CLAUSES INCORPORATED BY FULL TEXT

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

Award will be made to the offeror whose offer is the lowest price, and technically acceptable (LPTA). In order for offers to be found technically acceptable, contractors must comply with the terms and conditions of all sections of the solicitation and Performance Work Statement (PWS), to include passing a Food and Water Assessment (Section 2.1.4), and passing a Force Protection Inspection (Section 2.1.5) by the US Government prior to contract award. Any offeror determined to be technically unacceptable will be ineligible for contract award.

Technical Acceptability is defined as meeting all specifications in the solicitation. You must address each specification and each deliverable. Offers shall be ranked in order of lowest price to highest price. The lowest priced offer shall be evaluated first. If the lowest priced offer is technically acceptable, no other offers will be evaluated.

(b) Options. Not Applicable.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
