This document is a draft PWS intended for use as part of a Request for Information (RFI). It has been developed by the Government for market research purposes only. Nothing in this document can be construed to bind the Government in any way. A formal RFQ for this requiring may follow.
PERFORMANCE WORK STATEMENT (PWS)
Aftermarket Maintenance Contract
Maintenance contract for one (1) year, with possible option years up to five
(5) total years.
Afghan National Engineer Commands Wheel Excavators
1. GENERAL: The purpose of this PWS is to describe the one (1) year base period of performance with option years up to a maximum of five (5) total years maintenance contract requirements following the procurement of 8 wheeled excavators with sufficient detail for the contractor to accurately develop a proposal in terms of cost and performance to complete all necessary work for complete maintenance care for the defined period of performance. It is the contractor’s responsibility to review and understand the PWS in full detail to deliver a complete solution. This is a non-personal services contract to develop and commission the labor, tools, repair parts, and other maintenance requirements necessary to keep all 8 excavators under the control of the Afghan National Engineer Commands fully mission capable during the contracted period. Contract does not include any Government Furnished Equipment.
Compliance with laws and regulations: The Contractor shall comply with, and shall ensure that its personnel in the designated operational area or supporting the diplomatic or consular mission are familiar with and comply with, all applicable--
(1) United States, host country, and third country national laws;
(2) Treaties and international agreements;
(3) United States regulations, directives, instructions, policies, and procedures.
(4) Force protection, security, health, or safety orders, directives, and instructions issued by the Chief of Mission or the Combatant Commander;
however, only the Contracting Officer is authorized to modify the terms and conditions of the contract.
1.1. Scope includes but is not necessarily limited to comprehensive repair and commissioning of all mechanical systems (to include transmission, engine, electrical, hydraulic, and all power train systems) for all 8 excavators distributed throughout Afghanistan under the command of various National Engineer Commanders. This scope also includes all necessary preventative maintenance associated with the excavators in

1.2. The United States Government will award based upon a lowest price technically acceptable proposal process for a Firm Fixed Price (FFP) agreement.
2. DESCRIPTION OF SERVICES: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform the scope as defined in this PWS. There are no US Government furnished materials or supplies associated with this scope. Parts and maintenance should be provided by an authorized Original Equipment Manufacturer certified personnel to prevent voiding warranty terms and conditions. Contractor shall perform all maintenance and services to the standards and schedules found in the manufacturer's maintenance and service manuals. Contractor will be on call for unscheduled maintenance or service requirements. Contractor shall respond to unscheduled maintenenace, repair or service within 48 hours.
Maximum non-operational time should be no more than 10 days. Any non operational duration exceeding 10 days must be justified by an estimated cost of repair in accordance with manufacturer prescribed standards.
2.1. Maintenance Contract. The contractor will responsible for all equipment maintenance and repairs for 8 wheel excavators for a (1) year base period of performance with option years up to a maximum of five (5) total years maintenance contract. Maintenance will be performed by a local authorized manufacturer parts and maintenance repairer capable of providing mobile parts and maintenance support. Hours on site will be flexible since maintenance will be performed based on maintenance demands and prescribed and recommended manufacture service schedules and intervals.
2.1.1. Contractor is not required or expected to tow, retrieve or recover any equipment. The owning unit will coordinate and provide all evacuation of equipment to the appropriate supporting maintenance facility as required by the corresponding level of repair.
2.1.2. Repair and maintenance quality that properly reflects the original condition and manufacturing standards for each excavator.
2.1.3. Proper identification and diagnosis of equipment damages, shortfalls, and preventative maintenance requirements.
2.1.4. Open communication between the contractor, COR, KO, and National Engineer Commands regarding the proper usage and

2.1.5. Repair of significant cosmetic and exterior damages to equipment.
2.1.6. Routine replacement or expendable equipment parts including but not limited to tires, lights, and batteries.
2.1.7 Maintenance will be performed on site at a specifically designated location determined by Host Nation Unit which includes, but not limited to the motor pool and any existing maintenance buildings. On-site is defined as “at the Host Nation Unit location.” Host Nation Unit will make all reasonable efforts to accommodate inclement weather situations.
2.2. Equipment Repairs. The contractor shall conduct repairs and commission necessary parts and tools for all 8 wheeled excavators.
2.2.1. The contractor will be responsible for all costs of labor and time associated with equipment repairs for 8 wheeled excavators.
2.2.2. Procurement of all necessary repair parts to conduct the necessary repair. Repair parts purchased will reflect the quality of the original part and must be produced by the original manufacturer of the replaced part.
2.2.3. Procurement of all necessary tools for conducting repairs. Tools will remain property of the contractor or contracting company conducting the repair and will meet the required function and quality necessary to perform a permanent repair without causing additional damages.
2.3. Preventative Maintenance. The contractor shall be responsible for all preventative maintenance functions for a (1) year base period of performance with option years up to a maximum of five (5) total years maintenance contract in order to prevent degradation or damages to the 8 wheeled excavators. Contractor shall perform all maintenance and services to the standards and schedules found in the manufacturer's maintenance and service manuals.
2.3.1. Monitoring all fluid levels, quality, and pressures to enable optimal performance and equipment longevity to include but not limited to oil, coolant, fuel, hydraulic fluid, power steering, and wiper fluid.

2.3.4. Battery maintenance and replacement.
2.4. New Equipment Training. The contractor shall be responsible for providing new equipment training to all operators at each of the National Engineer Commands. Contractor will provide a minimum of two qualified trainers at each training site.
2.4.1. Training will be conducted at the delivery sight for each excavator at the National Engineer Commands.
2.4.2. Training will take place as a 3 day event in which students will be taught how to operate the equipment and perform preventative maintenance functions. The training day should last 8 hours per day.
2.4.3. Training will take place within 15 days of delivery.
2.4.4. Contractor is responsible for all life support as required during the training event.
2.4.5. The contractor will supply all required tools to conduct training.
3. MAINTENANCE SCHEDULE and PERFORMANCE
3.1. No later than 30 calendar days after contract award, the contractor shall submit a maintenance schedule to the Contracting Officer (KO) and Contracting Officers Representative (COR) reflecting a performance period not to exceed 45 days after Notice to Proceed (NTP). KO or COR will meet with Awardee within 15 days of Contract. Contractor shall perform all maintenance and services to the standards and schedules found in the manufacturer's maintenance and service manuals.
3.2. The maintenance schedule shall indicate all material ordering periods and shall highlight long lead items.
3.3. The contractor shall maintain implement quality control measures throughout the execution of a (1) year base period of performance with option years up to a maximum of five (5) total years maintenance contract.

3.4. No later than 30 calendar days after contract award, the contractor shall submit a quality contract plan (QCP) to the KO and COR.
3.5. The contractor shall have a maintenance supervisor capable of reading, writing, and speaking English at the maintenance site at all times.
3.6. The contractor shall coordinate with the COR for base and worksite access, badging, and work hours. All contractor personnel will conform to any base access, badging, or security requirements of the Garrison Commander, security personnel or COR. Contractor is required to comply with local vetting policies and processes.
3.7. Contractor is responsible for all life support requirements.
4. SAFETY and LIABILITY
4.1. The United States Government assumes no responsibility for injuries or damages suffered by contractor, its officers, agents or employees, while engaged in the performance of this contract.
4.2. The contractor agrees to take reasonable measures to provide for the safety and security of its own workforce, as well as the safety and security of all others present at the work site while engaged in the performance of the work.
4.3. All liability for any injuries incurred by contractor personnel while working on site is the sole responsibility of the Contractor.
4.4. The contractor shall ensure that employees are supplied and use proper personal safety equipment (i.e. hardhats, eye protection, proper hearing protection, gloves, and safety boots).
4.5. The contractor shall establish a safety zone around the maintenance area and establish a safety system to prevent injuries to worker as well as others present at the work site while engaged in the performance of maintenance.
4.6. The contractor shall install warning markers and other devises to prevent injuries to vehicles, pedestrians, and others who may be on site.
5. HAZARDOUS MATERIALS and ENVIRONMENTAL PROTECTION
5.1. Should the contractor produce, encounter, or remove hazardous materials during the maintenance period, the contractor shall notify the KO and COR; identify the area of danger, and discontinue work in that

Hazardous material are included as follows, but not limited to:
5.1.1. Toxic waste
5.1.2. Petroleum
5.1.3. Battery waste
5.1.4. Coolant/antifreeze
5.2. The contractor shall remove all materials, wastes, effluents, trash, garbage, oil, grease, chemicals, and similar hazardous substances.
6. SITE CLEANUP and RESTORATION
6.1. The contractor shall ensure the maintenance site and areas around the maintenance site are free of any debris and materials upon completion of work each day, as well as at the completion of the job.
6.2. The contractor shall remove and properly dispose of all materials and equipment at the completion of the job.
6.3. All unused materials and/or equipment remain the property of the Afghan National Army Equipment Owner.
6.4. Contractor will not store tools, parts, or any other materials overnight at the Host Nation Unit location without written authorization from the Host Unit.
6.5. The contractor shall restore the work site, insofar as is reasonably possible, to its condition prior to work, and similar conditions affected by work during the performance of the Contract.
7. NONCOMPLIANCE
7.1. The KO or COR will promptly notify the contractor of any discovered or perceived non-compliance.
7.2. The KO reserves the right to halt work for any violations of the PWS he/she perceives.
7.3. The contractor shall address and/or take immediate Corrective action of non-compliance upon notification, whether verbal or written.
7.4. Such notice, when delivered to the Contractor does not automatically constitute a basis for extension of time or other damage claims.

7.5. The KO is only person who may authorize the resumption of work once the non-compliance issue is resolved.
7.6. The COR has the authority to stop work immediately in the case of an emergency or unsafe situation.
8. REMOVAL OF UNACCEPTABLE WORK
8.1. New maintenance work or repairs could be considered ‘unacceptable’ if they do not conform to the requirements of the contract or this PWS as determined by the KO.
8.2. The contractor shall resolve or replace unacceptable repairs immediately whether the result of:
8.2.1. Poor workmanship
8.2.2. Defective materials
8.2.3. Damage
8.2.4. Carelessness
8.2.5. Any other cause that is not of the fault of the Afghanistan

8.3. Removal and/or replacement of unacceptable work are not grounds for an extension of time beyond the (1) year base period of performance with option years up to a maximum of five (5) total years maintenance
9. CONTRACTING OFFICER REPRESENTATIVE (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions
9.1. Ensure that the Contractor performs the technical requirements of the

9.3. Maintain written and oral communications with the Contractor concerning technical aspects of the contract.
9.4. Monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies.

A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
10. CONTRACT MANPOWER REPORTING APPLICATION. The contractor will register and update this contract information in the Contract Manpower Reporting Application (CMRA) within 30 days of contract award.
11. MONTHLY STATUS REPORT. The contractor will submit an electronic monthly report identifying maintenance work and repairs. The report will be submitted via email to the COR.
