Justification and Approval for Other Than Full and Open Competition Justification

W91A2K2160AA04

1. Contracting Activity: The U.S. Army Contracting Command -Warren, Michigan 48397-5000 is the procuring activity responsible for this action.

2. Description of Action: Contract W911QY-10-P-0656 provides for project management support for the Integrated Logistics Support Center Clothing and Sales Office (ILSC-CHPSID) as it pertains to their Medals and Heraldry web-based automation needs.

Contract W911QY-11-P-0748 provides information management support in all areas of information management including as it pertains to Domino servers for systems and applications at the U.S. Army Soldier Systems Center (SSC) and its tenants, and, when applicable and requested, the Army Materiel Command (AMC) and its subordinate organizations, plus TACOM, NCTRF and other DoD sites. The DA3078 automation system is the production system for the ILSC-CHPSID. A competitive effort is currently being prepared to solicit as a small business set-aside to combine these requirements, along with one other similar requirement, into one cohesive information management service contract. Currently, the Government will be combining these two efforts, which are currently being performed by NDIV Incorporated, into one contract vehicle to promote savings for the Government. As stated, the deliverables are similar and the additional overhead to maintain two separate contracts will be saved and overall efficiency will be gained.

3. Description of Supplies/Services: The Government proposes to issue one contract to NDIV Incorporated, to combine both efforts. The period of performance will be 26 September 2012 until 25 September 2013. This action will allow for continued performance until the new competitive contract is awarded. Operation and Maintenance

– Army (OMA) funding will be used to fund the estimated amount of $200,000.00.

4. Authority Cited: The statutory authority permitting this other than full and open competition is 10 U.S.C 2304(c) (1), as implemented by FAR 6.302-1 Only One Responsible Source & No Other Supplies or Services will Satisfy Agency Requirements

5. Reason for Authority Cited: A sole source contract action for a 12 month period of the current expiring contract is required, until the new competitive contract is awarded. At least 150-200 days are required to complete a proper Source Selection process to successfully award a small business set aside and then begin a successful transition for a new contractor. If the work is stopped after the current contract expires the ILSC-CHPSID Medals groups will lose on-line functionality and be forced back to costly, inefficient paper processing. As this system has been in place for years, the transition back to paper process would result in a process shutdown until a formal manual process can be instituted. This will increase lead times for Soldiers/Veterans to receive their awarded medal/heraldry items. Additionally, the tool serves as an inventory management process to afford accountability of the Heraldry/Medals assets. This functionality would revert to a manual process, and result in the need for more personnel support to adhere to Army inventory accountability requirements. Additionally, the development personnel supporting this effort ensure that Soldiers are expeditiously able to obtain the approved DA 3078 Clothing to support their mission. Without this support the application would revert back to a manual process resulting in significant cost increases to the Army. This would also increase the lead time for clothing dissemination, increase erroneous issues, and incur downtime to revert back to a manual process. There is not adequate time to phase in a new contractor and still allow for continuity of services. While the services are available through other contractors, there are not known contractors in the geographic area to provide these services in the timeframe we have before services end.

6. Efforts to Obtain Competition: This contract will only be utilized to extend the current contract services for 12 months. This will allow for acquisition of the new contract as a small business set-aside.

7. Actions to Increase Competition: Future requirement for this capability will be advertised to determine if any additional sources are available.

8. Market Research: This contract will allow for continued performance while the competitive action is planned and executed. In August/September 2012, the requirements office conducted market research and determined that competitive vendors would not be able to perform this effort without significant increases to cost and schedule due to the complexity and custom nature of the applications the personnel on this contract support.

The market research identifies that the cost allocated by the current vendor is for sustainment and modernization; where cost provided by potential new vendors included additional charges associated to knowledge transfer and technology transition.

Furthermore, no other company that was not identified through market research could begin service without a severe disruption in service. In order to maintain continuity of service, avoid mission failure, and mitigate a significant increase in personnel costs the current contractor needs to continue to provide service until a competitive solicitation process can be conducted.

9. Interested Sources: The notices required by FAR 5.201 will be published. Any other proposals received as a result of publication will be considered for the competitive small business set aside.

13. Fair and Reasonable Cost Determination: Include the following determination:
