Justification and Approval for Other Than Full and Open Competition
Architectural Engineering Services for CY ROKFC In-Kind, HAS Phase 1, 2 and 3 Kunsan
Airbase Korea
AMKOR A&E Inc
1. Contracting Activity: Contracting Division, US Army Corps of Engineers (USACE), Far East District (FED).
2. Description of Action: Approval is requested for non-competitive Architect Engineer
Services purchase order.
3. Description of Services: The AE’s services include fire protection engineering, electrical engineering and other services and tasks including BIM, interior design, energy modeling, landscape design, LEED support and rendering. The AE’s services supplements, and is coordinated to, that of the Far East District’s in-house design team which is performing the work of all other design disciplines.
The Architect-Engineer (A-E) shall perform all work necessary for the design and preparation of documents for the construction of those items identified in the project description. The work in general consists of field investigations, conducting all required studies/reports, attending meetings/conferences, for BIM support, preparation of Landscape Design, Architectural Renderings, Comprehensive Interior Design (CID), LEED Documentation online, LEED Design Notebook, Energy Modeling, and related pre-final, back check, and contract documents, and other A-E services described hereunder. The estimated price for the work is $30,000
4. Authority Cited: 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(iii), Only one responsible source and no other supplies or services will satisfy agency requirements, it is likely that award to any other source would result in substantial duplication of cost to the Government that would not be recovered through competition and would result in unacceptable delays in fulfilling the Government’s requirements.
5. Reason for Authority Cited:
a. Use of competitive (i.e., Brooks Act – FAR 36.6) procedures for the desired AE design services for this modification will not result in any cost savings to the Government, and will likely cost it more in terms of money and time.
b. Task order W912UM-13-D-0003-0030 was awarded 30 July 2015 to AMKOR A&E INC for the design of Calendar Year (CY) 2015 Republic of Korea Funded Construction (ROKFC) In-Kind Combine Design Packages for Hardened Aircraft Shelters Phase 1, 2, and 3 at Kunsan Airbase, Korea. The construction of this design has begun, however, due to political protests that occurred during construction on 1 April 2019 from locals concerning the location of the currently designed drainage line "N". Current drainage system connects to off-base irrigation of local farmland. Construction of overflow drainage ceased immediately following the protest by direction of ROK Government officials. Immediate re-design is required in order to maintain project progress towards its scheduled completion of May 2020. Failure to perform the re-design will result in delay of project completion, resulting in additional costs to the Government for contractor's overhead, as well as impact to the using agency's occupancy plan for these 20 new aircraft shelters.
c. Because AMKOR A&E has already performed the majority of the services related to the design, using that architect engineer contractor’s services for the design of this project will avoid duplication in cost, amounting to an estimated $57,994 which was the total of the previous design. If we were to compete this requirement to a different firm, the Government would require the incoming A-E firm to assume responsibility for the entire design due to the additional requirement of contractor sequencing.
d. Selection of another AE for this modification would increase FED’s costs of obtaining the desired design services, since other AE firms would need to perform greater effort to evaluate and validate the existing AMKOR design and prepare their input towards the design of this modification. Moreover, selecting another AE would result in a scenario with 2 different designers of record for inter-related projects. Using competitive selection procedures would be unacceptable because such a selection would take an estimated 4 months just to advertise, negotiate and award. By comparison, negotiation and execution of the work under the projected purchase order is expected to take 1.5 months, which results in an estimated savings in 2.5 months in construction.
e. The estimated cost for these new tasks, plus validation of the original design and for another A-E to take full responsibility for the entire design would be $78,000. Therefore the comparison is $30,000 (current AE) to $75,270 (new AE) means $48,000 savings.
6. Efforts to Obtain Competition:
a. Effective competition is not anticipated for this acquisition. For the reasons stated in Paragraph 5 above it would be impractical to solicit work from A-E’s other than AMKOR.
b. Subcontracting competition. FED will advise AMKOR to place any work it needs to subcontract in accordance with the competitive procedures of the Brooks Ace and FAR 36.6
7. Actions to Increase Competition: In the future, FED will endeavor to use competitive (i.e., Brooks Act – FAR 36.6) selection procedures, in accordance with Engineer Pamphlet 715-1-7, whenever placing requirements against its IDIQ A-E services contracts or making public announcements for A-E services. FED will try to avoid situations in which designs for virtually identical projects are undertaken simultaneously or near simultaneously, by its in-house design forces and its A-E contractors.
8. Market Research: FED conducted market research by reviewing existing acquisitions among its existing IDIQ A-E services contractors to determine which contractor would best be able to provide the design services needed by the FED Engineering Division, Design Branch. FED’s market research concluded that AMKOR was the best qualified A-E contractor to provide the required services, given that it had recently produced a virtually identical design to the one being prepared by the FED Engineering Division, Design Branch for the project.
9. Interested Sources: To date, no other sources have written to express an interest. The notices required by FAR 5.201 were published on 17 June 2019, no proposals received.
