SCOPE OF WORK

PINE RELEASE SPRAYING

MECKLENBURG COUNTY, VA

JOHN H. KERR RESERVOIR

1. Description of Work

The services to be furnished under these specifications consist of equipment, personnel, and performing all work required in the pine release spraying of approximately 100 acres in Liberty Hill WMA and Tate’s Branch Sale Area on John H.

Kerr Reservoir lands in Mecklenburg County, Virginia. Stands in Liberty Hill WMA include 3 and 4. Stands in Tate’s Branch Sale Area include 2, 3, 5, 7, and 8. These tracts have been recently salvaged to remove timber killed by the Southern Pine

Beetle (Dendroctonus frontalis). The Contractor shall be a licensed applicator in the state of Virginia. Proof of license shall be provided at the time of quote.

2. Period of Services

The period during which services are to be provided under this contract will be between 15 July 2017 and 15 September 2017. The Contractor shall give a 24 hour notice to the Project Forester Josh Deal (434) 738-6143 ext. 6157 or COR Shannon

Crews (434) 738-6143 ext. 6155, prior to commencement of this contract.

3. Pine Release Procedures

The Contractor shall be required to spray a mix of Arsenal at 16 ounces per acre, Escort at 1 ounce per acre, and Herbimax Surfactant at 3.2 ounces per acre or industry equivalent by helicopter. The Contractor shall abide by all Virginia Department of Forestry Best Management Practices and by all Federal and State laws.

4. Materials Furnished by the Government

The Government will furnish all forms, maps, and other instructional material necessary for the performance of this contract.

5. Materials Furnished by the Contractor

The Contractor shall furnish all equipment, labor, fuel, tools, transportation, and personnel required for the successful performance of this contract. The Contractor shall also furnish sufficient documentation demonstrating they are a licensed applicator in the state of Virginia.

6. Correction of Unsatisfactory Work

If the work is found to be unsatisfactory, the Contractor shall be liable for all costs in connection with correcting such errors where the errors are deemed by the

Contracting Officer to be the result of careless or incompetent performance by the Contractor’s employees.

7. Safety

All work shall be performed in conformance with applicable U.S. Army Corps of

Engineers safety regulations (EM 385-1-1) and all OSHA requirements.

8. Liability and Release of Claim

The Government will not be liable for any damage, loss, or destruction of real or personal property of the Contractor or of employees of the Contractor, or of any individual, partnership or corporation, which results from the operation of or accident to their equipment. The Contractor shall agree to hold and save the

Government, its officers, agents, and employees free from all liability from any or all injury, death, loss, damage, or destruction of personnel and/or property caused by or in connection with services required by this contract.

9. Antiterrorism/Operations Security Requirements (AT/OPSEC)

The Contractor will be required to adhere to the following conditions:

Access and General Protection/Security Policy and Procedures: All contractor and all associated sub‐contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or

Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

For contractors who do not require CAC, but require access to a DoD facility or installation: Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and

Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

Pre‐screen candidates by using E‐Verify Program: The Contractor must pre-screen Candidates using the E-verify Program(http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award." *When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.

10. Pre-work Conference

A pre-work conference will be scheduled on a mutually convenient date and place prior to the commencement of work in order to discuss the above information.

11. Health and Safety

A. In order to protect the health and safety of the public if aerial application is used, the contractor shall give notice to the COR no later than 4:30PM on the business day prior to application allowing time for public evacuations from the area or restricted access to the area if required. The Government will be responsible for placing signs in the area to be serviced upon this notification.

B. In order to protect the health and safety of employees and other persons and prevent damage to property, materials, supplies, and equipment, and to avoid unnecessary work interruptions in the performance of this contract; the Contractor shall comply with all pertinent provisions of the US Army Corps of Engineers’ Safety and Health Requirements Manual, EM 385-1-1 http://www.usace.army.mil/SafetyandOccupationalHealth/EM38511,2008Being Revised.aspx

C. Prior to the commencement of work, the Contractor shall submit an Activity Hazard Analysis (Appendix A) to the COR for review and approval.

D. Work-related accidents involving the Contractor or his employees shall be reported promptly to the COR.

E. The Contractor shall obtain Safety Data Sheets (SDS) for all chemical materials used to complete this contract and submit copies to the COR.

F. Copies of all SDS shall be included with the Activity Hazard Analysis and must be available to the Contractor’s employees in the field in case of an emergency.

G. The Contractor shall ensure that all hazardous or toxic materials are handled in a manner which prevents contamination of the environment, and that these materials are disposed of in accordance with Federal, State, and local regulations.

H. The Contractor shall ensure that wastes generated by the contracted work are removed from the work area and disposed in a lawful manner.
