EXECUTIVE SUMMARY

This Executive Summary describes the purpose for this Request for Proposal (RFP) and contains the most salient and pertinent aspects of this solicitation. If conflict exists between this summary and the provisions of this solicitation, the provisions of this solicitation govern.

A-1. REQUEST FOR PROPOSAL. The Department of Defense (DoD) Joint Interagency Task Force South (JIATFS) Contracting Office hereby requests submission of a proposal for the performance of Down-Range Logistics (DRL) Support Services. Services shall be performed in accordance with Part 5 of the Performance Work Statement (PWS).

This RFP should not be discussed with any Government employee except the Contracting Officer, Ms. Paula Claudio, or her representative, Mr. Richard Hill.

A-2. SOLICITATION INFORMATION

A-2.1. This Request for Proposal (RFP) is issued on a competitve basis in accordance with Section 8(a) of the Small Business Act [15 USG 637(a)] and the Federal Acquisition Regulation (FAR) Part 19.8. This acquisition is for a firm-fixed price contract.

A-2.2. The Government will award a single, Firm Fixed Price (FFP) contract (with cost reimbursable Travel CLINs) which includes a 12 month base period and four (4), 12 month option periods.

A-2.2.1. For proposal preparation purposes, the expected date for initiation of contract performance is 29 Jan 2017. The base period includes a 30 day phase-in transition period which is also the first 30 days of contract performance. To facilitate the transition from one contractor to another, during the 30 day phase-in period the new contractor employees shall work along side the previous contractor's employees from Expeditionary Technology Services Inc (CAGE Code 1NB10) contract W912PX-14-C-0001. Contract W912PX-14-C-0001 concludes on 27 Feb 2017.

A-2.2.2. Award will be based on your proposal submitted to the Government. Please see ADDENDUM TO FAR 52.212-1 and ADDENDUM TO FAR 52.212-2 for proposal instructions and information on how your proposal will be evaluated.

A-2.3. This acquisition will be awarded based on evaluation of your proposal using the factors and sub-factors listed in ADDENDUM TO FAR 52.212-2 of this RFP. The functional areas to be performed under this instant contract are Part 5 of the PWS. You are instructed to address functional sections Part 5 of the PWS.

A-2.4. The Government intends to evaluate your proposal and award the contract without discussions (except clarifications as described in FAR 15.306(a)). Therefore, your initial proposal should contain your best terms from a price and technical standpoint. The Government reserves the right to conduct discussions, in writing, if the Contracting Officer later determines them to be necessary.

A-2.5. This solicitation is issued subject to the availability of current year funding (reference FAR 52.232-18 Availability of Funds). The basic contract and the contract option years exercised will be subject to the availability of funds at the time of award.

A-2.6. The solicitation includes Attachments and Technical Exhibits for the development of proposals. This information is a representation of the requirements as they are at the time of solicitation release.

A-2.7. Proposal submission shall be Firm Fixed Priced in accordance with ADDENDUM TO FAR 52.212-1 of this solicitation.

SPECIAL CONTRACT REQUIREMENTS

Special Contract Requirements

COMPLIANCE WITH CONTRACT REQUIREMENTS. The contractor shall ensure compliance with all contract requirements. An election to perform by subcontract (at any tier) or otherwise does not relieve the prime contractor of its responsibilities to ensure compliance.

PUBLIC RELEASE OF INFORMATION. Contractor personnel shall not publicly (or privately) discuss or release information, photographs, or other documents concerning any aspects of the materials or services relating to this contract without the express written approval of the Contracting Officer.

RELATIONSHIP BETWEEN GOVERNMENT, CONTRACTOR AND CONTRACTOR

PERSONNEL.

a. The Government and the Contractor understand and agree that the services to be delivered under this contract are non-personal services and that no employer-employee or master-servant relationship exists or will exist under the contract between the Government and the Contractor or between the Government and the Contractor's personnel. Further, the Contractor is not the Government's agent.

b. The Government will not exercise any supervision or control over Contractor personnel performing services under this contract. Contractor personnel shall not become an integrated part of the Government organization in connection with performance under this contract.

c. The work required under this contract does not require or authorize the Contractor or his employees to exercise personal judgment and discretion on behalf of the Government, but rather, the Contractor's employees shall act and exercise personal judgment and discretion on behalf of the Contractor.

d. Contractor personnel shall not be eligible, by virtue of performance under this contract, for payment by the Government of entitlements and benefits accorded federal employees. The entire consideration to the Contractor for performance of this contract is contained in the provisions for payment set forth in this contract.

KEY PERSONNEL. The Contractor shall designate by name and position title those key personnel which are considered to be essential to the work being performed under all contract types. Prior to replacing any of the specified individuals, the Contractor shall submit justification (including proposed substitutions) in sufficient detail to permit evaluation of the impact on the program. No replacement shall be made by the Contractor without the written consent of the Contracting Officer. The personnel listing may be amended from time to time during the course of the contract to either add or delete personnel, as appropriate upon written consent of the Contracting Officer.

PERSONNEL CERTIFICATIONS AND QUALIFICATIONS. The Contractor shall ensure that Contractor personnel assigned to perform work under this contract meet the minimum stated requirements in the PWS.

SECURITY. Security Clearance requirements are set forth in DD Form 254, Department of Defense Contract Security Classification Specification. Requests for security clearance of SECRET or higher shall be submitted to the Defense Industrial Security Clearance Office. The security clearance requests shall be submitted in accordance with DOD 5200.2-R, Department of Defense Personnel Security Program, and DOD Regulation 5220.22(D), DOD Industrial Security Program. A minimum of six months should be allowed for the DISCO to receive, process, and respond to any requests for a security clearance.

INVOICING AND PAYMENT. JIATFS Contracting Office uses the Wide Area Work Flow Receipt and Acceptance (WAWF-RA) Program. You shall have the ability to comply with implementation of Wide Are Work Flow Receipt and Acceptance (WAWF-RA) for Electronic Processing of Payment Receipt/Acceptance Documents and Payment. You must be capable of accepting electronic funds payment for this procurement. You shall invoice at the end of each month.

CONTRACTOR MANPOWER REPORTING. The Contractor shall completely fill in all the information in the format using the following web address http://www.ecmra.mil/. Contractor shall provide the estimated total cost (if any) incurred to comply with this reporting requirement.

Reporting period shall be the period of performance not to exceed 12 months ending 30 Sep of each government fiscal year and must be reported by 31 Oct of each calendar year. If contract period of performance ends prior to 30 Sep, the contractor has 30 days from end date of the contract to complete the CMR requirement.

INSURANCE REQUIREMENTS. As the contractor shall provide services in CONUS and OCONUS locations, in accordance with FAR Part 28.301 clauses 52.228-3 Workers’ Compensation Insurance (Defense Base Act) and 52.228-5 Insurance -- Work on a Government Installation, the following types of insurance are required for this contract:

Workers' Compensation (See Note) Comprehensive General Liability Insurance for Bodily Injury Comprehensive Automobile Liability

Note: Workers' Compensation shall be provided as regulated by the Division of Workers’ Compensation, issued by a Florida Department of Insurance (FDI) licensed insurer, regulated by the FDI and guaranteed by the Florida Property and Casualty Insurance Guaranty Association.

PERSONAL RECOVERY TRAINING. Requirements for Personal Recovery (PR)/Isolated Preparation Report (ISOPREP).

a. Personal Recovery (PR) requirement is for all US Nationals Deploying or deployed contractor personnel. Please note this training is currently only required for U.S. National contractor personnel deploying within this Area of Responsibility (AOR). It is important to understand that this requirement applies to all U.S. National contractor personnel who work for the prime or any of the subcontract tier levels on this procurement. This training will be required to be taken annually.

b. In accordance with DODD 2310.2 Personnel Recovery, DA Policy-AR 350.1, and HQ AMC

Policy (dated 31 March 05), Personnel Recovery Training is a mandatory pre-deployment theater entrance training and certification requirement for this contract. The Contractor is required, for all U.S. National employees, to provide instruction and assurance of certification/compliance with the following DoD, DA, and HQ AMC PR Training:

i. Personnel Recovery Training.

ii. Anti-Terrorism-Force Protection (AT/FP Level I) Training.

iii. Civilian ISOPREP Card.

c. The Contractor shall provide documentation of the PR training on a reporting basis with the

410th CSB. Notification, frequency, and point of contact information will be provided upon contract award with a company employing U.S. Nationals. The required documentation shall include: Employee Name, Social Security Number, Date of Training, work location, estimated arrival, and departure date.

MARKING PROPRIETARY INFORMATION. All records, files, reports, and data deemed proprietary by the Contractor shall be clearly marked in accordance with applicable laws, regulations, and clauses within this solicitation. The Contractor shall be required to identify specific portions of the records, files, reports, and data that it considers proprietary by circling, underscoring, highlighting, or other appropriate identifiers, as required by, or in addition to, applicable laws, regulations, or clauses in this contract. Data not properly marked will be considered non-compliant to solicitation requirements and may be rejected under inspection and acceptance clauses of this solicitation. Data delivered for any purpose is presumed to be properly marked, and as such, rejection of improperly marked data may occur at any time upon discovery by the Contracting Officer that such data has been mislabeled or improperly marked.

COMBAT TRAFFICKING IN PERSONS (CTIP). All Contractors, contractor employees, subcontractors, and their employees, shall be subject in addition to FAR Clause 52.222-50 to the requirements delineated in FAR Clause 52.222-50 Alternate 1.

52.204-21 BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS (JUN 2016)

(a) Definitions. As used in this clause--

Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public Web sites) or simple transactional information, such as necessary to process payments.

Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).

Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).

Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures.

(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:

(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).

(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.

(iii) Verify and control/limit connections to and use of external information systems.

(iv) Control information posted or processed on publicly accessible information systems.

(v) Identify information system users, processes acting on behalf of users, or devices.

(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.

(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.

(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.

(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.

(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.

(xii) Identify, report, and correct information and information system flaws in a timely manner.

(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.

(xiv) Update malicious code protection mechanisms when new releases are available.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR

EXECUTIVE ORDERS—COMMERCIAL ITEMS (DEVIATION 2013-O0019) (SEPT 2016)

(a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(b)

(1) Notwithstanding the requirements of any other clause in this contract, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (b)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days prior to contract expiration.

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days prior to the end of the period of performance; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months.

52.219-17 SECTION 8(a) AWARD (DEC 1996)

(a) By execution of a contract, the Small Business Administration (SBA) agrees to the following:

(1) To furnish the supplies or services set forth in the contract according to the specifications and the terms and conditions by subcontracting with the Offeror who has been determined an eligible concern pursuant to the provisions of section 8(a) of the Small Business Act, as amended (15 U.S.C. 637(a)).

(2) Except for novation agreements and advance payments, delegates to Joint Interagency Task Force South Contracting Office have the responsibility for administering the contract with complete authority to take any action on behalf of the Government under the terms and conditions of the contract; provided, however that the contracting agency shall give advance notice to the SBA before it issues a final notice terminating the right of the subcontractor to proceed with further performance, either in whole or in part, under the contract.

(3) That payments to be made under the contract will be made directly to the subcontractor by the contracting activity.

(4) To notify the Joint Interagency Task Force South Contracting Officer immediately upon notification by the subcontractor that the owner or owners upon whom 8(a) eligibility was based plan to relinquish ownership or control of the concern.

(5) That the subcontractor awarded a subcontract hereunder shall have the right of appeal from decisions of the cognizant Contracting Officer under the “Disputes” clause of the subcontract.

The offeror/subcontractor agrees and acknowledges that it will, for and on behalf of the SBA, fulfill and perform all of the requirements of the contract.

(c) The offeror/subcontractor agrees that it will not subcontract the performance of any of the requirements of this subcontract to any lower tier subcontractor without the prior written approval of the SBA and the cognizant Contracting Officer of the Joint Interagency Task Force South Contracting Office.

52.222-50 COMBATING TRAFFICKING IN PERSONS (MAR 2015) ALTERNATE I (MAR 2015)

(a) Definitions. As used in this clause—

“Agent” means any individual, including a director, an officer, an employee, or an independent contractor, authorized to act on behalf of the organization.

“Coercion” means—

(1) Threats of serious harm to or physical restraint against any person;

(2) Any scheme, plan, or pattern intended to cause a person to believe that failure to perform an act would result in serious harm to or physical restraint against any person; or

(3) The abuse or threatened abuse of the legal process.

“Commercial sex act” means any sex act on account of which anything of value is given to or received by any person.

“Commercially available off-the-shelf (COTS) item” means--

(1) Any item of supply (including construction material) that is—

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.

“Debt bondage” means the status or condition of a debtor arising from a pledge by the debtor of his or her personal services or of those of a person under his or her control as a security for debt, if the value of those services as reasonably assessed is not applied toward the liquidation of the debt or the length and nature of those services are not respectively limited and defined.

“Employee” means an employee of the Contractor directly engaged in the performance of work under the contract who has other than a minimal impact or involvement in contract performance.

“Forced labor” means knowingly providing or obtaining the labor or services of a person—

(1) By threats of serious harm to, or physical restraint against, that person or another person;

(2) By means of any scheme, plan, or pattern intended to cause the person to believe that, if the person did not perform such labor or services, that person or another person would suffer serious harm or physical restraint; or

(3) By means of the abuse or threatened abuse of law or the legal process.

“Involuntary servitude” includes a condition of servitude induced by means of—

(1) Any scheme, plan, or pattern intended to cause a person to believe that, if the person did not enter into or continue in such conditions, that person or another person would suffer serious harm or physical restraint; or

(2) The abuse or threatened abuse of the legal process.

“Severe forms of trafficking in persons” means—

(1) Sex trafficking in which a commercial sex act is induced by force, fraud, or coercion, or in which the person induced to perform such act has not attained 18 years of age; or

(2) The recruitment, harboring, transportation, provision, or obtaining of a person for labor or services, through the use of force, fraud, or coercion for the purpose of subjection to involuntary servitude, peonage, debt bondage, or slavery.

“Sex trafficking” means the recruitment, harboring, transportation, provision, or obtaining of a person for the purpose of a commercial sex act.

“Subcontract” means any contract entered into by a subcontractor to furnish supplies or services for performance of a prime contract or a subcontract.

“Subcontractor” means any supplier, distributor, vendor, or firm that furnishes supplies or services to or for a prime contractor or another subcontractor.

“United States” means the 50 States, the District of Columbia, and outlying areas.

(b) Policy. The United States Government has adopted a policy prohibiting trafficking in persons including the trafficking-related activities of this clause. Contractors, contractor employees, and their agents shall not—

(1) Engage in severe forms of trafficking in persons during the period of performance of the contract;

(2) Procure commercial sex acts during the period of performance of the contract;

(3) Use forced labor in the performance of the contract;

(4) Destroy, conceal, confiscate, or otherwise deny access by an employee to the employee's identity or immigration documents, such as passports or drivers' licenses, regardless of issuing authority;

(5)(i) Use misleading or fraudulent practices during the recruitment of employees or offering of employment, such as failing to disclose, in a format and language accessible to the worker, basic information or making material misrepresentations during the recruitment of employees regarding the key terms and conditions of employment, including wages and fringe benefits, the location of work, the living conditions, housing and associated costs (if employer or agent provided or arranged), any significant cost to be charged to the employee, and, if applicable, the hazardous nature of the work;

(ii) Use recruiters that do not comply with local labor laws of the country in which the recruiting takes place;

(6) Charge employees recruitment fees;

(7)(i) Fail to provide return transportation or pay for the cost of return transportation upon the end of employment--

(A) For an employee who is not a national of the country in which the work is taking place and who was brought into that country for the purpose of working on a U.S. Government contract or subcontract (for portions of contracts performed outside the United States); or

(B) For an employee who is not a United States national and who was brought into the United States for the purpose of working on a U.S. Government contract or subcontract, if the payment of such costs is required under existing temporary worker programs or pursuant to a written agreement with the employee (for portions of contracts performed inside the United States); except that--

(ii) The requirements of paragraphs (b)(7)(i) of this clause shall not apply to an employee who is--

(A) Legally permitted to remain in the country of employment and who chooses to do so; or

(B) Exempted by an authorized official of the contracting agency from the requirement to provide return transportation or pay for the cost of return transportation;

(iii) The requirements of paragraph (b)(7)(i) of this clause are modified for a victim of trafficking in persons who is seeking victim services or legal redress in the country of employment, or for a witness in an enforcement action related to trafficking in persons. The contractor shall provide the return transportation or pay the cost of return transportation in a way that does not obstruct the victim services, legal redress, or witness activity. For example, the contractor shall not only offer return transportation to a witness at a time when the witness is still needed to testify.

This paragraph does not apply when the exemptions at paragraph (b)(7)(ii) of this clause apply.

(8) Provide or arrange housing that fails to meet the host country housing and safety standards; or

(9) If required by law or contract, fail to provide an employment contract, recruitment agreement, or other required work document in writing. Such written work document shall be in a language the employee understands.
