PERFORMANCE WORK STATEMENT
PERFORMANCE WORK STATEMENT (PWS)
TWO RIVERS DAM AND RESERVOIR FLOOD CONTROL PROJECT
CHAVES COUNTY, NEW MEXICO
Part 1
General Information
1.0 General: This is a non-personal services contract to provide oversight, inspection, operation, maintenance and reporting duties for the Two Rivers Dam and Reservoir Flood Control Project. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1 Description of Services/Introduction: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform oversight, inspection, operation, maintenance and reporting duties for the Two Rivers Dam and Reservoir Flood Control Project as defined in this Performance Work Statement except for those items specified as Government furnished property and services. The Contractor shall perform to the standards in this contract.
1.2 Background: The Two Rivers Dam and Reservoir Flood Control Project was authorized by the 1954 Flood Control Act for the purposes of flood control and sediment retention. The Two Rivers project was constructed from 1960 to 1963. The City of Roswell experienced mass flooding from the Rio Hondo in 1937, 1941 and 1954. After the disastrous flood of 1941, Roswell sought to convert the abandoned Hondo Reservoir into a flood control facility. The Two Rivers Dam was completed in August 1963. The project is named Two Rivers because it provides flood control from the Rio Hondo and Rocky Arroyo. Since the goal of the project is flood control, most visitors will not see water in this reservoir. Visitors will find an overlook shelter, picnic area and restrooms at the Day Use Picnic Area, located approximately 1 mile from the Diamond “A” Dam.
1.3 Objectives: To provide public safety, protect life, property and commerce by mitigating flood conditions in Chaves County, New Mexico to include the City of Roswell by means of daily operations, inspection and maintenance of the Two Rivers Dam and Reservoir Flood Control Project while satisfying all regulations of the Dam Safety Program.
1.4 Scope: The U.S. Army Corps of Engineers, Albuquerque District is authorized to provide flood control, including operations and maintenance services for the Two Rivers Dam and Reservoir Flood Control Project.
The services to be performed under a firm fixed price performance-based contract will consist of oversight, inspection, operation, and maintenance of high hazard dam facilities and property. Services include safety, fire, security and environmental protection efforts, as well as, providing USACE reports that include but are not limited to, operations, inspections and maintenance information and notifications of unanticipated situations or problems. Services also include maintaining records, logs and schedules. Finally, Critical Components (CC) of the services to be provided includes coordination of gate and flood control operations with the Reservoir Control Branch, providing emergency response in flood fight situations, coordination of emergency services with local safety and fire protection agencies such as Chaves County Law Enforcement and Fire Department, participating in emergency planning and exercises, providing and operating heavy equipment, providing on-call services during off-duty hours to include Saturdays, Sundays, and holidays and ensuring compliance with all Federal, State and Dam Safety Regulations. The Contractor shall perform to the standards in this contract.
1.5 Period of Performance: The period of performance shall be for one (1) Base Year of 12 months and four
(4) 12-month option years and one (1) 6-month extension period. The Period of Performance reads as follows:
Base Year: Date of Award through 28 February 2023 Option Year I: 01 March 2023 through 29 February 2024 Option Year II: 01 March 2024 through 28 February 2025 Option Year III: 01 March 2025 through 28 February 2026 Option Year IV: 01 March 2026 through 28 February 2027 Option V: Optional 6 Months of Services This option may be exercised by formal modification in the event that continued services are required outside the period of performance for the base or optional periods. This option provision may be exercised more than once, but the total extension of performance shall not exceed 6 months.
Exercise of the contract option years will be at the Government’s discretion.
1.6 General Information:
1.6.1 Quality Control: The Contractor shall develop and follow an effective Quality Control Plan (QCP) to ensure services are performed in accordance with this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s Quality Control Plan is the means by which he ensures that his work complies with the requirements of the contract. The Contractor will provide his Quality Control Plan within 30 days of contract award. After acceptance of the QCP, the Contractor shall receive the Contracting Officer (KO) or Contracting Officer Representative’s (COR) acceptance in writing. Changes to the Contractor’s QCP must first be approved and accepted by the KO or COR.
1.6.2 Quality Assurance: The Government shall evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum satisfactory performance thresholds. The Government will use the Facilities and Maintenance System (FEMS) to track Contractor performance.
1.6.2.1 As a minimum, the COR and/or authorized representative will perform monthly quality assurance inspections. The inspection will involve a review of written reports and logbooks, and a visual inspection of the project site and facilities. Written reports and logbooks will be inspected for completeness, accuracy, and up-to-date status. The visual inspection of the work area and project site will evaluate the safety precautions in use, number of outstanding and undetected maintenance items, and overall condition of the project site and facilities as described by the O&M manual. Identification of any deficiencies will result in a Contract Discrepancy Report (CDR). The CDR will be handled in accordance with the applicable section.
1.6.3 Contract Discrepancy Report (CDR): If any items are discovered which are not properly maintained or inspected, the COR will prepare a Contract Discrepancy Report. This report will describe the nature of the discrepancy/deficiency and will request the Contractor to take action to remedy the discrepancy/deficiency. These reports will be kept on file for the duration of the contract. Upon receipt of the CDR, the Contractor will either take action to correct the problem or provide a written response on the report as to his position regarding the discrepancy/deficiency. If, within 7 days of receipt by the Contractor, the items noted on the report are corrected or resolved to the satisfaction of the Government, no further action will be taken. If the CDR is not resolved, the Contracting Officer’s decision is final. The KO has the following options:
a. Perform required work by Government forces and bill or deduct from the Project Contractor for costs incurred by the Government.
b. Perform required work by other outside Contractor and bill or deduct from the Project Contractor for costs incurred by the Government.
All CDRs resolved by either of the two methods above will likely result in a cumulative unsatisfactory evaluation of the Contractor’s performance.
1.6.4 Recognized Holidays: The following are recognized Government holidays in which the Contractor is required to be on-call:
New Year’s Day Labor Day Martin Luther King Jr.’s Birthday Columbus Day President’s Day Veteran’s Day Memorial Day Thanksgiving Day Independence Day Juneteenth
Christmas Day
1.6.4.1 Hours of Operation: The Contractor is responsible for conducting business between the hours of 7:30a.m.
- 4:00p.m. Monday thru Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must, at all times, maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
After Hours, Weekend, Holiday and Emergency Dam Operations (CC): The Contractor will be available on-call 24-hours a day, 7 days a week in case of after hours, weekends, holidays or emergency dam operations. In such cases, the Contractor and his employees are expected to be available by phone and no more than one (1) hour away from the project site in order to execute dam operations as directed. The estimate for the number of callouts is 3 times a year. The most likely scenario for emergency dam operations is a weather event that would require gate changes after hours, perhaps during the monsoon season. If weather dictates more callouts than the estimated 3 times, the contractor will get paid above the contract amount by a modification to the contract. The Contractor shall maintain his/her own office operations and equipment within the vicinity of the project and have the capability to mobilize heavy equipment to the project site within four (4) hours for dam operations as stated above. The type of equipment the contractor mobilizes for the completion of the work is left to the contractor. Past experience has shown that typical equipment necessary for work completion at the dam includes a 4 x 4 service pickup truck, backhoe tractor, motor grader, track-hoe with 30 feet reach and dump truck. The four-hour response time with equipment is a target response and would be dictated by the type of event taking place at the time. Scenarios requiring the subject equipment response in 4 hours are remote and experience has shown this rarely happens. An example of a remote event outside of flood risk management is herein given: A car was stolen and driven on to the dam site and ended up at the bottom of the trash rack. Law enforcement wanted immediate help with dealing with the situation. In a remote case like this, the contractor would have to respond, and this would be included as part of his contract for maintaining the dam.
1.6.5 Place of Performance: The work to be performed under this contract will be performed at the Two Rivers Dam and Reservoir Flood Control Project, located in Chaves County, New Mexico. Refer to Attachment #4 for map of project boundaries.
1.6.6 Direction to Place of Performance: The Two Rivers Dam and Reservoir Flood Control Project is located southwest of Roswell, New Mexico. Diamond “A” Dam is located on the Rio Hondo about 34 river miles above the confluence of the Rio Hondo with the Pecos River. Rocky Dam is located on Rocky Arroyo about 10 river miles above its confluence with the Rio Hondo. Access to the dams and reservoir from Roswell is by traveling west on U.S. 70 about 12.7 miles to the project access road, and southerly approximately 7 miles on the project access road to Diamond “A” Dam.
