QUESTIONS AND ANSWERS
1. QUESTION: I have a question about Clause 52.211-10 for Notice ID W912WJ20Q0106, 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984) The Contractor shall be required to (a) commence work under this contract within 14 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and ( c) complete the entire work ready for use not later than 60 days from NTP. The time stated for completion shall include final cleanup of the premises.
This would normally not be a concern but with the COVID19 pandemic, can you please let me know what the penalties would be for violation?
1. ANSWER: This contract contains requirements for the timely execution of the work under normal circumstances. Contract Clause 52.249-10 Default (Construction) addresses circumstances where delays in proceeding with the work may be excusable. Please note that the contract also requires compliance with all applicable Federal, State and local laws and regulations, including any applicable State issued shut down orders. If, in the course of performing the contract, the contractor wishes to request a time ajustement for excusable delays, the contractor should submit a written request with specific information about the time impact the pandemic has had on operations relative to performance of the project.
2. QUESTION: My concern is if COVID19 delays our process internally or with our suppliers. We received notice from the Mill that lead time on the particular material could be 8 to 10 weeks.
It would seem that we will have an issue with Clause 52.211-10, we would need help with that if we are awarded. If this precludes me from submitting a proposal please let me know.
