense Authorization Act of 2002 (PL 107-107), FAR 16.505(b)(2) and DFARS 216.505-70(b), the contracting officer shall give every awardee a fair opportunity to be considered for a delivery/task order. Mark the applicable exception:

A statute expressly authorizes/requires that purchase be made from a specified source [DFARS 216.505-70(b)(1)]

Item peculiar to one manufacturer (a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer) [FAR 16.505(a)(4)].

Urgent agency need precludes fair opportunity [FAR 16.505(b)(2)(i)(A)] Only one awardee is capable because supplies or services are unique or highly specialized [FAR 16.505(b)(2)(i)(B)] In the interest of economy and efficiency, the order is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order [FAR 16.505(b)(2)(i)(C)]

It is necessary to place the order to satisfy a minimum guarantee

5. Rationale/explanation to support cited authority: For this action, PM MC required brand-name MySQL Enterprise Edition software subscriptions. These software subscriptions are Commercial Off-The- Shelf (COTS) products available via the Army’s Computer Hardware Enterprise Software and Solutions (CHESS) program. Pursuant to Army Federal Acquisition Regulation Supplement (AFARS) Part 5139.1, the Army’s CHESS program is the mandatory source for commercial Information Technology (IT) purchases of computer software and hardware.

The Microsoft SQL Server is comparable with existing software in use at the BFT Network Operations Centers at Aberdeen Proving Ground and Fort Carson. It meets the requirements derived from the JBC- P Capabilities Description Document (CDD) approved by the JROC (Joint Requirements Oversight Council) and thereby ensures the JBC-P is meeting performance parameters and operations requirements. The Microsoft SQL Server complies with AR 25-2 since it has undergone testing and security measures in order to ensure it is safe for use on government computers. MY SQL is the only software approved through this process and therefore is the only software that can be used which meets the requirements derived from the JBC-P CDD.

6. Market Research: In accordance with AFARS 5139.1 and Army Regulation 25-1. The Government conducted Market Research, on 22 October 2014, via the CHESS Enterprise License Agreements (ELA) and Enterprise Software Initiatives (ESIs) for this commercial requirement. The Microsoft SQL Server was found to be available on CHESS ESI contract #W91QUZ-06-A-0002 through DLT, an authorized Oracle America Inc reseller. The Government obtained a quote and determined the vendor’s product meets Government requirements and specifications.

7. Actions to Increase Competition: In accordance with AFARS 5139.1 and Army Regulation 25-1, the Government assessed competition via the CHESS e-mart. Currently a contract is available through Enterprise Software Initiatives on CHESS. The Government will continue to conduct market research via the CHESS e-mart to ascertain if there are changes to the market place that would result in additional suppliers provided this product.

8. Additional Other Facts Supporting the Justification: N/A

9. Approval: I hereby certify that this justification is accurate and complete to the best of my knowledge and belief. Based on the foregoing, I approve this Justification for Exception to Fair Opportunity under FAR 16.505(a)(4) subject to the availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition. I hereby approve the award of a Firm-Fixed-Price Delivery Order in the amount of $46,546.50. I hereby approve the procurement of six (6) MY SQL Enterprise Edition software subscriptions on an other than full and open competition basis pursuant to the authority of 10 U.S.C. 2304(c) and FAR 16.505(a)(4) “Items peculiar to one manufacturer”. This action will be a new Delivery Order placed on an existing Multiple Award IDIQ through CHESS. The proposed order under the CHESS vehicle will include a thirty (30) day delivery period in accordance with the BPA terms and conditions. If any changes to the requirements, basis for the justification, market conditions, or increases in the estimated value of the proposed action occur at any time, these changes shall be documented in a memorandum and obtain review/approval from the Contracting Officer.
