NOTE 1: In accordance with FAR Part 28.102-1(b)(1), the Contractor will be required to provide one of the following payment protections for all construction contracts greater than $35,000.00 but not greater than $150,000.00.

A Payment Bond or Irrevocable Letter of Credit is the SELECTED payment protection for the Government. The penal amount of bond shall be 100% of the original contract price. If the contract price increases, the Government will require an

Any reference to CCR or ORCA in any clause or provision is referring to the www.sam.gov website. Please note that Google and Google Chrome are not supported browsers for SAM registration. Mozilla FireFox, Safari, and Internet Explorer are supported browsers.
SAM.gov registration takes approximately 3 weeks (DUNS registration 1-2 business days; CAGE code validation up to 10 business days; IRS validation and overall submission 7-10 business days). It is the contractor’s responsibility to track SAM.gov registration and follow-up with required tasks. SAM.gov registration does not have to be “active” to be able to submit a quote. However, contractors must have an active record before a contract award can be made. If SAM.gov registration is not completed in a timely fashion in accordance with the SAM.gov timelines, the Government reserves the right to disqualify the quote in accordance with FAR 52.204-7(d).

7. Contractors are not required to submit an Accident Prevention Plan (APP) with their quote. The successful offeror will be required to submit this document upon award. The APP must be accepted by the Government Designated Authority prior to the preconstruction conference.

Scope of
Section C - Descriptions and Specifications
SOW
I. General
1. Scope of work
Contractor shall furnish all labor, materials, and equipment necessary to install a new potable water well and pump connecting to onsite electrical and water lines with hydrants at Conant Brook Dam. Contractor shall furnish and place two prefabricated wooden sheds to house electrical and pump control equipment.
2. Location
Conant Brook Dam Flood Reduction Project is located at Wales Road, in Wales, MA.
3. Site Visit Contact the Technical Point of Contact to arrange a site visit. The Technical Point of Contact for the project is Keith W. Beecher, 978-318-8405, at email keith.w.beecher@usace.army.mil.
4. Schedule
The work will be completed within 120 days after notice to proceed. The project area will be open to the contractor Monday through Friday 7:00 AM to 3:30 PM and all work must be done during those hours unless additional hours are approved by the Technical Point of Contact. No work shall be done on weekends or Government holidays.
5. Safety
The contractor will comply with all pertinent provisions of the latest edition of the U.S. Army Corps of Engineers Safety and Health Requirements COE EM 385-1-1. A copy of COE EM 385-1-1 is available for reference at the project office or may be viewed at the following link http://www.publications.usace.army.mil/Portals/76/Publications/EngineerManuals/EM_38 5- 1-1.pdf.
The contractor shall also comply with all OSHA work safety standards. The project staff can and will order the cessation of work at any time should the safety of employees and visitors become jeopardized
6. Preconstruction Conference
Prior to the start of any work, the Technical Point of Contact will schedule and conduct a “Preconstruction Conference.” The Contractor’s Project Manager and Quality Control Personnel will attend this meeting. This conference will be held at the time and location

Scope of agreeable to the government and contractor. No work may be performed under this contract prior to this conference. The purpose of the conference is to enable the Technical Point of

Contact to outline the procedures that will be followed by the Government in its administration of the contract, and to discuss the performance that will be expected from the Contractor. This conference will allow the Contractor an opportunity to ask questions about the Government’s administration and inspection of contract work or obtain other pertinent information that might be required. At the Preconstruction conference the contractor shall provide the name of the project superintendent with a telephone number for project coordination.
The following is a general list of items for discussion during this Preconstruction Conference:
i. Authority of the Technical Point of Contact and Quality Assurance Inspectors.
ii. Contractor’s Safety Program (including sub-contractors).
iii. Accident Prevention Plan
iv. Weekly Safety Meetings (Documented on NED Form 251)
v. Accident Reporting (ENG Form 3394)
vi. Safety Data Sheet (SDS) requirements
vii. Correspondence, Communication and Administrative Procedures.
viii. Invoice and payment.
7. Permits
The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses, permits, and letters of certification. The Contractor shall comply with any applicable Federal, State, County, and Municipal laws, codes, and regulations in connection with the performance of the work specified under this contract.
8. Security
The contractor will comply with all established security policies at Conant Brook Dam.
Due to periods of heightened security that may affect the access to the areas covered under this contract, areas may be subject to periodic closures, which in turn may reduce or inhibit the Contractor’s ability to access certain areas. During periods of heightened security, the Government reserves the right, at any time, to close any property or portion of property and reschedule and/or cancel any subsequent service in an area. The Contractor shall be given at least 24 hour notice of any such closure.
9. Payment Payment shall be made on a per job basis. After final inspection and acceptance by the Government, the Contractor must submit an invoice to the Technical Point of Contact. The invoice shall include the invoice date, contract number, dates of service, description of work, quantities, process, and total amount due per line item. For jobs greater than 30 days the contractor may request progress payments.

II. Technical Requirements: Part 1 General:
Existing Conditions:
The area for the well is in an open field area with buried electrical to a 200 amp service to be used to power the well and future construction trailers/RVs. No commercial power is available. Electrical conduit and water lines are buried and placed to receive future well water (e.g., hydrants for motor home hook up) and electrical line connections for this project.
Requests for Information:

Submittals:
Although the Government technically reviews submissions required by this scope of work, it is emphasized that the Contractor’s work must be prosecuted using proper internal controls and review procedures. The documents identified below must be prepared in accordance with the applicable standards, submitted for review and accepted by the government prior to the commencement of any field activities.
i. Accident Prevention Plan (APP) prior to start of field work
ii. Accident Hazard Analysis (AHA) prior to start of field work
iii. A valid Massachusetts Well Driller certification and licenses for any electrician or plumber involved in this contract
iv. Well System components and materials product sheets (prior to ordering/delivery)
v. Well completion report (After Installation and Prior to final payment)
vi. Pumping test report (After Installation and Prior to final payment)
vii. Water quality report (After Installation and Prior to final payment) showing it meets
Massachusetts drinking water standards. Lead, radon, water hardness tests shall be included.
Clean Up:
The Contractor shall practice good housekeeping to maintain a safe job site. The contractor shall keep the work area, including any storage areas, free from the accumulation of waste materials. Upon completing work in an area the contractor shall remove any tools, equipment, and materials that are not the property of the government. Upon completion of work, the Contractor shall clean up the job site to the satisfaction of the Government. Slurry, drill cuttings, rock core; other solid or liquid material bailed, pumped, or otherwise generated by the drilling, installation, completion, and well development procedures shall be disposed of by the Contractor off-site.
Environmental Protection:
Containers for excess and/ or waste materials, rubbish, etc. shall be provided by the contractor at the site, and the site will be inspected/ cleaned on a daily basis. Water, air, and land resources shall not be adversely impacted during the course of the work. Contractor will take necessary steps to ensure all federal, state, and local environmental regulatory requirements are met.
Government Resources:
There are no restroom facilities or Government buildings at this site. The contractor shall supply his own means of communication, restroom (porta john) facilities, and waste disposal containers.
Omissions:
This contract may not cover all specified activities, steps, and procedures required to supply the contract product. In case of omission, the normal industry, state, or federal standards, practices, specifications, and/or guides shall prevail. In no instance shall an omission be reason to produce less than an acceptable product.
Quality Assurance:
The contractor is responsible for the quality control of the contract work. The government has the right to inspect and test all items called for by the contract, to the extent practicable at all times and at all places during the term of the contract.
Other Contracts:
The Government may undertake or award other contracts for additional work not related to this contract, and the Contractor shall fully cooperate with other Contractors and Government employees. The contractor shall not commit or permit any act, which will interfere with the performance of work by another contractor, or by Government employees.
Receiving and Storing Materials:
The contractor is responsible for protecting any stored material until it is placed in service.
The contractor is responsible for receiving and unloading of delivered goods. Government employees will not receive material or supplies for the contractor and will not be responsible for damage to contractor equipment or material.
Part 2 Products:
The contractor shall provide products that are consistent with the Private Well Guidelines published in 2017 by the Massachusetts Department of Environmental Protection, available online at http://www.mass.gov/eea/docs/dep/water/laws/i-thru-z/prwellgd.pdf
Variable frequency drive submersible, constant pressure pump and controls. Grundfos SQE with CU301 Control Unit or similar.
In well storage tank. FLEXCON, IWSS Model 5 or similar.
Two (2) Frost free, sanitary yard hydrants, ADA compliant, with storage tanks to preclude drinking water contact with ground water. Woodford S4H, or similar.
Utility Sheds (2) will be 6’x8’ and of sufficient height, English Garden Shed by Kloter Farms design or similar. Buildings will be vinyl sided, no windows, lockable double doors, architectural shingles, each with 6 foot wide ramp. Sills will be pressure treated.
Color of shingles and building siding will be determined by the Technical POC.
½” Minus processed gravel for shed placement.
Part 3 Execution:
Installation:
The contractor shall install the new well in conformance to the Private Well Guidelines published in 2017 by the Massachusetts Department of Environmental Protection [available online at http://www.mass.gov/eea/docs/dep/water/laws/i-thru-z/prwellgd.pdf ] and will be in conformance with National Electric Code.
The contractor shall furnish and install a new drilled private drinking water well, as approved by the Technical Point of Contact to meet the following requirements:
1. A 6-inch drilled water well, depth shall be sufficient to yield a minimum of 5 (five) gallons per minute.
2. Final location of the well shall be approved by the Technical Point of Contact.
3. The new well shall have a sanitary cap. The contractor shall ensure that the cap is properly installed to create a sanitary seal.
4. Install a variable frequency drive, constant pressure, submersible pump of adequate horse power to provide adequate water supply to two sanitary, frost free hydrants for recreational vehicle hook ups.
5. Install an in-well pressure tank.
6. Provide and install two frost free, sanitary yard hydrants, burial depth in compliance with manufacturer specifications to prevent freezing, with sealed reservoir, so as to preclude contact of drinking water with ground water.
7. The Contractor shall connect to the two sanitary yard hydrants, each with poly line (placed by others), in sand bed, in two locations within 125 feet of well head. Each hydrant will have a curb cock for turning water supply on/off. A handle must be provided for these curb cocks.
8. Electric line from water supply well shall be connected to existing circuit panel on site;
well to electricity supply is approximately 125 feet. Conduit is in place.
9. Bed and backfill with sand, and compact all trenches.
10. The contractor shall chlorinate and test the well water and ensure installation meets all applicable state and local codes, provide report to government Technical Point of Contact.
11. Provide and install two (2) prefabricated 6’x8’ buildings with double doors to house electrical and above ground well components.
12. Buildings will be levelly placed on a prepared, compacted pad, 10” (six inches) in depth of ½” minus processed mix. Pad will extend 12” (twelve inches) beyond drip edge of each building and be a minimum of 3” (three inches) above ground level two allow for drainage. Organic material/topsoil will be removed prior to placement of processed mix and building.

Section H - Special Contract Requirements
SECURITY INFORMATION
The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the Technical Point of Contact not later than 5 calendar days after the completion of the training.
The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the Technical Point of Contact no later than 3 business days after the initial award.

(a) This clause does not apply to terminations. See UAI 5152.249-9000, Basis for Settlement of Proposals, and Federal Acquisition Regulation (FAR) part 49.
(b) Allowable costs for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a contractor or subcontractor at any tier shall be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the contractor’s accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor’s accounting records, costs for that equipment shall be based on applicable provisions of Engineer Pamphlet (EP) 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region I. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the contracting officer. For equipment not included in the schedule, rated for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.
(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36. Rates for equipment rented from an organization under common control, lease purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
