NGB-AQ Control No: 17-0028 Contractor: Arrowpoint Corp.
Program: Installations Professional Support
FOR OFFICIAL USE ONLY
LIMITED SOURCES JUSTIFICATION
1. Contracting Activity: National Guard Bureau, Operational Contracting Division (NGB-ZC-AQ), 111 South George Mason Dr, Arlington, VA 22204-1382
2. Description of Action: This action is a modification to a GSA Task Order to exercise an Option to Extend Services IAW FAR 52.217-8 under W9133L-12-F-7918 to allow continuity of services until the follow-on contract is awarded on 4 February 2018. NGB intends to extend the period of performance (POP) from 1 October 2017 – 3 February 2018. Total Estimated cost of this action is $530,000 for four months of service. This action will be for a limited period, at which time the Government anticipates award of a competitive awarded Task Order.
3. Description of Supplies/Services: The Installations Professional Support contract provides support to properly identify requirements, support budget requests, analyze execution, evaluate program effectiveness, collect data to support requirements, and analyze annual funding requests to support the 54 States, Territories, and District of Columbia, as well as NGB Program Managers. Contracted services are required to provide assistance to the States in the areas of Sustainment Restoration and Modernization (SRM) support, Real Estate support, Sustainability and Energy Management support, Strategic Communications and Training Management support, Budget and Program Planning and Analysis support, Military Construction Budget Execution Program Analysis support, and Facility Operations support.
4. Authority Cited: Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et. Seq) and Title 40 U.S.C 501, Services for Executive Agencies, as implemented by FAR 8.405-6(a)(1)(i)(C) under the authority of the Multiple Award Schedule Program—In the Interest of Economy and Efficiency the new work is a logical follow to an order placed in accordance with the Federal Supply Schedule Order procedures and was not previously awarded using limited sources procedures.
5. Reason for Authority Cited: NGB-AQ used fair opportunity procedures under the Federal Supply Schedules and received two proposals on 24 SEP 13. The Government subsequently awarded to Arrowpoint Corp, who was determined to have provided the proposal that represented the best value to the Government. Arrowpoint Corp is qualified to provide this service and has provided satisfactory contract performance for the past five years of performance. At this time, a break in service would cause a disruption to the ARNG's Sustainability Team at the time when they compile and submit the ARNG's annual energy and water consumption and solid waste generation data legally required by Congress. This team reviews and ensures the accuracy of data for over 20,000 ARNG utility accounts which is reported to HQDA in the Annual Energy and Water Management Report and develops the DARNG's Command Energy and Water Management briefing to the ASA IEE, presented annually in December/January. It would also impact several training courses that are planned, with an expected attendance of 1200 students.
This training is critical to ARNG-IEZ’s mission to deliver required CFMO and Environmental training to the 54 States and Territories. This Limited Sources Justification ensures the continuity of these services without the delays associated with ramp up, training certification, and costs noted above, through 3 February 2018. IAW FAR 8.404(d) this contract represents the best value to the government as it results in only available alternative to meet the Government’s needs.
6. EFFORTS TO OBTAIN COMPETITION: The Government posted a Sources Sought at the GPE for these services on 3 August 2017 and 9 companies have provided interest in submitting a proposal for the follow on acquisition. Exercising the Option to Extend Services provides sufficient time to conduct the remainder of the acquisition and award the follow on effort. While companies that responded to the Sources Sought may have been interested in proposing to provide these services, at this time the Government does not have tacit knowledge that these companies could provide the services at the level quality required by the Government.
Competing a smaller contract for these services would not provide the Government with any cost savings in return for awarding a new contract for these services until the follow on acquisition can be awarded
7. ACTIONS TO INCREASE COMPETITION: In an effort to save money, improve performance, and promote accountability, the Government intends to pursue a competitive procurement strategy for the subsequent effort through GSA OASIS Government Wide Acquisition Contract (GWAC) through GSA. The choice to limit this extension to four months is an attempt to transition these services to a competitively awarded Task Order This Limited Sources Justification is for four months of extension under 52.217-8.
8. Market Research: NGB has finished conducting additional market research via the sources sought notice described in section 6. Based the 9 responses received, the Government will work to enact the acquisition strategy in awarding a single contract through the GSA OASIS IDIQ IAW
FAR 16.505.
9. INTERESTED SOURCES: Companies that responded to the sources sought notice are interested sources. These companies will be able to compete for this requirement with adequate time for proposal writing, evaluations and negotiation based on the Government’s anticipated timeframe. Publication notices are not required for this modification, but this limited sources justification will be posted to fbo.gov.
