JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. CONTRACTING AGENCY:

Department of the Army Albuquerque District, Corps of Engineers 4101 Jefferson Plaza NE Albuquerque, NM 87109-3435

2. DESCRIPTION OF ACTION:

This action is to request a Sole Source Firm-Fixed Price Contract for Curation of U.S. Army Corps of Engineers, Albuquerque District Archaeological Collections. This new contract will be using FY20 through FY24 Operation and Maintenance Funds (O&M) funds. The base year of this service contract will be funded utilizing FY20 O&M funds. Any subsequent option years will be exercised if found to be in the best interest of the Government. They will be funded at that time, utilizing appropriate, allocated funds.

We are requesting to use the Agency for Conservation Archaeology, Eastern New Mexico University (ENMU) as the primary contractor for this work. Under the authority found in FAR 6.302-3(a)(2)(ii), the Agency for Conservation Archaeology, Eastern New Mexico University (ENMU) is providing a service to maintain an essential engineering, research, or development capability for USACE.

Per 36 CFR 79.1 and 36 CFR 79.2, and under the authority of FAR 6.302-3(a)(2)(ii), it is the Government's intent to award a sole source service contract to the Agency for Conservation Archaeology, Eastern New Mexico University (ENMU) for the curation of existing archeological materials and associated archival records, photographs, slides, maps, etc., recovered as a result of past U.S. Army Corps of Engineers projects, and other curation associated tasks.

3. DESCRIPTION OF SUPPLIES/SERVICES OR NATURE OF CONSTRUCTION:

In accordance with 36 CFR 79 and ER 1130-2-540, the Contractor shall provide curatorial and management services for the U.S. Army Corps of Engineers Albuquerque District’s archaeological collection from Santa Rose Lake (Los Esteros).

The collections consist of a total of approximately 378 cubic feet of artifacts and associated records including field notes, photographs, drawings, maps, slides, reports, computer printouts, etc. The Contractor shall accession or deaccession, label, catalog, store, maintain, inventory, and conserve the collection on a long-term basis. The Contractor shall have the capability to store, study, stabilize, and conserve the collection(s). On-site space for qualified researchers must be available.

Based on a Government Estimate the total estimated cost for this project is approximately $81,000.00.

4. AUTHORITY CITED:

The statutory authority permitting this procurement is 10 U.S.C. 2304(c), and FAR 6.302-3(a)(2)(ii), because the requirement is necessary to maintain an essential engineering, research, or development capability and will be provided by and educational or other nonprofit institution.

Our intent is to award a Sole Source contract to the Agency for Conservation Archaeology, Eastern New Mexico University (ENMU). As required by 36 CFR 79.1 and 36 CFR 79.2, the Agency for Conservation Archaeology, Eastern New Mexico University (ENMU) meets all requirements for the proper curation of the U.S. Army Corps of Engineers Archeological Collections.

5. REASON FOR AUTHORITY CITED:

Per 36 CFR 79, the collections must be deposited in a repository with adequate long-term curatorial capabilities such as having requisite equipment, appropriate storage space, and adequate safeguards for physical security and controlled environment as well as a professional, qualified staff for management of the collection(s); in a repository that is centrally located relative to the source location of the materials; that has the capability to provide public access to U.S. Army Corps of Engineers-owned collections for research and educational purposes; and a repository that houses other collections that are thematically related to the U.S. Army Corps of Engineers collection(s).

6. EFFORTS TO OBTAIN COMPETITION:

A Notice of Intent to Award a Sole Source Contract was posted on beta.sam.gov on November 19, 2019. This remained on the website until December 4, 2019, advertising the prospective contract for a total of sixteen (16) days.

7. ACTIONS TO INCREASE COMPETITION:

Outside of posting the Notice of Intent to Award a Sole Source Contract requirement on beta.sam.gov, there have been no attempts or plans to increase competition for services that must be completed per guidelines and restrictions dictated in the Code of Federal Regulation (CFR). The reasons behind this decision have been previously outlined in paragraph 5.

This requirement was previously awarded in FY15. The only Offeror for that requirement was the Agency for Conservation Archaeology, Eastern New Mexico University (ENMU), a State Entity. No other entities expressed interest in the requirement or made any offers to perform the work.

8. MARKET RESEARCH:

Aside from the attempts detailed in paragraph 5 and 6, no additional attempts at Market Research have been conducted, due to the requirements detailed in the Code of Federal Regulation (CFR).

9. INTERESTED SOURCES:

No other sources have expressed an interest in writing. There have also been no objections presented to the prospect of awarding a Sole Source Contract to the Agency for Conservation Archaeology, Eastern New Mexico University (ENMU).

Other than the Agency for Conservation Archaeology, Eastern New Mexico University (ENMU), there have been no other sources identified as interested in performing the required services.

10. OTHER FACTS:

The U.S. Army Corps of Engineers will continue to perform Market Research, in an attempt to identify alternatives to avoid sole source situations in the best interest of the Government.

Currently, based upon the Code of Federal Regulations, the Agency for Conservation Archaeology, Eastern New Mexico University (ENMU) must be utilized for this requirement. See Paragraphs 3, 5, and 6 above.
