II. Technical Requirements:

1. General:

Existing Conditions:

Buffumville Lake consists of the Buffumville Dam and associated dike and weir. The only surface water body includes Buffumville Lake, approximately 200 acres. During normal flow periods, water flows from the Little River at the north and South Fork River at the south end into Buffumville Lake. Water continues from the lake out the dam and converges with the French River, 1.3 miles downstream in Oxford, Massachusetts. During floods, flows held back by Buffumville Dam flood both government and easement lands around the lake.

Flows are released as soon as possible.

Buffumville Lake Park and boat ramp are both heavily used recreation areas. Buffumville Park has a swimming beach, picnic area and two shelters that are open for the summer season on May 21, 2016. Treatment of Buffumville Park includes areas surrounding the swimming beach.

Heavy infestation of variable milfoil, fanwort, and traces of Eurasian milfoil occurs throughout the entire lake. Emphasis for control will focus on areas in the north section of the lake located in and around the Buffumville Lake Park swimming beach (area 1 on attached map 8 acres) and the 4-8ft water depth zone around the north end of the lake (area 3 on attached map 14.8 acres). The third area of concern is located in the 4-8ft zone around the boat ramp on the south section of the lake (area 2 on the attached map 2 acres). See the attached map for more details. The lake has not been treated with chemicals and each year there is more infestation. During the winter of 2014-2015 and 2015-2016 the lake was drawn down to expose the root systems to the cold temperatures. The drawdown appears to have been successful at slowing down the weed growth rate.

Abutters:

The Corps owns all of the surrounding land in fee. A public drinking water well is present near the Buffumville Park work area. The well supplies water for the park attendants, who camp at the park May through September, and also supplies water to the restrooms and water fountain down in the beach area for the general public. The well is approximately 530 feet from the nearest treatment area. Another drinking water well is located at the Buffumville Dam and Office site which supplies water for the Ranger Station and public restrooms. The well is over 1,000 feet from the nearest treatment area. There are private drinking water wells on abutting land of the US Army Corps of Engineers property. The US Army Corps of Engineers will provide the successful bidder with a map showing public well locations to include information pertaining to well type, depth and specific use.

Requests for Information:

Requests concerning the work of this project should be directed to the Technical Point of Contact at 978-318-8426, 508-341-1641 or timothy.g.russell@usace.army.mil.

Submittals:

Although the Government technically reviews submissions required by this scope of work, it is emphasized that the contractor’s work must be prosecuted using proper internal controls and review procedures. The documents identified below must be prepared in accordance with the applicable standards, submitted for review and accepted by the government prior to final payment of the contract:

Safety data sheets, material data sheets for chemicals applied.

Activity Hazard Analysis to include both spraying and boating activities. Given the relatively high risk of waterborne activities, the contractor will be required to submit an activity hazard analysis that must be accepted by the government prior to the commencement of any work on the lake.

Accident Prevention Plan must be submitted to the POC before field work can commence.

Report – A brief letter report discussing the efficacy of treatment measures and recommendations for future monitoring and control. A map that shows the actual GPS track of treatment boats relative to the treatment area. This document may be e-mailed to the technical point of contact in PDF format.

Data Files – GIS shape file that shows the actual passes or spray zones of the treatment boats as recorded by a GPS system.

State Applicator’s License – The contractor will be required to submit verification that their license as a Commonwealth of Massachusetts Authorized Application is current and in good standing.

Clean Up:

The contractor shall practice good housekeeping to maintain a safe job site. The contractor shall keep the work area, including any storage areas, free from the accumulation of waste materials. Upon completing work in an area the contractor shall remove any tools, equipment, and materials that are not the property of the government. Upon completion of work, the contractor shall clean up the job site to the satisfaction of the Government.

Government Resources:

The contractor is responsible for providing all materials to complete the project. Unless specified in the contract, the Government will not provide any equipment, telephone services or other resources.

Omissions:

This contract may not cover all specified activities, steps, and procedures required to supply the contract product. In case of omission, the normal industry, state, or federal standards, practices, specifications, and/or guides shall prevail. In no instance shall an omission be reason to produce less than an acceptable product.

Quality Assurance:

The contractor is responsible for the quality control of the contract work. The government has the right to inspect and test all items called for by the contract, to the extent practicable at all times and at all places during the term of the contract.

Other Contracts:

The Government may undertake or award other contracts for additional work not related to this contract. The contractor shall fully cooperate with other contractors and Government employees. The contractor shall not commit or permit any act which will interfere with the performance of work by another contractor, or by Government employees.

Receiving and Storing Materials:

The contractor is responsible for protecting any stored material until it is placed in service.

The contractor is responsible for receiving and unloading of delivered goods. Government employees will not receive material or supplies for the contractor and will not be responsible for damage to contractor equipment or material.

2. Products:

Systemic aquatic herbicide requirements:

Fluridone is the preferred herbicide to treat Eurasian milfoil and fanwort. If treated early spring, Fluridone could be effective on variable milfoil.

Diquat dibromide may also be necessary to treat variable milfoil if Fluridone is not applied in early spring.

3. Execution:

Access:

Boat access to the work areas is provided by the boat ramp at 230 Oxford Rd. This area can be accessed from Interstate 395, Exit 4B towards Oxford Center.

Task 1 - Permit Application:

The U.S. Army Corps of Engineers Buffumville Lake is not a candidate to file a Notification of Intent with the Commonwealth of Massachusetts. However, the contractor shall be responsible for obtaining any state approval required concerning rare and protected species as identified by the National Heritage and Endangered Species Program.

Task 2 – Herbicide Treatment:

Prior to any treatment, the contractor is responsible for creating and posting signs adjacent to treatment areas and making the required notifications.

The contractor shall apply an appropriate systemic aquatic herbicide to all treatment areas as shown on the attached map. Herbicide application rates shall follow manufactures’ recommendations and accepted industry practice and be adequate to provide effective control within the target area.

A GPS system with at least 3 to 5 meter accuracy shall be used during the treatment to insure even application of the herbicide. Should the presence of stumps inhibit or limit access to the full treatment area by a larger air boat, the contractor must also be equipped with: A) hoses to be able to spray the herbicide into zones targeted for treatment, and/ or B) smaller boats to use to gain access to the full range of the indicated treatment areas.

The treatment is proposed for May and June, weather permitting. The treatment date will be determined based on the specifications of the approved permits obtained by the contractor. The treatment must be completed on consecutive days.

The Corps will be responsible for closing Buffumville Lake Park on the treatment days.

Task 3 – Report and Submittal Preparation:

The contractor shall provide the technical point of contact a brief letter report as described in the “Submittals” section listed above.

CLAUSES INCORPORATED BY FULL TEXT

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified.
