52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the
Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph
(b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.

The narrative shall specifically address the below key points:
a. Describe the technical approach the Offeror proposes in completing the task of dewatering and sedimentation removal within the stilling basin sufficient to allow the government to inspect and correct existing deficiencies within the Stilling Basin, understanding the time, weather, irrigation, and physical constraints associated with this project.
b. Describe how the Offeror proposes to allocate resources to ensure the project stays on schedule within the time limitations imposed by the irrigations requirements downstream.
c. Describe how the Offeror proposes to execute the removal of material within the Stilling Basin without damage to the existing feature of the stilling basin.
d. Describe how the Offeror proposes to coordinate and maintain necessary communication with all stakeholders associated with the project for all anticipated situations.
5.1.2 EVALUATION CRITERIA:
5.1.3 The Government will evaluate the strengths, weaknesses and any deficiencies in the plan. The offeror
MUST, at a minimum, address the key points listed above. Failure to address all of the key points will result in an
Unacceptable rating. The Government will evaluate the firm’s understanding of the requirements described in the
Division 01 requirements and the plans and technical specifications of the solicitation and the capability to execute the project.
6.0 FACTOR 3: SUMMARY SCHEDULE:
6.1 SUBMISSION REQUIREMENTS
6.1.1 Submit a summary level schedule for construction including any construction phasing. Schedules or diagrams may be provided separately in a size that is easily read, but shall be clearly labeled as Tab C. This summary schedule will, after contract award, be replaced with a project schedule as required by Section 01 32 16.00 20
SMALL PROJECT CONSTRUCTION PROGRESS SCHEDULES. The summary schedule shall be task oriented, indicating the number of calendar days after notice to proceed, and by which milestones are to be achieved. The
Offeror may use a critical path or other method of their choice; however, schedule shall be graphically represented.
For purposes of developing a summary level schedule assume an award date of September 26, 2018. The proposed summary schedule shall reflect the proposed contract duration. Give attention to the following features:
a. Show the overall construction phasing for major activities. At a minimum the contractor shall identify the site preparation, sediment removal of materials from the Stilling Basin, inspection of the concrete within the Stilling Basin, and allowances for time to execute incidental concrete repair before the end of time limitations for working within the Stilling Basin, as identified in Section 00 73 00 and Section 01
01 01.
b. The Offeror must demonstrate the capability and flexibility to plan and schedule the complete project to meet the proposed contract limitations for working within the Stilling Basin. Clearly identify any additional constraints on the schedule presented (e.g., labor or material availability, permits, weather, etc.). Indicate the anticipated overall critical path on the schedule.
c. Show closeout activities.
The intent is to provide enough detail to demonstrate the Offeror’s understanding of the project; however, it is not the intent for the Offeror to provide the amount of detail that will be required in the pre-work submittals contained in
Division 01 of this RFP.
