A Payment Bond or Irrevocable Letter of Credit is the SELECTED payment protection for the Government. The penal amount of bond shall be 100% of the original contract price. Providence, RI Statement of Work

February 2019

I. General

1. Scope of work

Furnish all labor, equipment, tools and materials to replace ten existing louvers and one fixed window at the Fox Point Hurricane Barrier located in Providence, RI. New windows shall be hurricane rated with both fixed and awning type windows complete with all frames and hardware components to provide functional windows in accordance with this scope. Work includes demolition, removal and proper disposal or recycling of the existing louvers and windows.

2. Location The work site is within a pump station of the Fox Point Hurricane Barrier located in Providence RI. Access to the site is from 40 Point Street, Providence RI.

3. Site Visit

Contact the Technical Point of Contact to arrange a site visit. The Technical Point of Contact (TPC) for the project is Andrew LaBonte (978-318-8418 or andrew.s.labonte@usace.army.mil).

4. Schedule The work shall be completed within 210 days of notice to proceed. The project area will be open to the contractor Monday through Friday, 8:00 AM to 4:00 PM. All work must be done during these hours unless additional hours are approved by the Technical Point of Contact.

No work shall be done on weekends or Government holidays. Work on the windows shall be properly sequenced to protect the interior of the pump station from weather.

5. Safety Requirements

a. General: All work shall be conducted in accordance with the U.S. Army Corps of

Engineers Safety and Health Requirements Manual (EM 385-1-1, most recent edition), and all applicable OSHA, federal, state, and local safety and health requirements. A copy of EM 385-1-1 can be accessed at the project office or electronically at Headquarters USACE website under publications using the following link:

b. Accident Prevention Plan: The Contractor shall prepare an Accident Prevention Plan (APP) specific to the activities being performed. It shall include Activity Hazard Analyses (AHAs) for all tasks. Work shall not proceed until the APP has been reviewed and accepted by the Government.

Contractors are responsible to ensure their subcontractors are in compliance with safety requirements. The Contractor shall conduct a safety meeting at the project site on the first day of work, whenever a new activity or phase of work begins, or at least weekly during the progress of work.

c. Activity Hazard Analyses: An AHA shall be submitted for each major phase of work.

The analysis shall define all activities to be performed, identify the sequence of work, the specific hazards anticipated, and the control measures to be implemented to eliminate or reduce each hazard to an acceptable level. Work shall not proceed on a phase of work until the AHAs have been accepted. A preparatory meeting shall be conducted to discuss the AHAs with onsite employees. The AHA shall be continuously reviewed and revised to address changing site conditions as appropriate.

d. Required Personnel: The Contractor shall employ a minimum of one Competent Person (CP) at each project site to function as the Site Safety and Health Officer (SSHO). The SSHO shall be present at the project site and report to the contractor’s upper management. The SSHO is required to have related construction experience and have completed a 10 Hour OSHA training (or more).

e. Accident Reporting: All accidents and near misses shall be investigated by the Contractor and reported to the Technical Point of Contact immediately. ENG Form 3394 shall be completed and submitted within five working days of an incident.

6. Fall Protection

a. A site-specific Fall Protection and Prevention Plan is required as part of the APP.

The Fall Protection part of the APP shall address: Location of anticipated anchorages, Rescue plan and procedures, Fall arrest and horizontal lifeline systems, Inspection and storage of fall protection equipment, and Inspection and oversight methods employed.

b. Workers using fall protection: Workers shall be trained and capable of using fall protection equipment in accordance with the manufactures instructions. Workers shall follow the policy, procedures, and instructions of the Competent Person regarding the use of fall protection, rescue systems, and related equipment. They shall:

i. Be trained by a CP in accordance with EM 385-1-1, Section 21.C.05

ii. Properly use, inspect, maintain, store and care for their fall protection equipment and systems;

iii. Inspect all fall protection equipment or damage or defects, prior to each use.

iv. Understand the site-specific rescue procedures;

c. Personal Fall Arrest System Requirements (PFAS): All components of the PFAS shall meet the requirements contained in ANSI Z359, Fall Protection Code, to include full body harnesses, connectors, lanyards and Self-Retracting Devices.

d. All scaffolding, aerial work platforms, scissor lifts, or similar must be used in accordance with EM 385-1-1, Section 22.

7. Preconstruction Conference

Prior to the start of any work, the Technical Point of Contact will schedule and conduct a “Preconstruction Conference.” The Contractor’s staff responsible for quality and safety on the job site will attend this meeting. This conference will be scheduled for a time and location agreeable to the government and contractor. No work may be performed under this contract prior to this conference. The purpose of the conference is to enable the Technical Point of Contact to outline the requirements in terms of safety, quality, communications, inspections and payments. Storage areas for materials, equipment and dumpsters will also be coordinated at this meeting.

8. Permits

The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses, permits, and letters of certification. The Contractor shall comply with any applicable Federal, State, County, and Municipal laws, codes, and regulations in connection with the performance of the work specified under this contract.

9. Security

The contractor will comply with all established security policies at the barrier project.

Potential periods of heightened security may affect access to work areas. During periods of heightened security, the Government reserves the right to close any property. The Contractor shall be given at least 24 hour notice of any such closure.

10. Contractor Conduct

The work area is located on Federal property. Contractor and employees must act in a professional manner at all times. Alcohol and firearms are prohibited on project grounds.

11. Payment

After final inspection and acceptance by the Government, the Contractor must submit an invoice to the Technical Point of Contact. The invoice shall include the proper name of the contractor, invoice date, contract number, dates of service, description of work, and total amount due. Payment for work accepted by the Government will be made within 30 days of receipt of a proper contractor invoice.

II. Technical Requirements:

Part 1 General:

Summary:

Furnish all labor, equipment, tools and materials to replace ten existing louvers with hurricane rated window systems each approx. 11-foot in height x 4-foot wide and one existing fixed window approx. 4-foot x 4-foot wide. New windows shall be installed in accordance with the manufactures recommended means and methods to provide fully functional and weathertight new windows for the pump station.

Submittals:

Although the Government technically reviews submittals that are required, it is the Contractor’s responsibility to ensure all work is completed in accordance with this scope.

The following submittals must be prepared and submitted for Government acceptance.

Submittals must be accepted by the government prior to the commencement of any field activities.

Product Shop Drawings, design and layout drawings for the replacement window systems. Include details of the frame materials and sizes, anchorage hardware, operating equipment for the awning windows, glass, weather stripping, screens, etc. Include documentation from window manufacturer certifying the window performance as specified herein.

Safety Submittal- Safety Plan with activity hazard analyses that lists potential hazards associated with the louver replacement field work and appropriate measures to mitigate the hazards. Safety Plan shall include expected method for workers to reach exterior of louver and window locations.

Warranty. The Contractor shall submit all applicable warranty documentation for the products installed.

Omissions:

This contract may not cover all specified activities, steps, and procedures required to supply the contract product. In case of omission, the normal industry, state, or federal standards, practices, specifications, and/or guides shall prevail. In no instance shall an omission be reason to produce less than fully functional hurricane rated windows.

Quality Control and Quality Assurance:

The contractor is responsible for the quality control of the work. The government has the right to inspect and test all items called for by the contract for Quality Assurance, to the extent practicable at all times and at all places during the term of the contract.

Other Contracts:

The Government has other contract work not related to this contract ongoing at the barrier. The contractor shall fully cooperate with other Contractors and Government employees. The contractor shall not commit or permit any act, which will interfere with the performance of work by another contractor, or by Government employees.

Clean Up:

The Contractor shall practice good housekeeping to maintain a safe job site. The contractor shall keep the work area, including any storage areas, free from the accumulation of waste materials.

Upon completing work, the contractor shall remove all tools, equipment, and materials that are not the property of the government and shall clean up the job site to the satisfaction of the Government.

Access to Pump Station and Receiving and Storing Materials:

Access to the pump station is through property owned by an adjacent power generating facility.

Contractors will need to comply with security guard sign-in and sign-out requirements for access to the pump station. The contractor is responsible for receiving and unloading of delivered materials. The contractor is responsible for protecting any equipment and materials until they are placed in service. Areas for storage of materials and space for dumpsters will be coordinated at the preconstruction meeting. A single bathroom and 120 volt power for hand tools is available inside the pump station at the work site.

Part 2 Materials/Products:

Each of the ten existing louvers, on the upstream side of the pump station, shall be replaced with a set of windows that consists of two fixed windows on top with one awning type window that is operable while standing on the floor of the pump station (each of these windows will be approximately 3.5-feet tall x 4-feet wide). One existing fixed window, on the downstream side of the pump station, shall be replaced with a fixed window of the same size. Dimensions appropriate to fit in the rough openings of existing louver vents and window opening. Rough openings of existing louvers are approximately 11’ in height by 4’ wide. Rough opening of the one fixed window opening is 50 ½” in height by 48” wide. Windows shall have a minimum 10 year glass, parts and labor warranty. Contractor shall verify all dimensions and layout of openings.

New hurricane rated window systems and fixed window shall have the following minimum ratings.

I. Window projection and Integral hinges must open, adjust and lock at least out to 40 degrees

II. Cam lock: Double Cam locks III. Screen: Stainless steel insect screen with wicket IV. Screen Frame: Extruded Aluminum Alloy V. Frame color: Silver anodized

VI. Performance rating minimum of: AW-PG90-AP, 90psf pressure tested VII. Hurricane large missile impact rating minimum level: D

1: Below is an example of an acceptable hurricane rated impact window system that meets all the minimum requirements to replace each of the ten louvers, but the Government will accept will windows that meet the minimum requirements.

The listing of specific product names and manufacturers is to establish a standard of quality, characteristics and features. The contractor may propose windows from an alternate manufacturer that will be considered by the Government. Materials must be accepted by the Government prior to delivery.

Part 3 Execution:

The contractor shall ensure that all submittals have been approved prior to onsite work and shall coordinate the schedule for all onsite work with the Government technical point of contact.

Work includes demolition and removal of ten existing louvers and one fixed window. Removal of the existing louvers and window shall be done by appropriate means that will not damage the building’s brick walls and other equipment in close proximity. The entire frame of each existing louver and window shall be removed. Any damage caused by demolition shall be repaired by the contractor at no additional expense to the government. All existing utilities and equipment shall be protected from damage. Contractor shall ensure that dust from the demolition is contained.

Access to the exterior of louver and window locations will require staging, a man-lift, ladders or other means for workers. Contractor’s shall plan and install all required access equipment.

Installation of temporary anchors to secure access staging is acceptable based on their removal at completion of work. Note there is no vehicular access to the downstream side of the pump station near the one fixed window to be replaced. All access equipment shall be in good working order with all safety devices for fall protection.

New windows shall be installed in accordance with the manufactures recommended means and methods to provide fully functional and weathertight new windows for the pump station. Install windows plumb, level, square and neat. Trim shall be installed that looks neat and professionally finished. Anchorages shall be solid and interface between windows and building walls shall be in accordance with manufactures recommendations. Windows shall be adequately anchored to maintain positions permanently when subjected to normal thermal movement, building movement, and wind loads. Determination of proper perimeter anchors and spacing is the responsibility of the contractor. Use only skilled tradesmen with work done in accordance with approved shop drawings and manufacturers recommendations. Adjust windows for proper operation after installation.

Work shall be done such that no contaminants are released to the environment. Debris and demolition waste shall be cleaned up daily and properly disposed offsite by the contractor in accordance with local, state and federal laws and regulations. Areas for storage of materials and space for dumpsters will be coordinated at the preconstruction meeting.

Work shall be sequenced to minimize time that the openings are without functional replacement windows. The contractor shall provide temporary means to secure all openings overnight if work is not completed in one day. Work shall be sequenced to protect interior space from dust, dirt and weather.

Contractor will install one hurricane window system window first, and ensure window fits correctly and operates properly before proceeding to another louver vent/fixed window.

Contractor will contact technical point of contact to inspect first window installation before proceeding to ensure proper installation.

Although work is not specifically shown or specified, contract shall include miscellaneous items, appurtenances, devices and materials obviously necessary for a sound, secure and complete installation.

Contractor work on the windows shall not impact work by other contractors or Government operations. Contractor shall provide manufacturer’s warranty documents over to the Technical Point of Contact.

For a period of one (1) year from the date of complete installation, the contractor shall provide a warranty for satisfactory performance of the window installation which includes that of the operation of the windows, frame and parts.

Section H - Special Contract Requirements

SECURITY INFORMATION

The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the Technical Point of Contact not later than 5 calendar days after the completion of the training.

The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the Technical Point of Contact no later than 3 business days after the initial award.

(a) This clause does not apply to terminations. See UAI 5152.249-9000, Basis for Settlement of Proposals, and Federal Acquisition Regulation (FAR) part 49.

(b) Allowable costs for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a contractor or subcontractor at any tier shall be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the contractor’s accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor’s accounting records, costs for that equipment shall be based on applicable provisions of Engineer Pamphlet (EP) 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region I. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the contracting officer. For equipment not included in the schedule, rated for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.

(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36. Rates for equipment rented from an organization under common control, lease purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.
