SECTION 00010 - SOLICITATION CONTRACT FORM

The contractor period of performance end 135 has been deleted.

The following have been added by full text:

AMENDMENT 0001

SPECIFICATION CHANGES

1. In Section 01 11 00 “SUMMARY OF WORK” under subpart 1.11.1 titled “Hours of Operations,” remove the first sentence that reads “Hours of operation are from 7:00 a.m. to 5:00 p.m., Monday through Saturday, and from 10:00 a.m. to 5:00 p.m. on Sunday.” from subpart 1.11.1a and replace it with the following verbiage:

The Contractor will be allowed to work 24 hours a day, Monday through Saturday, and from 10:00 a.m. to 5:00 p.m. on Sunday.

2. In Section 01 11 00 “SUMMARY OF WORK” under subpart 1.11.2 titled “Work Restrictions,” remove the verbiage in its entirety and replace it with the following verbiage:

All dredging and disposal work shall be conducted within the designated environmental window and the contract period of performance from 15 October 2020 to 31 January 2021, with all work being completed by the date specified in the contract solicitation. All work shall include dredging, disposal and placement of dredged material, grading of placed material, site clean-up, and demobilization.

3. In Section 01 57 19 “TEMPORARY ENVIRONMENTAL CONTROLS” under part 3.1, remove the second paragraph in its entirety and replace it with the following verbiage:

A copy of the Water Quality Certificate (WQC) issued by the Rhode Island Department of Environmental Management (RIDEM), dated 9 September 2020, and a Coastal Zone Consistency Concurrence (CZM) issued by the Rhode Island Coastal Resources Management Council, dated 4 August 2020, has been provided as part of the Contract. The WQC and CZM shall be kept on hand at all times during the performance period of this contract. The WQC and CZM are for reference only and shall not be relied on for contract requirements. In the event a discrepancy is discovered between the reference documents and these specifications or the contract drawings, the Contractor shall notify the Contracting Officer for clarification. The Contracting Officer will rely on permit requirements and conditions to resolve perceived conflicts. The opening date of the dredge window, noted as “October 1, 2020” in the WQC under condition 3, shall be replaced with “October 15, 2020”.

4. In Section 01 57 19 “TEMPORARY ENVIRONMENTAL CONTROLS” under part 3.1, add a third paragraph with the following verbiage:

The proposed work for surveying the amount of shellfish, and the restoration, transplanting, and monitoring of eelgrass as noted in the first paragraph and under conditions 2, and 4 through 7 of the Water Quality Certificate will be completed by others and is not part of this contract.

Question #1: Could you please provide the dredge quantities for each dredge area?

Government Response 1: The geometric coordinates and depths for the proposed dredge areas shown on the contract drawings and the provided xyz data for existing conditions will allow the bidder to compute the required and overdepth volumes for each dredge area.

Question #2: Can you provide X, Y, Z data files for design and existing elevations.

Government Response 2: xyz data for existing conditions within the pond and at the placement sites may be requested by contacting the contract specialist. The contract specialist will arrange for transfer for these large files, as they cannot be posted to beta.SAM due to size constraints. Design elevations are shown on the contract drawings.

Question #3: Is completion of the project when 70,900 cy has been successfully dredged or the completion of the beach placement? Our experience is significantly more material will be needed on the beach due to the surf removing sand during placement. If this material is required, will additional there be additional compensation for the volume required? Are additional dredge areas available if more material is required?

Government Response 3: Project completion requires that all work to dredge and place 70,900 CY of material, including clean-up of site and staging and storage areas, and demobilization be completed on or before the date specified in the contract documents.

The Contractor is responsible for meeting the dimensional requirements of the contract and is not responsible for any material that is removed as a result of wave action once placement has been accepted by the Government (see Note 4 on sheet G-003). Additional material shall not be placed to make up for loss of material due to wave action once placement of material has been accepted by the Government.

Question #4: Operational hours currently only allow 10 hours per day. Can these hours be modified to operate 24 hours per day 6 or 7 days per week? There should be a precedent for this type of work being allowed around the clock in the past.

Government Response 4: The town of Westerly has allowed a change to the operational hours from 10 hours per day, Monday through Saturday to 24 hours per day, Monday through Saturday, with Sunday hours to remain the same as to what is currently specified in the contract documents.

Question #5: 01 11 00 1.11.2 State the environmental window is open on October 1st and 01 11 00 1.3 states October 14th. Please confirm what day dredging operations can begin. Also, it calls for all operations including demobilization to be complete by January 31st. Can demobilization be conducted after January 31st if all in water equipment has been removed already?

Government Response 5: The opening date for the environmental window, shown under subparagraph

1.11.2 in Section 01 11 00 Summary of Work, is a typographical error and should read “15 October 2020”.

Dredging work cannot start until 15 October 2020. Due to environmental restrictions all work must be completed on or before 31 January 2021. Extensions will not be granted.

Question #6: The bid opening is currently on October 6th. When should the contractor expect receive notice to proceed? What should the contractor assume for review period of submittals?

These answers will help to determine the earliest dredging can begin.

Government Response 6: As noted in clause 52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984) – Alternate 1 (APR 1984), The completion date is based on the assumption that the successful offeror will receive the notice to proceed by 30 October 2020. The completion date will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.

The governmental review period for submittals is specified in the contract documents. The Government will do its best to turn around submittals as quickly as possible when it can but an expedited review is not guaranteed.

Question #7: The specifications call for a safety person at the discharge 24 hours per day doing inspections? Is this required if operations can only be conducted 10 hours per day?

Government Response 7: The safety person will be required to inspect and remain at the discharge end at all times when discharge operations are being conducted within the operational hours. Refer to response provided for Question #4 for change to operational hours.

Question #8: Sheet G-003 Note 4 - How will the contracting officer accept the placement of material on the beach? Will this occur daily? During the last project a significant amount of material was lost from wave action.

Government Response 8: For acceptance of work as needed, the Contractor must coordinate their schedule with the designated Contracting Officer’s Representative (COR). Refer to Government Response 3 for issues regarding loss of material due to wave action.

Question #9: Is there a deadline for the submission of additional questions?

Government Response 9: Please submit additional questions at least 5 days before bid opening.

Question #10: The project is to dredge 70,900 cy and place it on the beach. The surf will be removing sand during placement. Is the goal of the project to remove the material from the pond, or is it to place material onto the beach. If it is to get that amount of material onto the beach and additional material is needed, are there additional areas to dredge to meet the placement requirements?

Government Response 10: Please refer to the response provided for Question #3.

Question #11: Requesting the $30M dredging designation be removed and left with the 237990 Small business NAICs code and $39.5M limit since this dredging RFP also has a significant civil scope of work.

Government Response 11: The size standard will remain $30M for this dredging project.

Question #12: What is the Government’s estimated range for the project (e.g., $500K-$1MM, $1-$5MM, etc.)?

Government Response 12: Please see 52.003-4015 Magnitude of Project, included with this amendment.

Question #13: Is there a formalized way to ask questions in the future (e.g., ProjNet)?

Government Response 13: New England District does not use ProjNet to receive RFIs. Questions can be submitted by following the instructions in section 00010 of the solicitation.
