This is a Request for Quotations (RFQ) issued by the U.S. Army Corps of Engineers for preliminary title commitments and related services for seven parcels located in Plymouth, Massachusetts. The solicitation seeks a contractor to provide title evidence, title insurance, and optional closing services for temporary work area easements related to the Plymouth Long Beach Dike repair project.
The primary deliverables include preliminary title commitments within 30 days of contract award, with options for title commitment continuations, closing services, and final title insurance policies for each parcel. The contract will be awarded based on price alone, with no technical proposal required. Vendors must be registered in the System for Award Management (SAM) and submit quotes via email by September 2, 2025. The total period of performance is one year from contract award, with various optional tasks that can be exercised by the government, including title research, continuations, closing services, and final title policies for individual parcels along Ryder Way in Plymouth.

INFORMATION FROM TO
Response Due Date 29 Aug 2025 02 Sep 2025
Miscellaneous text in this section has been added to:
REQUEST FOR INFORMATION:
QUESTION 1: Since this is a fixed-price requirement, could you confirm how the Government envisions structuring the title and closing services? Title costs often fluctuate depending on the nature of the transaction, so we want to be sure we approach pricing correctly.
RESPONSE 1: As a firm-fixed price contract, the Government will only pay for the services provided at the agreed upon awarded amounts for each line item in the bid schedule. Vendors should account for fluctuating costs in their quote pricing, and any changes in costs are a risk assumed by the awarded Contractor.
QUESTION 2: Are the seven parcels expected to be purchased by the United States or disposed of/sold?
RESPONSE 2: No. The Government is not purchasing any of these parcels in fee or disposing of/selling the parcels. (See answer to question 4 below.)
QUESTION 3: The solicitation references parcels at 3R, 7, 9R, 11, 15, 17, and 21 Warren Avenue in Plymouth, but also elsewhere mentions Ryder Way. Could you confirm whether the Warren Avenue addresses are the official parcel references we should use for our title commitments?
RESPONSE 3: The parcel references in your question do not match the parcel number referenced in the solicitation. The parcel numbers are as follows: PARCEL ID: 037A-000-000Q-000 PARCEL ID: 037A- 000-000O-003, also known as 370 Ryder Way PARCEL ID: 037A-000-000O-004, also known as 322 Ryder Way PARCEL ID: 037A000-000O-006, also known as 318 Ryder Way PARCEL ID: 037A-000- 000S-000, also known as 228 Ryder Way PARCEL ID: 037A-000-004-000, also known as 152 Ryder Way PARCEL ID: 037A-000-003-000, also known as Ryder Way.
QUESTION 4: Can you provide more information on these properties and expectations? Are these fee acquisitions or easement acquisitions?
RESPONSE 4: The purpose of this action is to obtain temporary work area easements to allow the Government sufficient access and time to these parcels to repair and/or maintain the existing Plymouth Long Beach Dike.
QUESTION 5: What is the physical address for APN 037A-000-000Q-000 as the other parcels indicate a physical address?
RESPONSE 5: According to the Town of Plymouth, MA assessor's office web site, no physical address is provided for parcel no. 037A-000-000Q-000. However, the parcel overlaps Ryder Way, Plymouth, Massachusetts.
W912WJ25QA0820002
QUESTION 6: What is the physical address for APN 037A-000-003-000 as the other parcels indicate a physical address?
RESPONSE 6: A search of the Town of Plymouth, MA assessor's office records for parcel no. 037A-000- 003-000 simply references "Ryder Way" and a Certificate of Title No. 77594. The Massachusetts Registry District of the Land Court shows a deed referencing the property address as being "Warren's Cove, Plymouth, MA" and indicating the owner is the Trust for the benefit of Louise W. Meyer and others dated October 17, 1977, The Certificate of Title indicates Barbara W. Meyer, Orin H. Meyer, Robert H. Meyer and Richard R. Meyer as being the trustees. The Certificate of Title is recorded with the Plymouth County Registry District of the Land Court as Certificate No. 77954, Document No. 291340 recorded on September 29, 1998. No physical address number is provided for this parcel. Therefore, there is no known physical address for this parcel.
QUESTION 7: What will the Government provide to a contractor as part of an assignment of work -vesting deed? Aerial map of acquisition area?
RESPONSE 7: The Government will provide any/all maps, construction maps and information known by the U.S. Army Corps of Engineers to assist in identifying the parcels so as to allow the awarded vendor to complete their work.
QUESTION 8: Does the Government have copies of vesting deeds that they can provide to an offeror for evaluation for search quotes?
RESPONSE 8: No. Vesting deeds should be provided to the Government by the awarded Contractor.
QUESTION 9: Does the Government have acquisition values for each parcel? We would need this for quoting title insurance.
RESPONSE 9: Currently, no. The Government anticipates obtaining an appraised value for the temporary work area easements in-house, after the initial title exams are provided.
QUESTION 10: In the Technical Requirements, paragraphs 1.a. and 6. address ownership of subsurface rights. Mineral severance deeds identify the owner of the subsurface rights at the time of the severance.
a. Typically the Government wants us to identify the severance and provide a copy of the mineral severance deed. Is this acceptable?
b. In considering the above, this solicitation appears to require the contractor to identify the present owner of the subsurface rights meaning that the ownership needs to be traced from that severance whenever it was to the present day. This type of work is not performed by title companies. It is typically performed by landmen and outside of traditional title searches and difficult to quote without basic information about the severance. Please confirm that this step is not a requirement of this solicitation.
c. If it is confirmed that present day subsurface rights ownership is to be determined, would the Government consider removing this requirement from the basic pricing of the search work in the solicitation and handling this as a separate task to be quoted only when it is needed such as for closing costs described in Part III, paragraph 5.
RESPONSE 10a-c: The Government is no longer requesting subsurface mineral rights information in the title exam. The Performance Work Statement has been revised to remove this requirement.
QUESTION 11: Regarding closing services:
a. Please confirm that the Government will prepare the deed.
b. Please confirm that the deed will come with the Acceptance by Grantee page pre-signed by the Government.
c. Please confirm that the Government will prepare the "Payment and Closing Sheet".
d. Is a mailaway closing whereby the documents can be shipped to the seller for execution and notarization?
RESPONSE 11a: Yes, the Government will draft the easement deed.
RESPONSE 11b. Yes, the deed will come with the Acceptance by Grantee page pre-signed by the Government.
RESPONSE 11c. No, the Government has the option to exercise CLIN option number nine (9) thru fifteen (15), for closing services.
RESPONSE 11d. If the landowners are out of state, yes, the easements will be sent out for signature either by the Government or the Closing Attorney.
QUESTION 12: The solicitation states that an award will be made based on price only. Please confirm that a narrative proposal regarding technical expertise and past performance, etc. is not required as part of an offer for this work.
RESPONSE 12: Correct, the award will be made on price alone, and a narrative proposal regarding technical expertise and past performance is not required.
QUESTION 13: Do the sellers have legal representation/counsel in these transactions or are the sellers required to have legal representation/counsel in these transactions or are you aware if the sellers have legal representation/counsel in these transactions?
RESPONSE 13: Currently, is unknown whether any of the landowners are represented by counsel or will be in the future. The one exception currently known is the Town of Plymouth, Massachusetts, which is represented by Town Counsel. It is not a requirement of the Government that the parties be represented by counsel.
QUESTION 14: Are these transactions considered residential or commercial transactions?
RESPONSE 14: Based upon the limited information known, it is believed that these transactions will be residential transactions. These parcels consist mostly of vacant land and/or residential structures which appear to be vacation home(s), beach rental(s) or possibly primary residence(s).

Payment in such cases will be limited to the fee for the endorsement and the units of title insurance in excess of the units covered by the previously issued Title Policy or endorsement.
3. The Contractor represents, and it is a condition of any obligation of the Government hereunder, that the company which is to issue Title Insurance Policies under this contract, is authorized and qualified in the Commonwealth of Massachusetts to issue ALTA U.S. Title Insurance policies. If the contractor is an attorney, the pricing schedule must be accompanied by the written commitment of a company so qualified, to issue Title Insurance Policies and Commitments ordered hereunder, and a statement by said company that the contractor/attorney is its agent and can issue policies in its name.
4. At a minimum, the Preliminary title commitment document must extend for a period of no less than 6 months.
5. EXECUTION:
a. The Preliminary Title Commitments (hereinafter "Preliminary Commitment") to be furnished shall be based on a thorough search and examination of the public records affecting the title to the land. The Contractor shall correct or revise the source or derivation of title of the present owner or owners, contained in such description, if necessary, or otherwise furnish an appropriate derivation of title as required by law or local practice. The Preliminary Commitment shall be unqualified for the period of search (the specified duration of the period of search is defined infra), shall contain the legal description of the property as furnished by the government, and shall be immediately followed by a reference to the source of title of the present owner. The Preliminary Title Commitment and Final Title Policy shall be issued only on the most recent forms approved by the Attorney General of the United States and the ALTA for acquisitions by the United States (the following information, though correct at the time this specification was written, is provided for the contractor's information only, and is not guaranteed: ALTA U.S. Policy - 9/28/91 form, revised 12/03/12 is the ONLY currently approved policy form). Delivery of Preliminary Commitment and Final Title Policy on forms other than those so approved will be considered a nonconforming delivery.
b. The duration of the period of search for the title examination shall be sixty (60) years in accordance with the Regulations of the Attorney General Governing the Review and Approval of Title for Federal Land Acquisitions (2016) and in compliance with practice standards for the Commonwealth of Massachusetts, whichever is longer. A Preliminary Commitment, Continuation, or Final Title Policy based on and/or written off of previously issued policies or so called "back policies" shall not be sufficient.
c. In addition, Title Policies for tracts acquired by condemnation proceedings shall include information regarding the United States' immediate predecessor in the title, in language similar to the following:
"Title to the estate or interest covered by this Title Policy at the date hereof is vested in the United States of America by virtue of a Declaration of Taking, as evidenced by Lis Pendens Notice or [or Judgment on Declaration of Taking], dated _______________, recorded in _____________ Book _________, page _________ of the records of ____________, _________ . Prior to the Declaration of Taking, title was vested in ____________ ."
6. The Preliminary Commitment will disclose the name or names of the record owner or owners of the property described therein. It will disclose the full name of every person and entity in whom title to any interest to be acquired by the United States is vested, as shown by the public records or otherwise known to the title provider. Where subsurface estates or interests in the property to be acquired are owned by persons, corporations, or other legal entities, other than the owners of the surface estate, the present record owners of each such outstanding estate or interest and all pertinent data relating thereto shall be shown in the Title Policy unless otherwise specified in the order.
7. The Preliminary Commitment must identify all documents affecting any interest to be acquired by the United States (e.g., liens, easements, rights-of-way, affirmative and restrictive covenants, and competing records of ownership) revealed by the records search. Exceptions from coverage under the Final Title Policy for these interests must specifically identify each holder.
8. The Preliminary Commitment shall be executed and shall contain in Schedule B thereof the names and addresses, as disclosed by the public records, of all persons or entities having any liens on or rights or interests in the property described therein, in order that they may be joined as parties defendant in a condemnation proceeding if one is necessary. Schedule B exclusions shall include legible copies of the source material in PDF format with functioning hyperlinks to the source documents and said high quality PDFs attached as an addendum to the Final Title Policy. Source documents also include recorded plans, either recorded independently or referenced in a recorded instrument, such a deed, easements, mortgages etc.
9. The Preliminary Commitment shall contain sufficient information concerning defects, liens, encumbrances, and other matters excepted, to enable an attorney examining the policy to determine the nature and extent of such exceptions and their probable effect on the validity of the title to the land described. It shall also state or be accompanied by a report specifying the evidence or action, if any, which will be acceptable to the corporation issuing the Final Title Policy, as a basis for the issuance of a Continuation deleting each such defect, lien, encumbrance, and other matter from the Final Title Policy.
10. Each Preliminary Commitment shall contain a detailed statement of any taxes and special assessments of record which are a lien on the property described. Such statement will include, at a minimum, the current assessment information, including name of taxpayer, district (if applicable) assessment, and dollar amount. The statement will also either clearly itemize all delinquent taxes or affirmatively state that there are no delinquent taxes.
11. If the Preliminary Commitment contains any objection with respect to liens for taxes, assessments, or bonds of a special improvement district, such objections will be followed by references to the statutes pursuant to which such special improvement district was organized, its taxes and assessments levied and its bonds issued and any other facts necessary to enable an examining attorney to determine the nature and extent of the lien, if any, created by such taxes, assessments, or bonds, on the land described therein.
12. If the Preliminary Commitment shows title in a record owner who is deceased, it shall also state therein, or be accompanied by a statement indicating whether a judicial proceeding, affidavits of heirship, or some other form of proof will be acceptable to the title company as the basis for the issuance of a Final Title Policy showing title in the United States upon execution and recordation of a deed to the United States from such persons shown by such proof to be all heirs of the deceased.
13. If the Preliminary Commitment shows record title in a state, county municipality, or other subdivision of the state, or in a corporation, or a church or other religious, educational, or charitable institution or organization, or in a person or persons acting in a fiduciary or similar capacity, without authority to convey the property in the absence of specific authorization, the Preliminary Commitment shall disclose the incapacity of or limitation on the authority to convey the property and shall specify what action, if any, is necessary before a valid conveyance of the property may be made to the United States and what proof thereof will be required by the title company before issuing a Final Title Policy showing valid title to the property in the United States.
14. A Preliminary Commitment containing any exception or objection with respect to rights or possible rights under the provisions of Section 13 of the Selective Training and Service Act of 1940 (50 USC App. 313), or the Soldiers and Sailors Civil Relief Act of 1940, as amended (50 USC App. 501-509) must:
a. Contain the name of each person having such rights, and the address of any such person, if known.
b. Contain or be accompanied by a statement of the company issuing the policy showing the nature and extent of the interest in the land of each such person, and
c. If any such person has an actual interest in the land, contain or be accompanied by a transcript of the proceeding giving rise to such rights and disclose the action, if any, taken in the proceeding to comply with the requirements of said Acts.
15. Each Preliminary Commitment shall be executed by a duly authorized officer of the issuing corporation, shall bear the corporate seal of such corporation, and shall be countersigned by the proper officer of the corporation, where necessary. The Final Title Policies, as amended by the final Continuation to the commitment, shall not except from the corporation's liability, any defects, liens, encumbrances, or other matters of record set forth in the original commitment which are waived by the corporation or its duly authorized representative before closing of the acquisition, nor shall amended commitment contain any exception with respect to any matter affecting the title as of the date of the original commitment, or its Continuation, which was not disclosed in the original commitment, or its Continuation.
16. The Contractor also agrees, if requested by the Government technical representative, to review the proposed temporary work area easement (TWAE) of the property to the United States and advise as to the sufficiency of the TWAE to vest valid title to the property described in Schedule "A" of the
Preliminary Commitment, Interim Binder, or Final Title Policy. For these purposes the Contractor shall designate a local representative authorized by it to pass upon the form and sufficiency of the curative material, to waive objections, in the Preliminary Commitment, Interim Binder, or Final Title Policy and approve the proposed easement deed to the United States. The Contractor shall, if so requested, have its representative present at the closing of the purchase transaction to determine the current status of the affected titles.
17. The Contractor agrees to report changes in ownership and/or to eliminate or cause to be eliminated from the Final Title Policy by intermediate Continuations to the Preliminary Commitments, objections disclosed in the Final Title Policies issued hereunder when ownership changes occur and when curative material obtained by representatives of the United States or others is acceptable to the title company issuing the Final Title Policies hereunder.
18. "Continuation" is defined as a printed or typed amendment to the Preliminary Commitment previously issued by the title company, which extends the effective date of the original policy, and executed in the same manner as the original policy, and may be either an intermediate or final Continuation. The intermediate Continuation shall reflect the condition of title subsequent to the date of the original Preliminary Title Commitment and prior to the date of closing of the acquisition; the final Continuation shall reflect the vesting of title in the United States. The Continuations shall be issued only upon written order of the Contracting Officer or duly authorized representative. Endorsements which merely delete exceptions from the original policy due to presentation to the title company or the contractor of satisfactory curative matter and which do not require any search of courthouse records are not Continuations within the meaning of this contract.
19. If the corporation which is to issue Final Title Policy hereunder customarily insures marketability of title in the locality where the land is situated, the Policies to be issued hereunder shall not contain the paragraph headed "Refusal to Purchase" under "General Exceptions" of the aforesaid approved Title Policy, but shall insure the marketability of the title.
20. Liability of the company under the Final Title Policy, issued pursuant to the specifications, shall not be less than the monetary consideration paid for the real property; or if the acquisition is by gift or donation the estimated value of the real property; or in the case of acquisition by condemnation, shall not be less than the sum deposited in the registry of the Court as the estimated just compensation for the taking.
PART III - DELIVERIES/PERFORMANCE
1. Preliminary title evidence document--a Preliminary Commitment, which commits the title company to issue a final ALTA U.S. Policy - 9/28/91 (revised 12/03/12). Title evidence must be in accordance with the Regulations of the Attorney General Governing the Review and Approval of Title for Federal Land Acquisitions (2016) or as further updated, and must conform to the Performance Work Statement. As part of the title evidence, the contractor will determine the sufficiency of tax takings and foreclosures under Massachusetts State law. The contractor must submit preliminary title commitment within 30 calendar days of contract award. The Government shall have 30 calendar days to review the submittal to ensure it complies with the request. If it does not, the Government shall provide comments on the deficiencies to the Contractor and the Contractor will resubmit the preliminary title evidence without deficiencies within 7 calendar days of the Government's comments.
2. (OPTION) Continuation of most recent Preliminary Commitment for title insurance. The price quoted should include all time and costs involving discussions on issues relating to title and closing (such as preliminary title evidence and items needed to clear encumbrances). The price quoted should include the title company's advice and review of drafts of easement deeds and title curative material. Title evidence must conform to the Performance Work Statement. The contractor must submit Continuation within 14 calendar days of the exercise of option tasks. The Government shall have 7 calendar days to review the submittal to ensure it complies with the request. If it does not, the Government shall provide comments on the deficiencies to the Contractor and the Contractor will resubmit the Continuation without deficiencies within 5 calendar days of the Government's comments.
3. (OPTION) Closing Services for an acquisition in Plymouth, Massachusetts. Real estate Closing Services include obtaining municipal lien certificates; obtaining and notarizing the signature of landowners on documents associated with the closing, delivering a Government check; running down title before documents are recorded to ensure no change in title status; and recording documents in the appropriate County Registry of Deeds. The price quoted should include all costs not specified in item III.
5 below. If the title run down shows a change in title status, the Contractor must immediately notify the Government and wait for further direction before recording the temporary work area easement(s). The Government will require the closing agent to obtain the landowner's signature on the government form "Payment and Closing Sheet". The closing services must be provided in a timely manner so that closing will occur on the date scheduled. The Government will notify the Contractor at least 14 calendar days prior to the desired closing date and the Contractor must coordinate with the landowner and use best efforts to meet the desired closing date.
4. (OPTION) Final title policy with title insurance. The Contractor must provide a final policy with title insurance within 14 calendar days after a conveyance to the United States has been recorded. The policy must reflect the condition of title through the date of closing of the Government acquisition and show that the acquisition appears on the title. Title evidence must conform to the Performance Work Statement. The cost of the insurance coverage shall be the most favorable rate offered by the Contractor.
5. If the Government elects to exercise the option task(s) for closing services, the Government will issue a Request for Proposal for costs associated with closing the transaction, namely, (A) fees charged Plymouth County Registry of Deeds and/or the Plymouth County Registry District of the Land Court to record the temporary work area easement(s); and (B) any applicable property conveyance tax (while the grantee United States of America is exempt, the contractor must pay the grantor's portion of the tax). The Contractor shall submit these costs in the form of a response to the Request for Proposal. If acceptable, the Government will issue a modification to the Contract.
6. Affirmative title coverage. While not likely, it is possible the Government may require affirmative coverage insurance over exceptions. If coverage is required, the Government will issue a Request for Proposal and the Government and Contractor will negotiate a fair and reasonable rate.
