A Payment Bond or Irrevocable Letter of Credit is the SELECTED payment protection for the Government. The penal amount of bond shall be 100% of the original contract price. If the contract price increases, the Government will require an increase in the penal sum of the existing bond. This bond shall be submitted to the Contracting Officer within 10 days after receipt of award.

6. Contractors shall provide completed FAR clause 52.204-8 (Annual Representations and Certifications) found in Section K of this solicitation with their quote, if the Contractors have not completed their annual representations and certifications electronically via the SAM website at www.sam.gov. 7. Contractors are not required to submit an Accident Prevention Plan (APP) with their quote. The successful offeror will be required to submit this document upon award. The APP must be accepted by the Government Designated Authority prior to the preconstruction conference.

I. GENERAL
1. Scope
Furnish all equipment, materials and labor for the Woonsocket Falls Dam, Tainter Gate Level Indicator and Control Replacement, on four Tainter Gate controllers, at Woonsocket Flood Reduction Project in Woonsocket, RI., for the purpose of facility maintenance.
2. Location
The required services shall be performed at the following project site locations:
Woonsocket Falls Dam, 121 East Main Street, Woonsocket, RI
3. Site Visits and Requests for Information
Contact the Technical Point of Contact, Joe Zanca 978-318-8419 or joseph.l.zanca@usace.army.mil to arrange a site visit.
4. Schedule
The period of performance shall be 90 days from notice to proceed. The project area will be open to the contractor Monday through Friday 7:00 AM to 3:30 PM and all work must be done during those hours unless additional hours are approved by the Technical Point of Contact. No work shall be done on weekends or Government holidays.
5. Safety
The contractor will comply with all pertinent provisions of the latest edition of the U.S.
Army Corps of Engineers Safety and Health Requirements COE EM 385-1-1. A copy of COE EM 385-1-1 is available for reference at the project office or the manual may be viewed at the following link http://www.usace.army.mil/SafetyandOccupationalHealth/EM38511,2008BeingRevise d.aspx The contractor shall also comply with all OSHA work safety standards. The project staff can and will order the cessation of work at any time should the safety of employees and visitors become jeopardized.
6. Preconstruction Conference
Prior to the start of any work, the Technical Point of Contact will schedule and conduct a “Preconstruction Conference”. The Contractor’s Project Manager and Quality Control Personnel will attend this meeting. This conference will be held at the time and location agreeable to the government and contractor. No work may be performed under this contract prior to this conference. The purpose of the conference is to enable the Technical Point of Contact to outline the procedures that will be followed by the Government in its administration of the contract, and to discuss the performance that will be expected from the Contractor. This conference will allow the Contractor an opportunity to ask questions about the Government’s administration and inspection of contract work or obtain other pertinent information that might be required. At the Preconstruction conference the contractor shall provide to the name of the project superintendent with a telephone number for project coordination.
The following is a general list of items for discussion during this Preconstruction Conference:
Authority of the Technical Point of Contact.
Contractor’s Safety Program (including sub-contractors).
Accident Prevention Plan and Activity Hazard Analysis.
Weekly Safety Meetings (Documented on NED Form 251) Accident Reporting (ENG Form 3394) Safety Data Sheet (SDS) requirements Correspondence, Communication and Administrative Procedures.
Invoice and payment.
7. Permits
The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses, permits, and letters of certification. The Contractor shall comply with any applicable Federal, State, County, and Municipal laws, codes, and regulations in connection with the performance of the work specified under this contract.
8. Security
The contractor will comply with all established security policies at Woonsocket Flood Reduction Project. Due to periods of heightened security that may affect the access to the areas covered under this contract, areas may be subject to periodic closures, which in turn may reduce or inhibit the Contractor’s ability to access certain areas. During periods of heightened security, the Government reserves the right, at any time, to close any property or portion of property and reschedule and/or cancel any subsequent service in an area. The Contractor shall be given at least 24 hour notice of any such closure.
9. Payment Payment shall be made on a per job basis. After final inspection and acceptance by the Government, the Contractor must submit an invoice and a completed, signed US Army Corps of Engineers ENG93 form to the Technical Point of Contact. The invoice shall include the invoice date, contract number, dates of service, description of work, quantities, process, and total amount due per line item. For jobs greater than 30 days the contractor may request progress payment.

10. Damage to Government and Private Property
The Contractor shall be responsible for restoring any Government facilities or structures damaged as a result of the firm’s operation. The Contractor shall also be responsible for any damage to private property or injury to any person as a result of the firm’s operations. The Contractor shall notify the Technical Point of Contact immediately of damage to Government and private property and injury to any person resulting from the firms’ operation.
11. Point of Contact Requirements
The Contractor shall provide to the Technical Point of Contact a telephone number and a point of contact for discussion of any contractual matters.
II. TECHNICAL

Submittals:
Although the Government technically reviews submissions required by this scope of work, it is emphasized that the Contractor’s work must be prosecuted using proper internal controls and review procedures. The documents identified below must be prepared in accordance with the applicable standards, submitted to the Technical Point of Contact for review and accepted by the government prior to the commencement of any field activities.
Product specification sheets and cut sheets for electronic accessories and equipment.
Product specification sheets and cut sheets for all associated electrical panels and equipment.
Specifications of new electro mechanical indicator system.
Manufacturer Warranty for all equipment and hardware.
Abbreviated Accident Prevention Plan (AAPP) and Activity Hazard Analysis (AHA).
Clean Up:
The Contractor shall practice good housekeeping to maintain a safe job site. The contractor shall keep the work area, including any storage areas, free from the accumulation of waste materials.
Upon completing work in an area the contractor shall remove any tools, equipment, and materials that are not the property of the government. Upon completion of work, the Contractor shall clean up the job site to the satisfaction of the Government.
Government Resources:
The contractor is responsible for providing all materials to complete the project. Unless specified in the contract, the Government will not provide any equipment, telephone services or other resources.
Omissions:
This contract may not cover all specified activities, steps, and procedures required to supply the contract product. In case of omission, the normal industry, state, or federal standards, practices, specifications, and/or guides shall prevail. In no instance shall an omission be reason to produce less than an acceptable product.
Quality Assurance:
The contractor is responsible for the quality control of the contract work. The government has the right to inspect and test all items called for by the contract, to the extent practicable at all times and at all places during the term of the contract.
Other Contracts:
The Government may undertake or award other contracts for additional work not related to this contract, and the Contractor shall fully cooperate with other Contractors and Government employees. The contractor shall not commit or permit any act, which will interfere with the performance of work by another contractor, or by Government employees.
Environmental Protection:
Containers for excess and/ or waste materials, rubbish, etc. shall be provided by the contractor at the site, and the site will be inspected/ cleaned on a daily basis. No burning is permissible.
Water, air and land resources shall not be adversely impacted during the course of the work.
Contractor will take necessary steps to ensure all federal, state, and local environmental regulatory requirements are met.
Receiving and Storing Materials:
The contractor is responsible for protecting any stored material until it is placed in service. The contractor is responsible for receiving and unloading of delivered goods. Government employees will not receive material or supplies for the contractor and will not be responsible for damage to contractor equipment or material.
General:
Existing Conditions:
Woonsocket Falls Dam, consisting of four tainter gate control systems, was completed in 1959.
The electrical and mechanical tainter gate controls were rehabilitated in 2011. The last rehabilitation utilized some of the original components and mechanical indicators. The original components are composed of multiple mechanical gearing mechanisms that constantly are in error or completely inoperable. Those original components and indicators are now being rehabilitated with modern components and systems. Currently one system is broken and two are inaccurate.
Products:
Electronic, electrical and mechanical components will meet or exceed national electrical codes and specifications as listed specifications.
1. Tainter Gate Electronic Level Indicator Digital Panel Meter Display:
a. Shall be compatible with existing control system.
b. Shall have an independent, redundant sensor for level indicator, separate from the
PLC control level sensor.
c. Shall be NEMA 4x panel rated.
d. Digits shall be at least 1.20 inches in size, red in color and LCD.
e. Shall display at least three significant digits to 0.1 feet.
f. Shall have front panel programmable and calibration buttons.
g. Shall have display intensity levels, readable in direct sunlight.
h. Shall measure and track a minimum of -0.2 feet and a maximum of +14.2 feet.
i. Shall have two relays per meter to automatically activate limits to shut down gate at -0.1 feet and +14.1 feet.
j. Shall be installed in existing control cabinet at location approved by the technical point of contact.
k. Provide one additional unit for backup.
l. Shall be able to keep current gate level after power interruptions.
m. Shall operate in temperature range of -22 to +120 degrees Fahrenheit.
n. Precision Digital PD765 Trident X2 digital display meets these specifications but is not required.
2. Tainter Gate Electronic Level Indicator Sensor :
a. Shall be compatible with existing control system.
b. Shall work with new electronic level indicator display.
c. Two are required for redundancy on each gate, one connected to existing PLC control system, one connected to the new Digital Display on outdoor control cabinet.
d. Shall be waterproof or encased in a NEMA 4x enclosure.
e. Shall be compatible with Allen Bradley PLC electronic controls.
f. Shall be accurate to 0.1 feet.
g. Shall measure and tract a minimum of -0.2 feet and a maximum of +14.2 feet.
a. Shall be integrated to existing Tainter Gate mechanical movement.
b. Shall operate in temperature range of -22 to +120 degrees Fahrenheit.
c. Shall be able to keep current gate level after power interruptions.
h. Provide two additional units for backup.
3. High and Low Tainter Gate Limit Switches:
a. Shall be mechanically activated.
b. Shall be compatible with existing control system.
c. Shall be compatible with existing override mechanism.
d. Shall have two units per Tainter Gate.
e. Shall electrically stop tainter gate movement at two levels:
i. Low at -0.2 feet.
ii. High at +14.2 feet.
f. Shall be waterproof or encased in a NEMA 4x enclosure.
g. Shall be compatible with Allen Bradley PLC electronic controls.
h. Shall be accurate to 0.1 feet.
d. Shall operate in temperature range of -22 to +120 degrees Fahrenheit.
i. Provide two additional units for backup.
4. Mechanical components, fittings, fasteners and support structure:
a. Shall be stainless steel.
b. Shall not compromise any new or existing electrical, electronic or mechanical system.
c. Location shall be approved by the technical point of contact.
Execution:
Tainter Gate Level Indicator replacement shall occur in accordance with the scope of work and local and federal laws and the National Electric Codes. One gate shall be worked on and completed before moving to the next Tainter Gate. Sequence of replacement will be approved by the technical point of contact.
1. Work area will be restricted to contractors and USACE Employees.
2. Remove existing electronic level indicator sensor, limit switches, and mechanical level dial.
3. Existing platform may be reused at the approval of the technical point of contact.
4. Replace mechanical system, used to convert mechanical gate movement, on existing or new support platform.
5. Installation of new high and low limit switches, connect to existing control and override system.

6. Installation and connection of electronic level indicator sensors for digital display and
PLC.
7. Installation and connection of electronic level indicator digital display meter in existing control cabinet.
8. Calibrate all switches, sensors and level digital display meter indicators.
a. Calibration shall be to 0.1 feet accuracy.
b. Calibrate digital display relays to shut down gate movement at -0.1 feet and +14.1 feet.
c. Hard copy of digital display meter calibration program will be printed and stored inside PLC control panel.
d. Digital calibration program will be sent to technical point of contact.
9. Program existing PLC control system to operate new components.
a. Any upgrades to the PLC program or its components necessary for the execution of this contract, will be provided by the contractor.
b. New Program will be saved.
c. One digital copy of program will be left onsite.
d. One digital copy of the program will be sent to the technical point of contact.
10. Operate each tainter gate, its full range, 0.0 to +14.0 feet.
11. Operate each tainter gate to the digital display shut down -0.1 feet and +14.1 feet.
12. Operate each tainter gate limit switch bypass high and low bypass mechanism at -0.2 and
+14.2 feet.
13. Make adjustments as necessary.
14. Repeat no. 10 to no. 13 until operation is acceptable to technical point of contact.
15. Contractor will be responsible for disposal of all electrical and metal conduit, gearing and platforms removed in this contract.
16. Contractor is responsible for the cleanup of the site.

Section H - Special Contract Requirements
SECURITY INFORMATION
The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the Technical Point of Contact not later than 5 calendar days after the completion of the training.
The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the Technical Point of Contact no later than 3 business days after the initial award.

(a) This clause does not apply to terminations. See UAI 5152.249-9000, Basis for Settlement of Proposals, and Federal Acquisition Regulation (FAR) part 49.
(b) Allowable costs for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a contractor or subcontractor at any tier shall be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the contractor’s accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor’s accounting records, costs for that equipment shall be based on applicable provisions of Engineer Pamphlet (EP) 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region I. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the contracting officer. For equipment not included in the schedule, rated for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.
(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36. Rates for equipment rented from an organization under common control, lease purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization

Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.60 for calendar year 2019 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.60 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2019. If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate,if it is higher than the conformed wage rate). Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
