1.6 General Information:

1.6.1 Quality Control and Cleaning Plan. The Contractor shall develop and maintain an effective Quality Control Program (QCP) to ensure services are performed in accordance with this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s QCP is the means by which he assures himself that his work complies with the requirement of the contract. The Quality Control Plan shall contain a list of disinfectants and supplies to be used in performing the contract duties. The plan shall identify the contractor-furnished equipment and state how the work will be accomplished. Specific dates/days shall be scheduled for all daily, weekly, monthly, and semi-annual duties that are listed in Section

5. The schedule shall be submitted in writing for approval no later than 30 days after contract award. After acceptance of the quality control plan the Contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.

Changes in the approved schedule shall be submitted for approval prior to implementing the change. The Plan shall document how the Contractor will identify and correct performance shortfalls. Complete records of all inspections performed by the Contractor must be maintained and made available to the Government upon request during contract performance.

1.6.2 Quality Assurance. The Government shall evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum satisfactory performance thresholds.

The contractor shall furnish the Operations Manager, hereafter referred to as the Point of Contact (POC) a telephone number attended during normal working business hours (7:00 a.m. – 4:30 p.m. MST) to which calls concerning performance or other contractual matters can be placed. For the purpose of time and date, a message will be deemed delivered to the contractor, at such time as it is delivered to the number provided by the Contractor.

The contractor shall provide the POC:

(1) A list (to include brand names) of all supplies and materials to be used on-the-job that are required to be furnished by the Contractor.

(2) A Material Safety Data Sheet for each chemical and cleaning compound or any other substance the Contractor proposes to utilize in the performance of the work of the contract.

(3) A list of names of all employees who will be working for the Contractor.

(4) A list of Contractor and employee vehicles with license numbers.

(5) A photocopy of Certificates of Liability Insurance.

Quality Assurance Surveillance Plan. A Quality Assurance Surveillance Plan (QASP) will be used during the life of the contract to ensure that the contractor is performing the services required by this PWS (Performance Work Statement) in an acceptable manner. The Government develops the QASP and the Project Office administers the Plan through Quality Assurance Evaluators (QAE).

The Government will monitor the Contractor’s performance under this contract using assurance procedures developed by the Government. Typical procedures might include periodic sampling, checklists and customer/employee complaints. This should not be considered an exhaustive list. A primary objective of the Government Quality Assurance will be to determine the effectiveness of the contractor’s quality control system.

The Government has the right to inspect and test all service called for by the contract to the extent practicable at all times and places during the term of the contract. The government shall perform inspections and tests in a manner that shall not unduly delay the work.

If any of the services do not conform to contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by re-performance, the Government may (1) require the Contractor to take necessary action to ensure that future performance conforms to contract requirements and

(2) reduce the contract price to reflect the reduced value of the service performed.

Payment will NOT be made for work not performed to standard.

If the Contractor fails to promptly perform the services again or take the necessary action to ensure future performance in conformity with contract requirements, the Government may (1) by contract, or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service or (2) terminate the contract in whole or in part.

Performance by a third party or Government Personnel. In addition to the above remedies for nonperformance, the Government reserves the right to cause the specified work to be performed by a third party or Government personnel and the cost incurred thereby will be levied against the contractor. Any time government personnel are used because of the contractor’s nonperformance, the cost levied against the Contractor will include all direct costs associated with the performance of the specified work. Such inefficiencies are determined on an hourly basis at the applicable wage rate. Government personnel will be used only when time is of the essence and the interests of the Government would not be served by securing a third party to perform the specified work.

Deductions. If any of the services do not conform to contract requirements (cleaning plan), the Government may require the Contractor to perform the services again in accordance with contract requirements at no increase in the contract amount. Notice of contract discrepancies to be corrected will be given to the Contractor or his representative by telephone on the day that the discrepancy was identified. The Contractor shall have twenty-four (24) hours from the time of telephone notification in which to take corrective action. When the defects in services cannot be corrected by re-performance, the Government may reduce the contract price to reflect the reduced value of the services performed as listed below:

Deductions will be made on a monthly basis during the billing cycle when the work deficiencies (Allowable Reject Level [ARL]) fail to meet Acceptable Quality Levels (AQL’s). Deductions will be made to specific line items in the following manner: a 100% line item deduction will be made when the ARL reaches maximum deficiencies or a critical work item is not performed in each location specified in this contract. Deductions result from services not rendered, are non-negotiable and approved by the Contracting Officer. Anytime an AQL is not met, it will represent failure on the part of the Contractor to meet requirements, and may support cause for termination of the contract.

To assist the visiting public in reclaiming lost articles, all property left by visitors and found during cleanup operations shall be turned into the Project Office or POC.

If for any reason the required day’s cleaning is not completed by the designated time, the Contractor shall submit in writing, a list of facilities not completed, the reason the work was not accomplished, and the time the work was finally completed to the POC (Point of Contact). This explanation shall be furnished to the POC at 8:00 a.m. the following day.

The Contractor must, at all times, maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
