FAR Part 16 Exception to Fair Opportunity Justification Under Multiple Award Indefinite Delivery Contracts

For Actions Exceeding the Simplified Acquisition Threshold (SAT)

1. Contracting Activity: United States Army Engineering and Support Center, Huntsville (CEHNC) located at 475 Quality Circle, Huntsville, AL 35806

2. Description of Action: The purpose of this action is to obtain approval for a modification to contract W91QUZ-06-D-0012, extending the Period of Performance (PoP) for an additional six (6)-months under the authority cited in FAR clause 52.217-8 – Option to Extend Services.

CEHNC awarded a Firm-Fixed Price (FFP) task order (W91QUZ-06-D-0012-ZW05) in the amount of $4,402,805.44, to General Dynamics Information Technology (GDIT), Inc., in support of the Readiness Support Center’s (RSC) ENGLink Automated Information System (AIS), on 21 August 2016. The six (6)-month extension period was not evaluated at the time of award. The requested value is $ . RSC ENGLink will provide Fiscal Year (FY) 20 Operations & Maintenance (O&M) funds for this option period.

3. Description of Supplies/Services: This is a non-personal services requirement to support USACE, Mobile District’s Readiness Support Center (RSC), which overseas and manages the Engineers Link (ENGLink) Application. ENGLink is the System of Record for all emergency management reporting, information-sharing, and emergency response, including status of disaster events, situation reporting, readiness tracking and mission support. ENGLink provides the framework for processing information to USACE HQ, Divisions, Districts, and Centers.

ENGLink also provides real time tracking of personnel and events through time and location as well as personnel, team readiness and availability, Database and Application support, and Help Desk support to more than 35,000 USACE personnel worldwide.

Base Period 21 August 2016 – 20 June 2017 $ Option 1 21 June 2017 – 20 June 2018 $ Option 2 21 June 2018 – 20 June 2019 $ Option 3 21 June 2019 – 20 March 2020 $

6-Month Ext 21 March 2020 – 20 September 2020 $

Total Value: $

4. Authority Cited: 10 U.S.C. 2304c(b)(2) as implemented by FAR 16.505(b)(2)(i)(B) – Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

5. Reason for Authority Cited:

a. This Exception to Fair Opportunity is justification to extend ENGLink not more than 6 months to continue services without interruption to the Government. This extension will also allow for a 60-day transitional period between the new vendor and the incumbent.

Justification Throughout the term of task order W91QUZ-06-D-0012-ZW05, GDIT has excelled in supporting RSC by providing support to USACE that covers areas of training, customer support, web and functional enhancement and technical guidance for the ENGLink emergency management system application and database. Additionally, ENGLink is at a critical junction of transitioning from an on-premises based system to a cloud based system using Microsoft's Dynamics Office 365 (O365) which is a line of enterprise resource planning and customer relationship management software applications. The transition is planned for May 2020 timeframe which will require the operating expertise of both the current ENGLink system, software application and processes and the new ENGLink cloud based system to ensure a smooth transition for the 35,000 USACE world-wide Emergency Response personnel to ensure there are no interruptions in case of a catastrophic emergency and the immediate response to it. GDIT’s personnel have completed necessary training and certification on Microsoft Dynamics O365 software applications. They have been an integral part of the development of critical core business processes and software applications for the new ENGLink cloud based system and with-in the Dynamics O365 development. Transitioning to a new vendor that does not have intimate knowledge of these complicated systems, processes and software applications will require significant time for the new vendor to gain the knowledge and experience GDIT personnel have acquired from their 10 plus years of working on the current ENGLink system and their work on the new Microsoft Dynamics O365 software applications over the past year.

If the option to extend services is not added and exercised using the existing contract, a disruption in ENGLink support will have a critical impact on USACE Mission.

b. Alternatives: After receiving the request from the ENGLink Project Manager to exercise FAR 52.217-8 to allow for adequate acquisition time to procure the new ENGLink requirement;

CEHNC did an analysis of acquisition alternatives to determine the best course of action. CEHNC analyzed the following scenarios. (1) The option of procuring servicesthrough an 8(a) direct award or Alaskan Native Company which would not avoid the need for the specialized knowledge to complete the transition to a cloud based environment; or (2) Issue a new competitive order under the preferred CHESS vehicle which would still require an Exception to Fair Opportunity under FAR 16.5 to execute. Currently, CHESS ITES-3S contract is expiring and any orders issued against it can’t extend past August 2021. This would result in putting another contract in place within one year. Even if we were able to accelerate the procurement of either alternative, the likelihood that another contract would be able to adequately staff the contract and pick up transitioning to a cloud based system with less than 20 days to before the current period of performance expires is not viable. This would result in mission failure. CEHNC explored the above-mentioned potential contracting alternatives and determined adding and exercising FAR 52.217-8 to the existing contract, is in the best interest of the Government.

CEHNC will be executing the re-compete efforts for this requirement. CEHNC will require approximately four (4) months to re-compete and award a contract for these follow-on services based upon the acquisition milestone schedule: (1) Issue solicitation on 01 April 2020 (pending complete requirements package from customer); (2) Proposal(s) due 05 May 2020; (3) Evaluations are complete on 29 May 2020; (4) Discussions held (if applicable) on 10 June 2020;

(5) Final Price Revisions on 24 June 2020; (6) Anticipated award date of 15 July 2020; and (5) 60-day transition period to 16 July 2020 to 19 September 2020. A six (6)-month extension of the current contract would prevent a lapse in ENGLink Support.

6. Actions to Increase Competition: CEHNC is currently working with RSC to prepare adequate contract package which will allow for a small business or 8(a) set aside contract for the follow-on requirement. This solicitation is scheduled to be posted on 01 April 2020 with an anticipated award date of 15 July 2020.

7. Market Research: CEHNC issued a Request for Information on CHESS ITES-3S for the 52.217-8 extension. Also, a Notice of Intent to Sole Source on Government Point of Entry (BetaSAM.gov) on 12 February 2020.

The two (2) notices publicized on CHESS and BetaSAM.gov for ENGLink Support are detailed below.

a. RFI #312167 was posted on CHESS ITES-3S contract vehicle on 06 February 2020 with a closing date of 11 February 2020 resulting in three (3) interested vendors, the incumbent

GDIT, TekSynap, and Sentar. CEHNC requested additional information from the vendors to determine if they fully understood the challenges associated with this 6 month effort:

(1) shortened transition period; (2) ability to retain staff; and (3) experience with ENGLink. The incumbent possess the most current knowledge of and experience to handle all of the ENGLink critical requirements. GDIT holds the specialized expertise needed to sustain ENGLink accessibility with no significant downtime to more than 35,000 USACE personnel that rely on the system. GDIT also provides quality technical service and expertise to respond to all system faults ensuring no interruption to critical services.

TekSynap and Sentar responded to the additional questions:

1) TekSynap stated it is aware on the short term period of performance and will team up with Veteran Enterprise Technology Solutions, Inc. (VETS) to best meet the RSC’s needs for ENGLink services. Although, TekSynap has experience with Office 365;

TekSynap did not address having experience with Dynamics 365, a separate entity that requires different knowledge. TekSynap did not identify Risk Management Framework (RMF) capability which is essential in certifying ENGLink PRO to operate on the CORPSNET and DISA Impact Level 5 environment.

2) Sentar stated that they had 21 subcontractors on ITES-3S and will form a team to fully address the PWS requirements. However, they did not identify knowledge and capability with the Risk Management Framework (RMF) at DOD level, USACE has unique requirements that would require time to learn. Additionally, it is not clear from their response that they have Office 365 or Dynamics 365 knowledge or capability which will be necessary to support ENGLink PRO development and deployment.

b. Notice of Intent to Sole Source W91QUZ-06-D-0012-ZW05 was posted to BetaSAM.gov on 12 February 2020 with a closing date of 19 February 2020 and no responses were received.

With these factors considered, CEHNC determined that only the incumbent, GDIT, meets the criteria to continue services without risk of interruption to the Government. Any transition to a vendor, other than the incumbent, would put the mission at risk of failure and therefore, is not in the best interest of the Government.

8. Other Facts: ENGLink Support Services contract W91QUZ-06-D-0012 ZW05 was originally competed to large and small vendors on CHESS ITES 3S and awarded on 19 August 2016 to General Dynamics Information Technology (GDIT).
