Background Checks: The Contractor shall ensure contractor employees and subcontractor employees performing services under this contract have passed a local security check conducted by the State Police Department of their U.S. residence and the state of employment, (Florida) (if not the same). The Government reserves the right to independently process local background checks with DoD and local law enforcement using applicable DoD form (DD369) and protocols. Failure of the employee to concur with this document will result in a negative eligibility status to work on this installation.

The contractor shall ensure contractor employees and subcontractor employees performing services under this contract have been vetted under the current DoD and OPM requirements for Personnel Security investigations. The Contractor shall process either the SF-85/85P/86 background questionnaire to the OPM on employees, depending on the level of screening required for the current employment role and requirement for access stated in HSPD-12 (Homeland Security Directive-12) or Public Trust and Suitability of employment requirement. The employee shall meet “NACI” Public Trust and Suitability requirements as a vetted contractor. It is the Contractor’s responsibility to review and verify via DoD Portals if a prior investigation has been recorded. If not, the corporation must initiate and ensure all investigative requirements are met before employee actually begins work. Contractor is responsible for reporting to KO and COR any forms of misconduct or derogatory information discovered or disclosed, immediately, during this initial process. When issues are identified, it is the corporation’s responsibility to decide if an initial hiring waiver will be granted, allowing the investigation to proceed until final adjudication. Final and Favorable Determinations is always made by the final adjudication authority, Department of Defense Consolidated Adjudication authority (DoD-CAF) or Defense Industrial Security Clearance office (DISCO) as part of the Department of Defense (DoD) and Office of Personnel Management (OPM) Personnel Security Program. If employee has on file a previous DoD or OPM related background investigation, the corporate Facility Security Officer (FSO) and the government will review to certify the new position meets the historical investigation. The previous investigation may be unacceptable if a 24 month continuous break-in-service exists on the employee’s prior investigation, under reciprocal DoD guidance. The new position description must meet the historical/prior investigation on record. If the prior DoD or OPM investigation is acceptable, Contractor agency and subcontractor will still be responsible for processing all other screening checks, to recertify locally, including new fingerprints, DD369 and related law enforcement records (by disclosed state mentioned above). Documentation of these checks will be made available to the KO and COR. The Government retains the right to exclude any employee from access to the installation if any part of background security investigation or screening results reveals an employee is a security risk. The exclusion of an employee for security reasons shall not relieve the Contractor from performance of services required under this contract.
