PERFORMANCE WORK STATEMENT
For
INSTALLATION OF A VARIABLE FREQUENCY DRIVE (VFD)
AT BUILDING 3255 (WWTP) KITTREDGE ROAD
PROJECT NO.: SPBN 182014

Performance Work Statement Otis Air National Guard Base Installation of VFD at Building 3255 (WWTP)
1.0 GENERAL:
1.1 Scope: Services non-personal. The contractor shall provide all personnel, equipment, tools, materials, supervision, and quality control necessary to install a variable frequency drive at Building 3255 Kittredge Road at the Otis Air National Guard Base (ANGB) Waste Water Treatment Plant (WWTP).
Except as specified in Paragraph 3.0 titled Government Furnished Property, Material, Equipment and Services. The contractor shall perform to the standards of this contract.
1.2 PERIOD OF PERFORMANCE (POP). The POP shall commence no later than ten (10) business days after contract award. The performance period for the award shall be sixty (60) calendar days.
1.3 GENERAL INFORMATION:
1.3.1 Place and Performance of Services. Performance shall be at the 102IW, Building 3255 Kittredge Road at the Otis ANGB WWTP. Normal Hours of Operation for performance is Eastern Standard Time (EST) of 0700 (7:00 a.m.) and 1600 (4:00 p.m.) during the period of performance, except on recognized United States (US) holidays or when the Government facility/installation is closed due to local or national emergencies, administrative closings, or similar Government-directed facility/installation closings. The contractor shall at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS when the Government facility/installation is not closed for the above reasons. When hiring personnel, the contractor shall keep in mind that the stability and continuity of the work force are essential.
1.3.2 Recognized Holidays. The following are recognized US holidays. The contractor shall not perform services on these days:

1.3.2.3 President’s Day: Third Monday in February
1.3.2.4 Memorial Day: Last Monday in May

1.3.2.7 Columbus Day: First Monday in October
1.3.2.8 Veteran’s Day: 11 November
1.3.2.9 Thanksgiving Day: Third Thursday in November
1.3.2.10 Christmas Day: 25 December
1.3.3 Quality Assurance (QA). The Government will evaluate the contractor’s performance under this contract in accordance with a Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level
1.3.4 Contract Manager (CM). The contactor shall provide a CM who shall ensure performance under this contract. The name of this person, and an alternate who shall act for the contractor when the CM is absent, shall be designated in writing to the Contracting Officer (KO). The CM or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.
1.3.5 Security Requirements. Security Clearances are not required. The Government reserves the right to deny access at any time, for any reason.
1.3.5.1 Contractor and all associated sub-contractor’s employees shall provide all information required for background checks to meet installation access requirements to be accomplished by 102 Security Forces Pass and Identification (ID) Office. Contractor workforce shall comply with all personal identity verification requirements as directed by DOD, United States Air Force (USAF), and local policy. Should the Force Protection Condition (FPCON) change, the Government may require changes in contractor security matters or processes.
1.3.5.2 Entrance to JBCC and specifically the 102IW are controlled and security is strictly monitored. In accordance with the 102IW Policy for Contractor Access, the Contractor shall complete a unit developed “Contractor Matrix”, “Day Pass Request Form” or “102IW Request for Identification Application” in order to obtain access. Submissions of these documents are required prior to the pre-performance conference or 10 calendar days prior to start of work. Any additions or changes shall be submitted to the technical representative no less than 3 weekdays prior to required period of performance to allow timely processing. Access credentials will only be issued following an approved identification process to include vetting against authoritative government databases from the 102IW Security Forces Pass and ID Office. The Contractor is cautioned that these requirements shall be strictly enforced and any delays and/or costs associated with not adhering to these requirements shall be at the Contractor’s own expense.
1.3.5.3 The Contractor will coordinate with the technical representative on all security issues and to gain access to the base and all areas necessary to execute this service.
1.3.5.4 The Contractor shall ensure that all employees, suppliers, and subcontractors and their employees comply with established security procedures for entering the installation and its facilities, including special security procedures for entry to restricted or controlled areas, if applicable.
1.3.5.5 All prospective contractors MUST be U.S. citizens or MUST have established and maintain legal residence in the U.S., and be authorized by the US government to work in the United States (i.e. Green card, worker authorization, etc.). All prospective contractors MUST have at least one form of US government issued photo identification (driver’s license, US passport, US work visa, etc.) for entry to the installation. Security Forces will review any questionable identification documents for determination as to whether or not said identification is authorized for access to the installation.
1.3.5.6 All personnel, the vehicles and property under their control are subject to search upon entering or exiting the installation, or at any point while on the installation. Any vehicles or personnel found in possession of prohibited items will be removed, and/or barred, from the installation and released to the appropriate civil authorities.
1.3.5.7 The Government will not be held liable for any delays or breach of contract caused by refusal of the Security Forces to allow entry.
1.3.5.8 All contractors and their subcontractors who are issued passes to gain access for the 102 IW return all local access credentials to the technical representative when the contract is completed or when a contractor employee no longer requires access to the installation (e.g., quits or the contract is terminated).
Failure to do so will initiate immediate notification to Security Forces for an appropriate update in Defense Biometric Identification System (DBIDS) when a contractor refuses to return issued access media. If a local access credential is not returned, the Installation Commander may consider debarment.
1.3.6 Physical Security. The contractor shall safeguard all Government property provided for contractor use. At the close of each work period, Government facilities, equipment and materials shall be secured. The contractor shall ensure that all parts of the facility where work is being performed are adequately protected against vandalism and theft.
1.3.7 Areas controlled by Contractor employees shall comply with installation operations plans/instructions for Force Protection Condition procedures, Random Antiterrorism Measures (RAMS) and local search /identification requirements. The Contractor shall be responsible for safeguarding all Government property provided for Contractor use. At the end of each work shift, all Government facilities, equipment, and materials shall be secured.
1.3.8 Anti-Terrorism (AT) Level 1 Awareness Training. All contractor employees, to include subcontractor employees, requiring access to National Guard Installations, facilities, and controlled access areas shall complete AT Level 1 awareness training no later than 30 calendar days after contract start date and no later than 30 calendar days of new employees commencing performance. AT level 1 awareness training can be completed at the following website: http://jko.jten.mil/courses/atl1/launch.html or by locally approved training provided by the installation. The contractor shall submit certificates if completed through the website or by submitting roster with employee signature validating completion.
1.3.9 Photography and recording is not allowed except for official use and approved in advance. All photographs will be reviewed by the Special Security Officer to ensure sensitive and/or classified information is not revealed.
1.3.10 The Contractor shall not post to company websites, publications, newsletters or other media any images, data or information that reveal sensitive government operations, personnel, equipment, and/or classified or controlled unclassified information. When in doubt, company press releases elated to this contract should be coordinated through the technical representative.
1.3.11 Special Qualifications:
1.3.11.1 Contractor shall be factory trained and certified to install VFD Drives.
1.3.11.2 The Contractor shall be licensed by the State of Massachusetts board of Electricians.
1.3.11.3 All work shall be completed in accordance with all applicable Local, State and Federal codes and regulations including but not limited to the latest edition of the National Electrical Code (NEC), Massachusetts Electrical Code, National Electrical Safety Code (NESC) and the National Electrical Contractors Association (NECA), American Society of Mechanical Engineers (ASME), American National Standards Institute (ANSI) and American Society for Testing and Materials (ASTM) ) and MMR Fire and Emergency Services, Fire Prevention Standard 911-1.
1.3.12 COMMON REQUIREMENTS FOR ELECTRICAL INSTALLATION:
1.3.12.1 Comply with NECA 1.
1.3.12.2 Measure indicated mounting heights to bottom of unit for suspended items and to center of unit for wall-mounting items.

1.3.12.3 Headroom Maintenance: If mounting heights or other location criteria are not indicated, arrange and install VFD components and equipment to provide maximum possible headroom consistent with these requirements.
1.3.12.4 Equipment: Install to facilitate service, maintenance, and repair or replacement of components of both electrical equipment and other nearby installations. Connect in such a way as to facilitate future disconnecting with minimum interference with other items in the vicinity.
1.3.12.5 Right of Way: Give to piping systems installed at a required slope.
1.3.12.6 The variable frequency drive units shall be wall-mounted or securely mounted to uni-strut components that will allow easy access of positioning gantry device for motor/pump removal from concrete base.
1.3.13 Identification of Contractor Employees: All contract personnel working in situations where their contractor status is not obvious to government or third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials.
The contractor shall ensure that all documents or reports produced by contractor personnel are suitably marked as contractor products.
1.3.14 Organizational Conflicts of Interest (OCI): The contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent OCIs, as defined in Federal Acquisition Regulation (FAR) Subpart 9.5. The contractor shall notify the KO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the KO to avoid or mitigate any such OCI. The contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO and in the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may affect other remedies as he or she deems necessary, including prohibiting the contractor from participation in subsequent contracted requirements which may be affected by the OCI.
1.3.15 Safety and Fire Protection Requirements.
1.3.15.1 Safety Requirements. The contractor shall take all necessary precautions to meet proper safety standards and regulations of all local, state and federal codes and regulations. In performing work under this contract, the contractor shall:
1.3.15.1.1 Comply with all Occupational Safety and Health Administration (OSHA) regulations and requirements shall apply to all work performed on the Installation.
1.3.15.1.2 Conform to any additional restrictions outlined by the Base Safety Officer (BSO) and the JBCC Fire Department (FD) during the course of the contract to insure the safety of their employees, government employees and the general public.
1.3.15.1.3 Conform to the safety requirements contained in the contract for all activities related to the accomplishment of the work.
1.3.15.1.4 Take such additional immediate precautions as the contracting officer may reasonably require for safety and mishap prevention purposes.
1.3.15.1.5 Provide protection to government property to prevent damage during the period of time the property is under the control or in possession of the Contractor.
1.3.15.1.6 Record and report promptly (immediately) to the contracting officer all available facts relating to each instance of damage to government property or injury to either Contractor or government personnel.
1.3.15.1.7 In the event of an accident/mishap, take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, and preserve evidence until released by the accident/mishap investigative authority through the contracting officer.
1.3.15.1.7.1 If the government elects to conduct an investigation of the accident/mishap, the contractor shall cooperate fully and assist government personnel in the conduct of investigation until the investigation is completed.
1.3.15.1.8 When entering the Installation there are requirements that shall be adhered to. They are as follows:
1.3.15.1.8.1 While on the installation, use of a cell phone while operating a vehicle or other motorized equipment is prohibited by DoD regulations unless the operator is utilizing a hands-free device.
1.3.15.1.8.2 The installation speed limit is 40 mph unless otherwise posted. Motor vehicle regulations are strictly enforced and excessive violations may result in the loss of driving privileges on the installation.
1.3.15.1.8.3 The Installation speed limit is reduced to 15 mph and strictly enforced adjacent to military troop movements (i.e., personnel, vehicle convoys, etc.) traversing installation roadways.
1.3.15.1.8.4 Failure to follow the on base requirements is grounds for removal from the installation.
1.3.15.2 Fire Prevention and Protection Plan. This section covers the responsibility of the Contractor while performing under this contract. The emergency telephone number for JBCC is 911.
1.3.15.2.1 The Contractor shall strictly adhere to the attached “Joint Base Cape Cod (JBCC) Fire Prevention Standard 911-1” (attachment 1) while performing work on any area of the JBCC.
1.3.16 Environmental Controls. This section covers the responsibility of the contractor while performing under this contract.
1.3.16.1.1 Compliance with Laws and Regulations. The contractor shall be knowledgeable of and comply with all applicable Interstate, Federal, State, and Local laws, regulations, and requirements regarding environmental protection. In the event environmental laws/regulations change during the term of this contract, the contractor is required to comply as such laws come into effect. If there is an increase or decrease in cost as a result of the change, the contractor shall inform the KO pursuant to notice requirements and negotiate a modification to the contract.
1.3.16.1.2 Conservation of Utilities. The contractor shall instruct employees in utilities conservation practices. The contractor shall operate under conditions that preclude the waste of utilities.
2.0 GOVERNMENT ROLES AND RESPONSIBILITIES:
2.1 The Contracting Officer (KO) is the only individual with the authority to authorize changes within this project that will have an effect on the scope and/or monetary value (increase or decrease) of contract.
2.1.1 All contracting actions and/or correspondence should be forwarded through the technical representative. The technical representative does not have authority to take any action, either directly or indirectly, that would change the pricing, quantity, quality, place of performance, delivery schedule, or any other term and condition of the contract, or to direct the accomplishment of effort that goes beyond the scope of the PWS in the contract. When, in the opinion of the contractor, the technical representative requests efforts outside the existing scope of the contract, the contractor shall promptly notify the KO in writing. The contractor under such direction shall take no action until the KO has resolved the issue or has otherwise issued a modification to the contract.
2.1.2 In the absence of the technical representative (due to reasons such as leave, illness, and official travel), all responsibilities and functions assigned to the technical representative shall be the responsibility of the KO until an alternate is assigned.
2.2 Government personnel other than KOs and the authorized technical representative, may, with KO coordination, observe contractor operations. However, these personnel may not interfere with Contractor performance or make any changes to the contract.
2.3 Other Observers. 102nd CE Personnel, Military Public Health (MPH) personnel, Inspector General (IG) Personnel, and other authorized government personnel shall be permitted to observe operations as necessary. These operations include but are not limited to duties at the Contractor’s facility, transportation from the Contractor’s facility to the installation and return to the Contractor’s facility.
Contractors may be requested to provide State and Municipal certificates.
3.0 GOVERNMENT FURNISHED PROPERTY, MATERIAL, EQUIPMENT AND SERVICES
(GFP/M/E/S). The Government will provide the facilities, equipment, materials, services, and/or utilities listed below:
3.1 Facilities: Building 3255 Kittredge Road at the Otis ANGB WWTP
3.2 Equipment: N/A
3.3 Materials: N/A
3.4 Services: N/A
3.5 Utilities: All electrical and water utilities at Building 3255 Kittredge Road at the Otis ANGB WWTP will be available for the contractor’s use in the performance of this contract.
3.5.1 Note that any ELECTRICAL OUTAGES required to perform the required tests on the system shall only be accomplished after receiving written approval from the Contracting Officer. If any electrical outages are necessary the field technician shall request the outage at least five (5) days in advance.
4.0 CONTRACTOR FURNISHED PROPERTY, MATERIALS, EQUIPMENT (CFP/M/E). Except for those items specifically stated to be Government-Furnished in Paragraph 3.0, the contractor shall furnish the following and any additional items necessary to perform the services required by this Performance Work Statement:
4.1 Facilities: N/A
4.2 Equipment: All required equipment to successfully install a VFD at Building 3255 Kittredge Road at the Otis ANGB WWTP.
4.3 Materials: N/A
4.4 Services: N/A
4.5 Secret Facility Clearance: Secret Facility Clearance: The contractor does not require Secret Facility Clearance, but will be required to submit a “Contractor Matrix” to the COR in accordance with paragraph.
5.0 CONTRACT PERFORMANCE REQUIREMENTS. The contractor shall:
5.1 Furnish and install three (3) variable speed drives for operation of 480V, 3 phase, 60 Hz, to 75 HP centrifugal pump motors and as further described in Attachment 1 of this PWS.
5.2 Utilize existing power wiring where available and where the existing wiring will be NEC compliant. Otherwise new wiring shall be provided. Any devices, wiring, cabling, conduit, junction boxes, unistrut, or other appurtenances that are required for a complete installation shall be provided by the Contractor.
5.3 Provide drawings in AutoCAD 2014 format that shows the installation of the new VFDs along with power wiring and the connections to the existing SCADA wiring.
5.4 The VFDs shall be controlled and operable from an existing SCADA system. Contractor shall provide all conduit, wiring and cabling between the VFDs and the SCADA system. Access to the SCADA wiring is via the motor controller cabinetry located on the first level Motor Control Center of Building 3255.
5.5 The Variable Frequency Drives shall be installed in NEMA 4X enclosures in the basement space nearby (within eight (8) feet) to each of the existing motor/pump units. Verify location of VFD’s with the Technical Representative.
5.6 Warranty and Operational and Maintenance (O&M) Manuals—Contractor must assemble any/all warranties (Contractor and Manufacturer) and Operation and Maintenance (O&M) Manuals. Contractor shall package and submit to the technical representative in the following manner:
5.6.1 Warranty and O&M Manuals shall be bound in hard backed three ring binders with an index, sub dividers and reinforced sheets.
5.6.2 Contractor shall submit the Warranty and O&M Manual Package to the technical representative within seven (7) days of project acceptance.
5.6.3 Government has fourteen (14) days to review and verify that the Warranties and Operation and
Maintenance Manuals are complete.
5.6.4 All equipment provided for this project shall comply with the following regulations and standards:
American National Standards Institute (ANSI), National Fire Protection Association (NFPA): 70 - National Electrical Code (NEC), National Electrical Manufacturers Association (NEMA): ICS 3.1
– Safety standards for service and guide for selection, installation, and operation of adjustable speed drive systems. 250 – Enclosures for Electrical Equipment. Underwriters Laboratories, Inc.
(UL): 508C - Electric Industrial Control Equipment. Adjustable frequency drives shall be manufactured by the supplier at its own facility which has a quality assurance program that is certified in conformance with ISO Standard 9001. Comply with NEMA ICS 7 &
NEMA ICS 61800-2.
5.7 The Manufacturer Representative shall provide start up service by a factory trained service technician. The service technician shall verify correct installation, operate the drive at all available speeds, and check for proper operation.
5.8 Testing: After checkout and startup of the drive by manufacturer, electrical contractor will monitor the voltage and current percent Total Harmonic Distortion (THD) at the input of the drive installed. A recording type Fluke, Multilin PQM, BMI, or equivalent harmonic analyzer displaying individual and total harmonic currents and voltages must be utilized. To ensure quality and minimize failures on the jobsite, the VFD shall be completely tested by the manufacturer. The VFD shall operate a dynamometer at full load and speed under elevated temperature conditions. All optional features shall be functionally tested at the factory for proper operation. Factory test documentation shall be available on request.
5.9 Training: After checkout and startup of the drives by manufacturer, manufacturer shall supply a four hour on-site training course for Civil Engineering Squadron (CES) Base Operations personnel on operational and maintenance procedures.
5.10 Warranty: One year on-site warranty shall be provided such that the 102nd Civil Engineering Squadron is not responsible for any warranty costs including travel, labor, parts, workmanship or other costs for a full one year from the date of start-up of the drive. Cost of this warranty shall be included in the bid. The warranty period shall commence when the variable speed drive is first placed into successful service.
5.11 Payment Requirements.
5.11.1 In accordance with FAR 52.212-1(k), prospective awardees shall have an active Cage Code prior to award of a government contract. In accordance with FAR 52.212-3, prospective awardees shall have completed the Online Representations and Certifications. To register for a Cage Code or to complete Online Representations and Certifications, go to the System for Award Management (SAM) at https://www.sam.gov/portal/public/SAM/.
5.11.2 Contractor must not be debarred, suspended, proposed for debarment, excluded or disqualified under the non-procurement common rule, or otherwise declared ineligible from receiving Federal https://www.sam.gov/portal/public/SAM/ contracts, certain subcontracts, and certain Federal assistance and benefits. The Government will not issue an award to any business identified as debarred, or otherwise disqualified as identified above.
5.11.3 Contractors interested and capable of obtaining contract award must register with the Wide Area Work Flow (WAWF) located at https://wawf.eb.mil/. Contractors are required to create and submit invoices electronically through WAWF and receive payment via electronic funds transfer (EFT) for supplies or services rendered. WAWF is a secure Web-based system for electronic invoicing, receipt and acceptance. The WAWF application enables electronic form submission of invoices, government inspection, and acceptance documents in order to support DoD’s goal of moving to a paperless acquisition process.
5.11.4 The Contractor shall submit invoice consistent with the format of the contract line items.
Contractor shall submit invoice within five (5) calendar days after the completion of each performance period.
5.11.5 The Government will review the invoice and reject or authorize payment as applicable through
WAWF.
5.11.6 The contract payment terms shall be made in accordance with established discounted terms.
Contractor is encouraged to provide additional discounts when submitting their invoice.
5.12 Contractor Manpower Reporting (CMR). The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the Contractor shall report ALL Contractor manpower (including subcontractor manpower) required for performance of this contract. The contractor shall completely fill in all the information in the format using the following web address http://www.ecmra.mil/.
5.12.1 The required information includes: (1) Contracting Office, KO, COR; (2) Contract number, including task and delivery order number; (3) Beginning and ending dates covered by reporting period;
(4) Contractor's name, address, phone number, e-mail address, identity of Contractor employee entering data; (5) Estimated direct labor hours (including sub-Contractors); (6) Estimated direct labor dollars paid this reporting period (including sub-Contractors); (7) Total payments (including sub-Contractors); (8) Predominant Federal Service Code (FSC) reflecting services provided by Contractor (and separate predominant FSC for each sub-Contractor if different); (9) Estimated data collection cost; (10) Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the Contractor with its UIC for the purposes of reporting this information); (11) Locations where Contractor and sub-Contractors perform the work (specified by zip code in the United States and nearest city, country, when in an overseas location, using standardized nomenclature provided on website); (12) Presence of deployment or contingency contract language; and (13) Number of Contractor and sub-Contractor employees deployed in theater this reporting period (by country).
5.12.2 As part of its submission, the Contractor shall provide the estimated total cost (if any) incurred to comply with this reporting requirement. Reporting period shall be the period of performance not to exceed 12 months ending 30 September of each government fiscal year and must be reported by 31 October of each calendar year.
6.0 DEFINITIONS AND ACRONYMS.

6.1 Definitions.
6.1.1 CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
6.1.2 CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
6.1.3 DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.
6.1.4 DELIVERABLE. Anything that can be physically delivered and includes non-manufactured things such as meeting minutes or reports.
6.1.5 KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS.
When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
6.1.6 PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.
6.1.7 QUALITY ASSURANCE. The Government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
6.1.8 QUALITY ASSURANCE SURVEILLANCE PLAN. An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
6.1.9 QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
6.1.10 SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privet of contract with the subcontractor.
6.1.11 WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.
6.1.12 WORK WEEK. Monday through Friday, unless specified otherwise.
