QUESTIONS 1 ‐ 42/GOVERNMENT RESPONSES:

Question 1. The rates are different on the SCA and CBA and we need further clarification.

It is our understanding that the Department of Labor requires, in cases of difference, the higher rate be paid. Does the Government desire that the wage determination rate be used to cost health and welfare?

Response Q1: The contractor is responsible for classifying employees IAW Service Contract Act provisions, and DOL is responsible for enforcement, not the Army. It is noted that the current CBA expires on 30 June

2017 and the government anticipates receiving a new CBA. The incorporation of this new CBA will be handled in accordance with FAR 22.1012-2(b). Offerors must determine which of its employees will be covered by the CBA and those employees must be paid the CBA rates (See FAR 22.1002-3, Wage Determinations Based on Collective Bargaining Agreements).

Question 2. On page 97 of 115 of the solicitation Section TAB E – KEY PERSONNEL:

Who does the government's identify as key personnel (supervisory personnel)?

Response Q2: In accordance with the proposal instructions and PWS 2.2.3., the offeror is responsible for identifying all key personnel and positions they deem necessary based upon their proposed technical approach. The Government is simply stating that as a minimum, key personnel shall include the Project Manager and supervisory personnel.

Question 3. Question regarding a. Basis for Contract Award (page 115). The first paragraph states: "Award will be made to a single offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose proposal conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, and represents the Lowest Priced Technically Acceptable (LPTA) offer."

The second paragraph states: "The Randolph Sheppard Act (RSA) applies to this solicitation; therefore, priority will be given to the State licensing agency (SLA) pursuant to the RSA. The priority established by the RSA applies to the award of contracts for the operation of cafeterias on Federal property. Accordingly, in the event the SLA offer is found to be within the competitive range, the Government will enter into negotiations solely with the SLA consistent with the provisions of the RSA, as implemented by Army Regulation (AR) 210-25, paragraph 6.b.(1)(b)."

Question 3a. Would the Government please clarify the two separate standards - LPTA and competitive range?

Response Q3a: Please see response to Q3b below.

Question 3b. If the award is going to LPTA, how can there be a competitive range?

Response Q3b: The government reserves the right to make award on initial proposals received and the evaluation results thereof. If the contracting officer determines that discussions with offerors are necessary, then the contracting officer shall establish a competitive range in accordance with FAR 15.306 and shall proceed as required by the FAR as well as Army Regulation 210-25 with respect to a proposal submitted by the State Licensing Agency."

Question 3c. Will all bidders - including the SLA be evaluated by LPTA?

Response 3c: All offerors will be evaluated in accordance with Section M of the Solicitation.

Question 3d. If all bidders are going to be evaluated by LPTA and the SLA is evaluated by a different standard, could this limit competition?

Response 3d: All offerors will be evaluated in accordance with Section M of the Solicitation. The same evaluation criteria will be used to evaluate all of the offerors received.

Question 4. Will buffet style feeding be terminated?

Response Q4: PWS paragraph 3.1.2.3, “(buffet style)” has been deleted.

Question 5: Can a copy of the site visit sign in sheet be provided?

Response Q5: A copy of the site visit sign-in sheet will be provided as an attachment to Amendment 0002.

Question 6: PWS paragraph 2.1.11 mentions a requirement for the Contractor to submit a subcontracting plan to the Contracting Officer and to file subcontracting reports. Can this paragraph be clarified to specify that this is a requirement of an “other than small business” contractor, in the event a small business is not awarded the contract?

Response Q6: The subcontracting plan requirements are only applicable to large businesses.

Question 7: PWS paragraph 2.1.12 includes the requirement for the Contractor to ensure “the labor categories as defined in the Labor Categories document (see related documents), labor rates, and man-hours used in the performance of each TO (PWS line item) issued hereunder shall be the minimum necessary to accomplish the task.”

This paragraph seems at odds with the statement in paragraph 1.1 that emphasizes that the contract will be a Performance Based Service Acquisition.

a. What method will the Government use to ensure the Contractor is using the “minimum necessary to accomplish the task”?

b. Is the Government expecting only a minimal level of effort to ensure contract standards are met?

Response Q7a: An Amendment will be issued to clarify PWS paragraph 2.1.12. Part of the clarification will be to delete the “minimum level of effort” language.

Response Q7b: See Q7a above.

Question 8: PWS paragraph 2.2.1 requires certain personnel to have a CAC card and receive a favorable National Agency Check (NAC). Who is responsible for the cost of the NAC? If the contractor is responsible for this, what is the cost of this check?

Response Q8: The government will provide the necessary NAC check.

Question 9: PWS paragraph 2.2.1.2, and numerous other PWS paragraphs, mention the regulatory guidance in TB MED 530. Should these references be updated to the Tri-Service Food Code?

Response Q9: These documents are one and the same.

Question 10: PWS Paragraph 2.2.2 states, “all accidents which occur in association with performance of services required in this contract shall be reported in writing to the COR on the day of the accident or not later than the next working day.” Is emailing the COR the details of the accident an acceptable means of reporting?

Response Q10: Yes. Email or delivery in person of written documentation are all acceptable methods of communication.

Question 11: PWS Paragraph 3.1.1.2 d) requires the Contractor to remove snow and ice from sidewalks and access areas. Does the Government furnish any snow removal equipment?

Response Q11: No, the government does not furnish any snow removal equipment.

Question 12: PWS Paragraph 3.1.1.2.1 d) mentions tablecloths. Who is required to furnish the required tablecloths?

If the contractor is responsible, can data pertaining to the number of required tablecloths?

Response Q12: Tablecloths will be provided by the Government for special events. For the requirements of PWS paragraph 3.1.1.2.1 g), the contractor is required to provide plastic tablecloths.

Question 13: PWS Paragraphs 3.1.1.2.1 d) and 3.1.1.2.1 h) are the same, should one be deleted?

Response Q13: Yes, paragraph 3.1.1.2.1h has been deleted.

Question 14: PWS Paragraph 3.1.2.3 d) states serve at a minimum rate of 8 to 10 diners per minute, per serving line.

DA PAM 30-22 appendix B states full serving lines for full meal service meal should be 8 patrons per minute and reduced A line plus short order menu service should be 5 patrons per minute. Could this PWS be changes to reflect the requirements as stated in DA Pam 30-22?

Response Q14: PWS paragraph 3.1.2.3.d) has been changed to read, “STD: Serve at a minimum rate of 8 diners per minute per full food service line, or 10.5 diners per minute for a full food service line plus short order section (per DA PAM 30-22, section b)."

Question 15: PWS Paragraph 3.2 requires the transition plan to be submitted as part of the proposal. With which volume should the transition plan be submitted with, and will it count against the page count?

Response Q15: Paragraph 3.2 has been changed to the transition plan be submitted within 5 days following contract award. It is not required in the proposal.

Question 16: TE F. Building 3003, 3500, 11105 and 18028, paragraph 9, states policing outside areas, within 50 feet of facility, and 20 feet surrounding dumpsters, are cleaned to sight; and free of trash, cigarette butts, raw/ingredients, food waste, and foreign matter. PWS Paragraph 3.1.1.2 d) states Clean dining facility sidewalks, loading dock, and entry ways daily to prevent grease, dirt and refuse buildup IAW the approved quality control plan.

Snow and ice, or sand, is removed from sidewalks, and access areas within 10 feet of the dining facilities entrances.

There appears to be a conflict in these 2 paragraphs, can the Government clarify this conflict?

Response Q16: The requirements in PWS paragraph 3.1.1.2 d). TE F list the required standards has been clarified.

Question 17: IAW the Collective Bargaining Agreement, employees with at least 10 full years of service will be paid a longevity premium. To properly price this requirement, can we be provided with a current seniority list?

Response Q17: The seniority list is an attachment under Section J of the Solicitation in accordance with FAR Clause 52.222-41(n). Offerors are cautioned this list is for information purposes only. This is a new procurement and requirement, therefore, offerors shall determine the appropriate staffing and skill mix based upon this current solicitation and their proposed technical approach.

Question 20: Are we required to provide key personnel resumes? If so, what is the page limit for each resume? Are resumes included in the page count?

Response Q20: In accordance with Section L instructions, offerors are only required to identify the Project Manager by name. Section L delineates the specific information to be provided. However, Section L also states that if offerors have other key personnel identified by name then they shall submit the applicable information for that individual as specifically delineated in Section L. Yes, all information is included in the page counts. (Reference answer to question 28).

Question 21: How many people are currently employed as food service workers?

Response Q21: This is a new procurement and requirement, therefore, offerors shall determine the appropriate staffing and skill mix based upon this current solicitation and their proposed technical approach.

Offerors are required to provide the duties and responsibilities to be performed by the PM, the PM’s experience and capabilities to demonstrate they can execute the assigned duties and responsibilities, and evidence he/she possesses a current, 40 hour sanitation certification.
