Notification to the Contractor shall be promptly made in writing if time and circumstances permit. Otherwise, notification shall be verbal or by telephone, and shall be confirmed in writing as soon as possible. No such removal, however, will reduce the Contractor’s obligation to perform all work required under this contract, and immediate replacement will be made as required. This requirement shall not be made the basis of any claim for compensation or damages against the United States or any of its officers or agents.

In case of omission, the normal industry, state or federal standards, practices, specifications, and/or guides shall prevail. In no instance shall an omission be reason to produce less than an acceptable and functional product.

8. Quality Assurance:

The Contractor is responsible for the quality control of the contract work. The Government has the right to inspect and test all items called for by the contract, to the extent practicable at all times and at all places during the term of the contract.

Service Requirements:

All drinking water samples will be collected by a State of CT Certified Operator and sent to approved commercial laboratories certified to test drinking water by the State of CT, Department of Public Health.

1. Beach Water Quality Sampling at Hop Brook Lake:

a. Sampling & Monitoring: Beach is to be monitored weekly starting from time of award and continuing through the week after Labor Day, with additional monitoring events to be performed if samples do not meet State of CT standards for a total of up to 22 monitoring visits. During each visit, two samples will be collected for E. coli, for a total of 44 water samples. For following Option Years, beach monitoring will start one week prior to Memorial Day weekend, continuing through the week after Labor Day (approximately 17 weeks).

Samples shall be collected at fixed sampling stations, to provide consistency of data.

Samples should be collected at approximately 3 to 4 feet water depth. The 125ml bottle provided by the laboratory for surface water sampling must be used. Remove the cap from the sterile collection bottle, being careful not to contaminate either the inside of the cap or bottle. Grasp the bottle near its base and plunge it in a downward motion into the water to a depth of between 12 and 18 inches, always keeping the mouth of the container ahead of the hand so as not to contaminate the sample. In a sweeping motion invert the bottle to fill. Empty the bottle to approximately one inch from the top (if necessary) to provide air space for laboratory processing and carefully replace the cover. Store the samples on ice for transport to the laboratory.

b. Laboratory Analysis: The contractor will ensure the laboratory is using analytical methods approved by the State of CT.

i. The method of testing shall be as follows: E. coli organism, as determined by the Colilert -18 Method or any State of Connecticut/EPA approved method such as the membrane filter techniques, modified EPA Method 1603 (Modified mTEC Medium) and EPA Method 1103.1 (mTEC medium).

ii. A concentration of E. coli organisms less than or equal to 235 per 100 ml is generally considered satisfactory for a single sample from a swimming area.

iii. A single sample with a concentration of E. coli organisms greater than 235 per

100 ml is in excess of that which is normally considered acceptable for swimming. A re-sample will be required.

iv. To determine swimming water quality when using the E. coli organism as an indicator, a running geometric mean for each sampling station is to be used.

An acceptable running geometric mean for E. coli indicator organism density for swimming waters is less than or equal to 126. A running geometric mean is to be used when evaluating the long-term microbiological suitability of recreation water quality. The geometric mean can provide a better indication of water quality over time. This holds especially true when evaluating a proposed swimming area where seasonal or incidental variations may impact on single sample results. The contractor should keep all testing records and records of calculations for geometric means.

c. Reporting: Sample results for beach water testing shall be reported no later than noon the day after the samples are collected. The results will be submitted electronically to the Technical Point of Contact, the Project Manager, the Operations Manager and the City of Waterbury Health Department. The contractor shall advice all parties of the results of testing by noon the following day. The contractor shall also advise the CT Department of Public Health at (860)509-7296, when the beach and/or swimming area will be closed due to test results and also subsequently upon re-opening when the tests show acceptable levels.

2. Drinking Water Quality Testing:

System operations and testing to be managed/performed by a certified water system operator according to Connecticut Department of Public Health, drinking water section, water quality monitoring schedules and regulations:

i. Thomaston Dam Vista (PWS ID:CT1400184),

iv. Perform repeat sampling and additional investigatory sampling as needed/required.

v. An approved Total coliform enumeration method capable of simultaneously detecting Total Coliforms and Escherichia coli is required. (Pass/fail methods are unacceptable). Method SM9223B is preferred because it is not subject to interference of heterotrophic bacteria.

vi. Microbiology samples may not be sub-contracted to another laboratory.

vii. Report violations to the CT Department of Public Health and issue public notices when necessary, within state specified timeframes. Provide copies to the Technical Point of Contact.

viii. Perform Level 1 and Level 2 Water system assessments required by CT Department of Public Health following violations. Submit assessment certificates to CT within prescribed time limits set by CT Department of Public Health. Provide a copy to the Technical Point of Contact.

ix. Ensure timely data reporting by the certified laboratory to the CT Department of Public Health.

x. Compliance results must be reported to the state within 10 days of collection, or sooner if necessary to meet time limits set by the state of Connecticut.

c. System Descriptions and Operating Season:

i. Thomaston Dam Vista (PWS ID:CT1400184) has two sources. An inactive source located at the picnic area is above grade. The active source is located sub-grade in a locked vault, adjacent to the project office. Both sources are to be inspected monthly during the recreation season (mid-April through Columbus Day weekend). This system is only partially drained/ depressurized in the off-season, as it serves the project office year-round as a private water system. This recreation area is not subject to flooding.

ii. Northfield Brook Lake Recreation Area has two seasonal systems. The park opens by mid-April and closes after Columbus Day. The recreation area is subject to flooding and the gates are closed/locked during flood control operations. The elevation of both wells is below the dam crest (the lower at approximately 550ft and the upper at approximately 562ft).

a. Upper CS (PWS ID:CT1400234) This system has one source with the well head above ground. At a pool height of 75 feet, the water supply system is threatened. The system supplies the composting toilet unit housed in the basement of the comfort station. Treatment on this system consists of an in-line carbon filter. Inundation of this area is unusual.

b. Lower CS (PWS ID: CT1400124) The lower system’s lowest leg is subject to inundation at flood control pool levels of 29 feet. The source is subject to inundation at pool elevations of approximately 65 feet or more. The source is sometimes overflowing with an above ground well head.

iii. Hop Brook Lake Recreation Area has two seasonal systems. The recreation area opens in mid-May and closes after Labor Day. The recreation area is subject to flooding and the gates are closed/locked during flood control operations. 52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation.
