PROPOSAL SUBMISSION REQUIREMENTS, EVALUATION CRITERIA, AND BASIS

FOR AWARD

1.0 GENERAL REQUIREMENTS

The intent of this Request for Proposal (RFP) is to solicit proposals under a Multiple Award Task Order Contract to Provide Third Party Blind Validation Seeding and Advanced Geophysical Classification (AGC) Data Collection and Processing to Support the South Pacific and Southwestern Divisions. provide Tribal Consultation, Cultural Resources, and Environmental Services to support the USACE Tribal Nations Technical Center of Expertise (TNTCX), Albuquerque District (SPA). The geographic area of coverage is nationwide including Alaska, Hawaii, and other U.S. territories. Contracts awarded under this MATOC are made available for use by other Districts to support mission critical projects in those Districts.

This is a best value source selection conducted in accordance with Federal Acquisition Regulation (FAR) Subpart 15.3, Source Selection, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). The awards will be made based on the best overall (i.e. best value) proposals that are determined to be the most beneficial to the Government, with appropriate consideration given to all evaluation factors in the solicitation.

The proposal shall describe the capability of the Offeror to perform the requirements detailed in the Performance Work Statement (PWS), and associated documents. The proposal should be specific and complete in every detail;

and should be prepared simply and economically, providing a straightforward and concise description of capabilities to satisfactorily perform the requirements. The proposal should be practical, legible, clear, and coherent.

In order to effectively and equitably evaluate all proposals, the Contracting Officer must receive information containing sufficient detail to allow review and evaluation by the Government. Proposal clarity, organization, and cross-referencing are mandatory. Failure to submit and organize proposals as requested may adversely affect an Offeror’s evaluation.

Proposals shall not exceed the page limits described. Provide all information in tabbed sections.

2.0 SUBMISSION FORMAT FOR VOLUME I

a. COVER SHEET & TABLE OF CONTENTS. Proposals shall consist of two (2) volumes. A cover sheet identifying the Offeror (name, address, point of contact), project description, and solicitation number shall be provided. The second sheet shall be a table of contents. The proposals shall contain a detailed table of contents. Offers that violate these rules unnecessarily delay the evaluation process and may be rejected by the Government after the initial evaluation without receiving any further consideration. Neither the cover sheet nor the table of contents count toward the page limitations.

b. TABS. Written proposal materials shall be submitted in standard three ring loose-leaf binders. Proposals shall be tabbed and labeled as specified in a manner to afford easy identification from a Table of Contents.

c. FONT SIZE. Shall not be less than 10 point. Pages will be double-sided and each page shall be identified with the appropriate page number centered at the bottom of the page.

d. SHEET SIZE. Shall be 8-1/2 inches x 11 inches; however, if drawings, charts, or other graphics are submitted, sheets no larger than 11 inches x 17 inches and folded to 8-1/2 inches x 11 inches shall be used.

All sheets shall be dated and numbered.

Section M - Evaluation Factors for Award

6.1.1 Section 1- Relevance of Demonstrated Experience: This section shall list each recent and relevant contract experience of the Offeror (prime contractor, or previous contractor and subcontractor team performance, or as a subcontractor). Information provided on the Contract Description Form provided at the end of this section will be used to evaluate Past Performance. Offerors are invited, but not required, to submit photographs of successful projects in conjunction with this section. This factor is limited to fifteen (15) pages. Past Performance Questionnaires are EXCLUDED from the page limitation of Factor.

6.1.2. Provide five (5) examples of recent and relevant projects performed as the prime contractor to demonstrate relative project experience: Tribal consultation and cultural resources, and environmental support that demonstrate the company’s diversity of effort. A project does not have to be under an IDIQ contract, but where it is, clearly indicate so. The Government will use the relevant company effort and quality of past performance information submitted under this tab to assess the Offeror’s past performance to determine the Offeror’s probability of successfully performing the scope of work described in this solicitation.

a. Where the word “project(s)” appears it is understood to mean a project(s), contract(s), task order(s), or any other contract document provided for in the Federal Acquisition Regulation (FAR 2.101). An IDIQ or Task Order contract as a whole is not considered a project, although individual delivery or task orders awarded under such a contract would be. Examples of projects submitted by the Offeror shall demonstrate developing and implementing Tribal consultation, cultural resources, and environmental support work practices for a variety of customers including Tribal Nations, Government civil works, and military customers. Examples of projects submitted by the Prime Contractor may be projects performed for a State or Federal Government Agency; or for a commercial or private sector customer.

b. Where the word “recent” appears it is understood to mean projects for which the effort is at least 50% complete (measured by billed percentage) as of the RFP issue date of this solicitation or a project that has been completed within five years (5) years of the RFP issue date of this solicitation. Offerors shall indicate the percentage of work that is complete if currently underway. “Relevant” past performance information is one indicator of an Offeror’s ability to perform the contract successfully.

c. Where the word “relevant” appears it is understood to mean a project effort that is similar, and that has a logical connection to the context of this solicitation in terms of scope (similar type of work, size, magnitude of effort, complexities and dollar value) as projects described in the PWS of this solicitation.

The Government will only evaluate the past performance information of the Offeror signed on the SF 33.

Accordingly, past performance information of subcontractors to the Offeror, parent or affiliated companies, predecessor companies, etc., or key personnel will not be considered.

6.1.3 Section 2- Quality of Past Performance:

1) For all contracts identified in Section 1, Relevance of Demonstrated Experience, and pertaining to the Offeror only, the Offeror shall submit evidence of the quality of their past performance. The Offeror shall provide a completed contractor performance evaluation, whether interim or final, found in the Past Performance Information Retrieval System (PPIRS) at www.ppirs.gov. If a completed contractor performance evaluation does not exist in PPIRS (example, non-U.S. Government projects) the Offeror shall provide a completed Past Performance Questionnaire (PPQ) (Atta. If, at the time of evaluation, a completed contractor performance evaluation exists in PPIRS that conflicts with a submitted PPQ, the completed contractor performance evaluation in PPIRS will govern. Projects for which a past performance evaluation (either from PPIRS or a PPQ) has not been received (either from the Offeror or directly from the customer) on or before the proposal due date will not be evaluated. Only past performance evaluations of the offer will be reviewed.

Do not provide past performance evaluations for sub-contractors

2) Completed PPQs that were submitted in response to previous solicitations may be used in this source selection. However, Offerors shall not simply incorporate any those PPQs by reference, but rather provide them with their proposal. Offerors are advised that the Government reserves the right to consider previously submitted past performance information in this evaluation, and while the Government may elect to apply to this solicitation as indicated in paragraph (c) of this provision have been entered or updated within the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard applicable to the NAICS code referenced for this solicitation), as of the date of this offer and are incorporated in this offer by reference (see FAR 4.1201); except for the changes identified by the Offeror under this provision.

5. Financials and Financial Standing Questionnaire. Offerors shall provide their latest balance sheet and income statement, including the names of banks or other financial institutions with which your firm conducts business. If the financial statements are more than 60 days old, a certificate should be attached stating that the financial condition is substantially the same, or if not the same, state the changes that have taken place. The financial statements will be treated as confidential. The Financial Standing Questionnaire provided at the end of this section is required to be completed and submitted.

HOURLY LABOR RATES PRICE SCHEDULE:

The Offeror shall complete the Price Schedule in Section B of the solicitation. Offerors may not modify the price schedule wording or format. Offerors shall provide hourly labor rates for labor disciplines listed in the Hourly Labor Rates Price Schedule. If the Offeror has a different job title or if the Offeror is proposing to use subcontracted labor in which the subcontractor uses a different job title for any of the listed disciplines, Offerors are instructed to add that job title to the most appropriate or similar job title listed in the table (e.g.

clerical/Administrative Assistant). The Offeror may provide supporting documentation to support the Hourly Labor Rates Price Schedule.

Instructions for completing the Price Schedule: Offerors shall provide an unloaded labor rate in the “Base Hourly Rate” Column for the labor categories/disciplines listed. For the subsequent columns, the Offeror shall provide “Fully Loaded” rates that include overhead, general/administrative (G&A), labor burden fringes, etc.

for the labor categories/disciplines listed. An escalation factor may be applied to the base year rate for each of the subsequent years following Base Period Year 1; however, the Contracting Officer will have the discretion to renegotiate those rates annually based upon the current CPI or other accepted price indices. Labor Rates for all disciplines listed are required. A proposal that does not provide rates as instructed or rates that are traceable to the sample project will not be evaluated and therefore not considered for award.

The Offeror may not have all personnel on staff, therefore, if any personnel are subcontracted, their rates shall be provided in the price schedule as well. Provide only one rate per labor discipline including those provided by subcontractors. All subcontracted personnel shall be identified on the price schedule as “SUB”, for example, “Cultural Resources Specialist (SUB).” All proposed labor rates shall not include profit. Profit will be negotiated on individual task orders issued from the MATOCs.

The rates proposed in Section B will be legally binding and will be the maximum rates that the Offeror will use for any firm fixed-price task orders issued against the MATOCs within the five year performance period of the contract. Lower rates may be offered at the task order level. At the Government’s discretion, proposed escalation rates may be renegotiated annually.

FACTOR 4 (COST/PRICE) EVALUATION CRITERIA

The contract will be a Firm Fixed Priced (FFP) contract. The Government will evaluate price reasonableness for the fixed priced effort. The evaluation of the Offeror’s proposed rates in conjunction with the proposed price for the sample project will be considered in determining the overall reasonableness of the Offeror’s cost/price proposal and the potential risk to the Government.

The Government will evaluate price reasonableness for the fixed price of the labor disciplines and the proposed escalation rates. The base period and all option years shall be included in the cost/price evaluation.

Offeror shall clearly show, in (spreadsheet format, narrative, etc…) the rationale used in developing the burdened labor rate for all labor CLINs. disciplines. The rationale for the burdened labor rates should show, as a minimum, the actual labor rate paid to the employee, all applicable payroll taxes; all applicable paid time off e.g. vacation, holiday, sick; all applicable insurances e.g. health, dental, workers comp, general liability; all other benefits paid e.g.

retirement, 401K, employee morale, bonuses, etc.; and overhead for tools as applicable. (See sample format below.)

Offerors are cautioned that all hourly rates must be burdened to include all statutory taxes. Offerors are also cautioned that the burdened labor rates should include G&A and profit. Task Orders will be negotiated and issued based on the amount of time required to perform the work multiplied by these hourly rates plus cost of materials, travel, subcontractor expense and subcontract handling fee.

The offeror shall clearly show, and include in Volume III, the rationale followed in development of the percentage mark-up CLINs. Offerors are cautioned that these percentages must include all general and administrative expenses above the site level, profit, and other items described in Schedule B of this solicitation. The rationale shall include a breakdown to identify individually the portion of the proposed percentage attributable to G&A and the portion attributable to profit.

Information requested in subparagraphs (1) and (2) is not intended to be restrictive or all inclusive. The offeror is encouraged to submit any other price/cost or financial information that may be helpful in the understanding and evaluation of the price proposal; however, superfluous or elaborate documents are not desired. Offeror must agree that authorized Government representatives may have access to applicable accounting and estimating documents and records not submitted with the proposal if required to complete evaluation of the price proposal.

9.0 BASIS FOR AWARD

9.1 Proposals must meet the criteria stated in the RFP in order to be eligible for award, to include responsiveness, technical acceptability and responsibility.

9.2 The Government intends to award without discussions based on initial proposals received; therefore, the proposals shall contain the Offeror’s best terms from a cost and technical standpoint. However, the Government reserves the right to conduct discussions in accordance with FAR 52.215-1, if the discussions are deemed necessary at the Government’s discretion. The Government reserves the right to address any pertinent issues in the proposals.

9.3 The Government will award a contract to the responsible Offeror whose proposal the Source Selection Authority determines conforms to the request for proposal, is fair and reasonable with regard to pricing, and whose proposal offers the best overall value to the Government. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for the Technical factor (to include all subfactors). Proposals receiving a deficiency will not be considered for award. The Government reserves the right to accept other than the lowest priced offer or to reject all offers. If the Government accepts other than the lowest offer, it must be significantly more advantageous than the lowest offer to justify the payment of additional amounts.

9.4 The combination of all technical (non-price) evaluation factors is significantly more important than the price. As technical ratings and relative advantages and disadvantages become less distinct, differences in price between proposals are of increased importance in determining the most advantageous proposal. Conversely, as
