The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

52.215-1 INSTRUCTIONS TO OFFERORS--COMPETITIVE ACQUISITION (NOV 2021)
(a) Definitions. As used in this provision--
“Discussions” are negotiations that occur after establishment of the competitive range that may, at the Contracting Officer's discretion, result in the offeror being allowed to revise its proposal.
“In writing or written” means any worded or numbered expression that can be read, reproduced, and later communicated, and includes electronically transmitted and stored information.
“Proposal modification” is a change made to a proposal before the solicitation's closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.
“Proposal revision” is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.
“Time”, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.
(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).
(c) Submission, modification, revision, and withdrawal of proposals. (1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror.
Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.
(2) The first page of the proposal must show--
(i) The solicitation number;
(ii) The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);
(iii) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;
(iv) Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror's behalf with the Government in connection with this solicitation; and
(v) Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent's authority, unless that evidence has been previously furnished to the issuing office.
(3) Submission, modification, revision, and withdrawal of proposals.
(i) Offerors are responsible for submitting proposals, and any modifications, or revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.
Page 13c of 111
(ii)(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or
(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(3) It is the only proposal received.
(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.
(4) Unless otherwise specified in the solicitation, the offeror may propose to provide any item or combination of items.
(5) Offerors shall submit proposals in response to this solicitation in English, unless otherwise permitted by the solicitation, and in U.S. dollars, unless the provision at FAR 52.225-17, Evaluation of Foreign Currency Offers, is included in the solicitation.
(6) Offerors may submit modifications to their proposals at any time before the solicitation closing date and time, and may submit modifications in response to an amendment, or to correct a mistake at any time before award.
(7) Offerors may submit revised proposals only if requested or allowed by the Contracting Officer.
(8) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.
(d) Offer expiration date. Proposals in response to this solicitation will be valid for the number of days specified on the solicitation cover sheet (unless a different period is proposed by the offeror).
(e) Restriction on disclosure and use of data. Offerors that include in their proposals data that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall--
(1) Mark the title page with the following legend: This proposal includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed--in whole or in part--for any purpose other than to
Page 13d of 111 evaluate this proposal. If, however, a contract is awarded to this offeror as a result of--or in connection with-- the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government's right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]; and
(2) Mark each sheet of data it wishes to restrict with the following legend: Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal.
(f) Contract award.
(1) The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and subfactors in the solicitation.
(2) The Government may reject any or all proposals if such action is in the Government's interest.
(3) The Government may waive informalities and minor irregularities in proposals received.
(4) The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
(5) The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the offeror specifies otherwise in the proposal.
(6) The Government reserves the right to make multiple awards if, after considering the additional administrative costs, it is in the Government's best interest to do so.
(7) Exchanges with offerors after receipt of a proposal do not constitute a rejection or counteroffer by the Government.
(8) The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
(9) If a cost realism analysis is performed, cost realism may be considered by the source selection authority in evaluating performance or schedule risk.
(10) A written award or acceptance of proposal mailed or otherwise furnished to the successful offeror within the time specified in the proposal shall result in a binding contract without further action by either party.
(11) If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(i) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.
(ii) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
Page 13e of 111
(iii) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(iv) A summary of the rationale for award.
(v) For acquisitions of commercial products, the make and model of the product to be delivered by the successful offeror.
(vi) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

PROPOSAL SUBMISSION REQUIREMENTS, EVALUATION CRITERIA, AND
BASIS FOR AWARD: TWO PHASE
1.0 PHASE ONE GENERAL REQUIREMENTS
1.1 The intent of this Request for Proposal (RFP) is to solicit proposals for the new Building 760 Renovate Fiber Laser Integration, Test & Experimentation Laboratory (FLITE) at Kirtland Air Force Base, Bernalillo County, New Mexico. This is a competitive acquisition for the single award of a Firm Fixed Price contract. Competition is set-aside for competition among SBA certified 8(a) disadvantaged businesses. Award will be made using a Two-Phase Best Value Tradeoff source selection process to select the best overall proposal that is determined to be the most beneficial to the Government.
1.2 Only those offerors that are determined to be most highly qualified in Phase One will be asked to submit their design related information for Phase Two. The Government reserves the right to award a contract without discussions IAW FAR 52.215-1. Award will be made in Phase Two of the source selection process from among the short-list of offerors selected from Phase One. No more than five (5) offerors will be selected for Phase Two. However, the Contracting Officer has the discretion of adjusting that number. The Contracting Officer may make the determination at the conclusion of Phase One of the source selection process that fewer than five (5) offerors are to be selected for Phase II. The award will be to the responsible offeror whose proposal the Source Selection Authority (SSA) determines conforms to the solicitation, is fair and reasonable and offers the best overall (i.e. best value) proposal, with appropriate consideration given to the evaluation factors. To be considered to compete in Phase Two, a rating of no less than “Acceptable” and “Satisfactory Confidence” (or “Neutral Confidence”) must be achieved for the Phase One proposal. Proposals receiving a deficiency will not be considered for Phase Two. To qualify for Phase Two, the offeror’s design entity is required to have professional architects and engineers, registered in the appropriate technical disciplines and must meet the requirements specified in Section 01 10 10 of the solicitation. All design must be under the direct supervision of appropriately licensed professionals for each discipline involved.
Evaluation methodology for the Phase One process consists of three (3) factors: Past Performance, Key Personnel, and Management Approach.
1.3 This is Phase One of a Two-Phase RFP. This RFP is requesting submission of proposals under Phase One Submission criteria ONLY. After evaluating Phase One proposals, the SSA with select the most highly qualified offerors and request that only those offerors submit Phase Two proposals. Offerors shall not submit any proposals under Phase Two submission criteria at this time. Submitting any information under Phase Two criteria may lead to disqualification of your proposal.
1.4 The proposal shall describe the capability of the offeror to perform the requirements of the solicitation. The proposal should be specific and complete in every detail, and should be prepared simply and economically, providing a straightforward and concise description of capabilities to satisfactorily perform the requirements. The proposal should be practical, legible, clear, and coherent.
1.5 In order to effectively and equitably evaluate all proposals, the Contracting Officer must receive information containing sufficient detail to allow review and evaluation by the Government. Proposal clarity, organization, and cross-referencing are mandatory.
Failure to submit an organized proposal as requested may adversely affect an offeror’s evaluation.
1.6 NOTE: PHASE ONE DOES NOT INCLUDE SUBMISSION OF A COST/PRICE
PROPOSAL. ONLY THOSE OFFERORS SELECTED TO MOVE ON TO PHASE TWO
WILL BE REQUIRED TO SUBMIT A COST/PRICE PROPOSAL.
2.0 PHASE ONE FACTORS TO BE EVALUATED
2.1 The following are the Phase One evaluation factors appliable to this requirement:
FACTOR 1 – Past Performance FACTOR 2 – Key Personnel FACTOR 3 – Management Approach
2.1.1 Phase One will be evaluated on Phase One Factors 1 through 3 identified above to determine the most highly qualified firms to submit Phase Two proposals. Technical Factors 1-3 are listed in table 3.3, in descending order of importance.
2.2 PHASE TWO FACTORS –
2.2.1 This is provided for informational purposes only.
2.2.1.1 In accordance with FAR 36.303-1(a)(3), the following are the Phase Two evaluation factors. Offerors shall not submit any proposals under Phase Two submission criteria at this time.
FACTOR 1 – DESIGN TECHNICAL APPROACH
FACTOR 2 – CONSTRUCTION TECHNICAL APPROACH
FACTOR 3 – PROPOSED CONTRACT DURATION AND SCHEDULE
FACTOR 4 – PRICE
2.2.1.2 Phase II will be evaluated on Phase II Factors 1 through 4. Factors 1 and 2 are of equal importance. Factor 3 is the least important factor. Factor 4 is of equal importance to Factors 1, 2, and 3, when combined.
3.0 PROPOSAL SUBMISSION REQUIREMENTS
3.1 Each volume shall be submitted electronically. There are two electronic options: via email or using the DoD SAFE (formerly AMRDEC SAFE) if proposals are too large to send via email. When using SAFE, Offerors are required to request a drop off code from the Contract Specialist Loretta Sanchez, Loretta.D.Sanchez@usace.army.mil prior to the proposal due date and time. It is recommended that offerors contact the Contract Specialist, prior to the receipt of proposal date and time, to verify that their proposal has been successfully submitted, as the DoD SAFE website does not generate a confirmation email.

5.2 Tab B: Factor 1 – Past Performance
SUBMISSION REQUIREMENTS
5.2.1 Experience in Relevant Projects
5.2.1.1 The offeror shall submit examples of recent construction projects which best illustrate the experience of the construction contractor on relevant projects of similar scope, type, complexity, and magnitude as defined below. A minimum of three (3) projects, but not more than five (5), are to be submitted for the offeror as the Prime Contractor. Up to two (2) projects are to be submitted for the Designer of Record. Limit the information to Factor 1 to fifteen (15) thirty (30) pages or less. If the offeror’s submission exceeds the project limitation of 5 (five) projects for the Prime and 2 (two) for the DOR, only the first 7 (seven) projects submitted will be evaluated, and any remaining additional project(s) will not be evaluated. All narratives must contain sufficient detail to demonstrate recency and relevancy.
5.2.1.2 Where the word “project(s)” appears it is understood to mean a project(s), contract(s), task order(s), or any other contract document provided for in the FAR 2.101.
Examples of projects submitted by the Offeror may be projects performed for a State or Federal Government Agency.
5.2.1.3 Where the word “recent” appears, it is understood to mean construction type project for which construction is at least 70% complete (measured by performance period days) as of the RFP closing issuance date, or a construction type project that has been completed within 7 years of the RFP closing issuance date. Projects submitted for DOR should be for designs that are 100% complete. Projects completed more than 7 years before the RFP closing issuance date will not be considered for evaluation purposes.
5.2.1.4 Where the word “relevant” appears, it is understood to mean that project experience submitted is similar to the context of the solicitation in terms of scope, type, magnitude of effort and complexity as described and required in this RFP.
5.2.1.5 The Government may consider projects more relevant if they consist of all the recency and relevancy criteria listed below. Offerors are encouraged to submit a combination of projects demonstrating as many relevant characteristics as possible. For the purposes of evaluation under this factor, more consideration may be given to an offeror that demonstrates past performance/experience on projects that involve the following:
5.2.1.5.1 Performance by the offeror as the Prime Contractor
5.2.1.5.2 Previous experience between the Contractor and Designer of Record
5.2.1.5.3 Construction Complete Projects, or approximately 70% construction complete, (measured by performance period days) within the last 7 years from the closing date of the RFP. Projects completed more than 7 years before the RFP closing date will not be considered for evaluation purposes.
5.2.1.5.4 Experience with projects that involve the repair and rehabilitation of existing laboratory and scientific support spaces on a military installation.
5.2.1.5.5 Experience with integrating sustainable principles, to include life cycle cost-effective practices into the design, development, and construction of the project in accordance with UFC 1-200-02.
5.2.1.5.6 Projects greater than 15,000 square feet (sf) lab style and/or over $10,000,000 in construction costs may be considered more relevant.
5.2.1.5 As this is a Best Value trade-off, the more characteristics above that are met for each submitted project under this Factor, the greater the possibility of a higher technical rating.
5.2.1.6 Multiple Award Task Order Contracts (MATOCs) or any other type of task order contracts that provide for the issuance of task orders for the performance of tasks will not be considered projects for purposes of this evaluation. Only individual task orders issued under such contracts will be evaluated as projects. Project descriptions that do not clearly describe the offeror’s or team member’s experience, scope of the project or periods of project performance will not be considered.
5.2.1.7 It is the responsibility of the offeror to identify, detail, and demonstrate the relevancy of the submitted projects to the solicitation criteria elements. The evaluation committee WILL NOT make assumptions. If projects do not address the above, the proposal will still be evaluated; however, it may demonstrate potential increased risk of unsuccessful contract performance.
5.2.1.8 Information is to be compiled on the Contract Description Forms provided at the end of Section 00 22 16 and will be used to evaluate relevant contractor experience. Responses to this factor should take into account experience of the management team proposed for the contract, timeliness of performance, safety and health record, customer satisfaction and cost control. Projects submitted shall include challenges that were overcome and risks that were mitigated by use of quality management, risk evaluation and mitigation, and technical solutions. The contract number, issuing agency, date of award, and total value of each contract shall be provided.
5.2.1.9 Offerors are invited, but not required, to submit photographs of successful projects in conjunction with this section.
5.2.1.10 Each project example narrative should include the following information (provided on Contract Description Form):

5.2.1.10.7 Narrative description of the project, as described below.
5.2.1.11 All project examples shall contain a Point of Contact (POC) as well as on alternate POC, to include the name, job title of the POC, address, telephone, and e-mail address. The POC and alternate shall be familiar with the construction performance of the proposer and be a representative of the owner/customer, not affiliated with the proposer. The POC and alternate shall be available to verify the experience cited.
5.2.1.12 Narratives for each project should include a brief overview of the project and provide specifics as noted herein, discussing major features of the project and each project’s relevance and similarities to this project. The role and work assigned to any sub-contractors and/or personnel noted in the narrative shall be explained.
5.2.1.13 Indefinite-Delivery, Indefinite-Quantity (IDIQ) Contracts, where numerous Task Orders are summed to meet the minimum construction dollar value identified herein, are not acceptable.
5.2.1.14 If proposing as a Joint Venture (JV), providing examples for each prime contractor in the JV within the maximum of five (5) seven (7) project examples is allowed. JV documentation shall be provided in the offeror’s Phase I proposal.
5.2.1.15 In the case of contractor teaming arrangements involving a prime contractor and subcontractor(s), where the prime contractor submits the proposal in response to this RFP, the prime contractor must have completed at least 2 of the 3 minimum total number of relevant projects submitted for Factor 1 for consideration in response to the experience requirements of the RFP. Teaming documentation shall be provided in the offeror’s Phase I proposal. If a teaming agreement or commitment is not provided, the projects of any team members outside of the Prime Contractor will not be considered.
5.3 Past Performance
5.3.1 For each of the projects submitted in response to Section 5.2.1, provide a Contractor Performance Assessment Reporting System (CPARS) evaluation, or a completed Past Performance Questionnaire (PPQ), completed by a representative of the owner that provides the owner’s opinion of the offeror’s past performance for the project. As an alternative to a CPARS evaluation, or when CPARS evaluations do not apply, the Past Performance Questionnaire included in this solicitation (at the end of Section 00 22 16) is provided for the offeror or its team members to submit to the customer/client for each project the offeror includes in its proposal for the Past Performance factor. The offeror shall complete Part I of the Past Performance Questionnaire and e-mail the questionnaire to both the contracting activity and technical representative (Government or otherwise) responsible for the past/current contract. The POCs shall be instructed to electronically complete Part II of the questionnaire. Ensure correct phone numbers and email addresses are provided for the customer/client point of contact.
5.3.2 Completed PPQs should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a customer/client for a project before the proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ which will provide contract and customer information for the respective project(s). Offerors should follow up with customers/clients to ensure timely submittal of questionnaires. The Government reserves the right to contact the customer/client for verification or additional information. If the customer requests, questionnaires may be submitted directly to the Contracting Office no later than the proposal due date via email. Contact, Loretta Sanchez, Contract Specialist, via email at Loretta.D.Sanchez@usace.army.mil.
