JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SYSTEM ENGINEERING AND TECHNICAL ASSISTANCE (SETA)

IN SUPPORT OF THE

COMBAT TERRAIN INFORMATION SYSTEMS (CTIS)

Modification to W9132V-07-D-0001-0038 J&A Control Number AGC-13-00__

REFERENCES:

FAR 13.106 (b) states that, “For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization). The following documentation constitutes the rationale for this decision.

DOCUMENTATION:

(1) Requiring Activity:

a. Requesting Activity U.S. Army Corps of Engineers (USACE)

U.S. Army Geospatial Center (AGC) Technology Integration Branch 7701 Telegraph Road, Building 2592A Alexandria, VA 22315-3864

b. Contracting Activity

U.S. Army Corps of Engineers (USACE) U.S. Army Geospatial Center (AGC) Contracts Office 7701 Telegraph Road, Building 2592 Alexandria, VA 22315-3864

(2) Supplies or services being procured:

The purpose of this document is to obtain necessary approvals for a sole source acquisition in accordance with FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. AGC’s need to continue services is of such a compelling need that the Government would be impacted unless the agency is permitted to limit competition; full and open competition need not be provided for.

The procurement strategy is to issue a sole source task order modification to extend performance under the existing task order for 11 days to provide for a continuation of services without interruption until a follow-on task order is awarded.

The estimated cost of this acquisition is: $0.00.

This continued service will use existing funds currently available under the contract as part of a funding/CLIN realignment in the amount of $4,421.35.

IN SUPPORT OF THE

COMBAT TERRAIN INFORMATION SYSTEMS (CTIS)

(3) Reason that this is a sole source procurement (i.e., proposed contractor’s unique qualifications, etc.):

The existing Combat Terrain Information Systems (CTIS) Logistics support task order is to provide logistician support services to assist the Product Director (PD) CTIS in developing, supporting, fielding and integrating topographic equipment throughout US Army and other authorized users. CTIS systems provide automated terrain analysis, terrain data management and graphics reproduction in support of Intelligence Preparation of the Battlefield (IPB), Command and Control, Terrain Visualization, weapons and sensor systems, and other topographic information customers. Requested support shall continue to allow the Readiness & Engineering Team to assist PD CTIS in developing, supporting, fielding and integrating topographic equipment throughout the US Army and other authorized users. Currently this logistic support is tracking critical shipments of "The Instrument Set, Reconnaissance and Surveying" (common name ENFIRE) system to Ft.

Stewart, GA (12 units); to the MA National Guard (4 units); to the KY National Guard (17 units) and the VT National Guard (4 units) that have to be shipped and coordinated with the week of 4 February 2013); along with the disruption of the ordering and coordination of ancillary equipment for ENFIRE equipment that is currently being coordinated with the Program Executive Office – Intelligence Electronic Warfare & Systems (PEO-IEW&S) at Aberdeen Proving Ground (APG);

critical shipping and tracking of the Automated Integrated Survey Instrument (AISI) kit shipments to the MN 1208thNational Guard and to the Ft. Dix, NJ National Guard unit, which are about to occur 1-15 February, requiring non-disruption of these services and collaboration with APG. The existing task order providing this support, awarded under an IDIQ contract that was awarded as an 8(a) set aside, is to be extended from 1 February 2013 through 11 February 2013; a 11-day extension, to allowing additional time to issue a new task order to provide these support services.

History: These services were initially provided under Contract W9132V-07-D-0001 (with Chenega Federal Systems (CFS), an 8(a) ANC set aside sole source contract), Task Order #17 from September 20, 2008 to July 31, 2010. Services provided for logistics and training in support of the PD CTIS and its programs. Logistics support only was again provided under the same contract, Task Order #29, from August 5, 2010 to January 1, 2012. Currently this logistics service is being provided under the Task Order #38 of the same contract from February 1, 2012 to January 31, 2013. All three (3) task orders were awarded on a T&M basis.

The value of this effort under the existing task order (#38) is valued at $152,917.78 (including $4,440.13 set aside for travel and ODCs). It is estimated that the planned follow on continuation of services would cost approximately $150,000.00 for the same services and is planned to be awarded in February 2013. This action is for the continuation of the same services at no additional cost to the government (other than the realignment of $4,421.35 to the labor CLIN).

(4) Market survey.

Market research was not conducted for this 11 day extension nor has other sources expressed an interest in this acquisition. The need to continue this service at no additional cost prevents the consideration of other sources that could continue these services without interruption.

(5) Technical Certification:

I hereby certify that this justification is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge and belief, and that I would not be making this request if it were feasible to fully compete this requirement. I further certify that this request is not the result of lack of advanced planning or a desire to expend funds while those funds are still available.

(6) Price Reasonableness Determination:

The anticipated cost to the government for this contract action will be fair and reasonable, based on the costs for extension and will be a continuation of services within the limits and at the rates specified in the task order and as part of FAR 52.217-8.

(7) Contracting Officer Certification:

I certify that this justification is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge and belief.
