The following have been added by full text:
Request for Information
Amendment 0001:
Question 1.
How far out, in feet, can the gate be moved out into the channel to allow for access?
Answer: The gates can each be moved out up to 25 feet into the channel. Contractors should be aware that gates CANNOT be left out in the channel during hours of darkness.
Question 2.
What part of the leading edge of the skin plate needs to be painted?
Answer: As per Sheet S-201, Details D7 and C1, the area to be blasted and painted starts two feet above the water line, and extends up to the elevation of the existing walkway. The horizontal limit of painting is shown in Detail D7. Only the one side of the gate guide is to be blasted and painted.
Question 3.
Can Contractors use the fall protection cable that runs along the catwalk above the skin plate?
Answer: Contractors are welcome to use it. However, the Government does not state that it has been load tested and cannot vouch for its capability to provide a suitable fall protection system.
Question 4.
If a hurricane or other large storm comes that makes the Contractor have to take up the containment system and equipment, will the Contractor be compensated? How should this possibility be factored into the bid?
Answer: If a storm does necessitate removal of the containment system, Contractors are welcome to submit a Request for Equitable Adjustment (REA) that documents expenses of removal. These potential events should not be factored into the bid.
Question 5.
Blasting will most likely cause additional deterioration of the leading edge of the skin plate.
How is this to be handled within the contract?
Answer: There is no steel repair within the contract. Depending upon the amount of deterioration that occurs as a result of the blasting, this may be handled on a case-by-case basis.
Question 6. When do you envision this work actually taking place?
Answer: Spring 2019.
Question 7.
How many pins are in the drive rack?
Answer: The linear distance of the drive rack is 95 feet. The pins are roughly a foot apart, so the number of pins will be around 95 ±.
Question 8.
How are the pins in the drive rack held in?
Answer: The pins were inserted from the top, and then a cast material was poured around them.
They are not welded or bolted in.
Question 9. What are the pins made of?
Answer: The pins are made of carbon steel.
Question 10.
Are the flanges that the pins are held by to be blasted and painted?
Answer: As per Sheet S-101, Details E6 and B7, the flanges both above and below the pins, are to be blasted and painted.
Question 11.
Is the elastomeric sealant on the top only?
Answer: Yes. The existing elastomeric sealant to be removed is only on the top of the pins.
The new elastomeric sealant to be applied is only on the top of the pins.
Question 12.
Can Contractors use other methods of paint removal other than blasting?
Answer: For the purposes of bidding, Contractors should bid as shown in the Plans and Specs.
Once a successful award is made, then Contractors can submit a Value Engineering proposal detailing another method to be approved or rejected by the Government.
Question 13.
Blasting will most likely cause damage to the existing reflective chevrons painted on the skin plate below above and below the drive rack. What is the paint type to repair this damage?
Answer: Chevrons are reflective tape; not paint.
Question 14. Can Contractors support scaffolding from the gate?
Answer: Yes.
Question 15.
Where is the staging area? Can Contractors place equipment on the deck?
Answer: The staging area contains two locations. One is on the concrete deck surrounding the gate itself as shown in Information Drawing NBF-1-1105. The other is the large parking lot down on the lower level near the Bulkhead enclosure. Yes, Contractors can place equipment on the deck.
Question 16.
Can Contractors use the toilet facilities, water and electricity from the Barrier?
Answer: As per Spec Section 01 11 00 SUMMARY OF WORK, Paragraph 1.10.10, Government Sanitary Facilities, the Contractor must provide their own toilet facilities. As per Spec Section 01 50 00, TEMPORARY CONSTRUCTION FACILITIES AND CONTROLS, Paragraph 3.2 AVAILABILITY AND USE OF UTILITY SERVICES, The Contractor must furnish their own water and electricity.
Question 17.
Will Contractors be required to wear floatation devices for the length of the project?
Answer: As per Spec Section 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS, Contractors must comply with EM 385-1-1.
Question 18.
Can the SSHO/QC/CP be the same person?
Answer: As per Spec Section 01 35 26 GOVERNMENT SAFETY REQUIREMENTS, Paragraph 1.6.1.1 Site Safety and Health Officer (SSHO), the Site Safety and Health Officer cannot be the same person as the Quality Control/Competent Person.
Question 19.
How much power is available?
Answer: See Question 16 above. Contractor must provide their own power.
Question 20.
Has a lead risk assessment been performed? Have you tested for PCBs?
Answer: Lead is present in the coal tar. No, PCB testing has not been conducted.
Question 21. I saw on some maps that there is a ferry schedule. If there are ferries, will it impact the work?
Answer: No.
Question 22.
Under the waste generation, it indicates that all waste will be disposed of as hazardous waste. If this is the case will the USACE supply their Waste Identification number to dispose of material against?
Answer: Yes, this number will be provided prior to the actual generation of hazardous waste.
USACE is in the process of applying for this number with the state.
Question 23.
There is a photo in Spec Section 01 11 00 SUMMARY OF WORK, on page 11, that is labeled “Truss 1. Top horizontal members of this truss shall be blasted and repainted”. Is this correct?
Answer: No. This is not correct. This photo is hereby deleted.
Question 24.
Will we be blasting the bottom of the pins?
Answer: Yes, as per Plan Sheet S-101, Detail B7, the bottom of the gate drive rack is to be blasted and repainted.
Question 25.
Is the ladder carbon steel? Do we weld the new ladder in and then coat it?
Answer: Steel type of the ladder is unknown. Yes, painting of the welds must be done after attachment. However, coating of the ladder prior to transportation to the site could be done in a shop environment.
Question 26.
What is the loading restriction for cranes on the walking platform?
Answer: Cranes will not fit on the catwalks. The passageway within the west abutment has a roof that is 24 inches thick. Therefore, there are no loading restrictions for either of the concrete abutment decks.
Question 27.
What is the width of the walking platform?
Answer: The width of the radius catwalk is 30 inches and the straight north and south running catwalk is 31 inches wide. The concrete abutments are approximately 15 feet wide.
Question 28.
Are all parts of the rack in a relatively safe condition?
Answer: Contractors must answer this question to satisfy themselves.
Question 29.
Will there be an inspection for bad pins? Would we need to replace them?
Answer: No, no inspection for bad pins will be conducted. If replacement is warranted, this will be handled on a case by case basis.
Question 30.
Exactly what are we taking out of the rack?
Answer: The project is to use abrasive blasting to remove the previous coatings from all surfaces of the drive rack, including above and below and behind the drive pins. The pins themselves are not to be blasted. If you are referring to the steel components that are to be replaced in kind, please refer to Plan Sheet S-101 for the ladder, and Sheet S-401 for the walkway, new walkway beams, and new handrails.
Question 31.
It looks like the previous contractor used coal tar to coat. Are we to do the same?
Answer: Yes. As per Plan Sheet S-201, Painting Note 3 states “APPLY NEW COAL TAR
EPOXY ONTO THE NEWLY CLEANED AREAS OF THE MEMBERS MENTIONED
ABOVE.”
Question 32.
Can we use other methods besides abrasive blasting?
Answer: Bid the project as shown using abrasive blasting. If awarded, Contractor can submit a Value Engineering Proposal to propose another method of paint removal.
Question 33.
In order to gain access to all parts of this gate, can we open the gate slightly to get at the harder to reach areas?
Answer: Yes, the gates can each be moved out up to 25 feet into the channel. Contractors should be aware, however, that the gates CANNOT be left out in the channel during hours of darkness.
Question 34.
Can we use cables around the rack? If so, will it need to be inspected beforehand?
Answer: Contractors are welcome to use it. However, the Government does not state that it has been load tested and cannot vouch for its capability to provide a suitable fall protection system. Inspections would be at the discretion of the Contractor.
Question 35.
Can a boom truck fit safely on the walking platform?
Answer: Boom trucks will not fit on the catwalk, but boom trucks should be able to fit onto the abutments.
Question 36.
When was the last time we covered the pins? Would it be with PVC pipe or some other material?
Answer: The Corps has not previously conducted painting of the interior of the drive rack.
The Contractor is to derive the means and methods of accomplishing the project.
Question 37.
For wage rate purposes, is the channel running through the Barrier considered Navigable or non- Navigable? Likewise, is this structure considered to be a bridge?
Answer: This channel is considered Navigable for wage rate purposes. It is not a bridge.
Question 38.
How many square feet of steel and how much sandblasting and painting is needed?
Answer: Contractors are to determine these quantities by examining the Plans and the Information Drawings.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator
U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
