STATEMENT OF WORK

Janitorial and Grounds Maintenance Services

Cape Fear River Locks and Dams Bladen County, North Carolina

I. General Information

A. Introduction: The purpose of this work is to provide janitorial and grounds maintenance for and

Dams #1, #2, and #3 (William O Huske Lock and Dam) on the Cape Fear River, Bladen County, North Carolina. These facilities are operated and maintained by the US Army Corps of Engineers, Wilmington District.

B. Background: Each of the three locks and dams has public recreation facilities including a restroom building, picnic shelter/s, a boat ramp, public parking areas, and shoreline areas open for fishing. Lock #1 has a wooden fishing pier.

C. Pre-Bid Site Visit: Potential bidders should make an onsite visit prior to submitting a bid.

Bidders will be notified of site visit time and date by Contracting Officer. Mr. Virgil “Buddy” Ray, Lock Master, can be reached at telephone, 910-874-0883 (cellular). It is the Bidders responsibility to utilize this opportunity to note the location of the work; conditions, security, safety, equipment, facilities, and any other factors which may affect the work or costs to perform the work.

D. Definitions

1. Contracting Officer. A government employee with authority to enter into, administer, and/or terminate contracts and make related determinations and findings.

2. Contracting Officer's Representative (COR). An individual designated in writing by the Contracting Officer to be responsible for the administration of the contract.

E. Quality Control/Quality Assurance

1. General. The Contractor is responsible for maintaining adequate quality control to satisfactorily meet the specifications of this contract through the development of a Quality Control Plan.

2. Quality Control. The Contractor shall establish a complete quality control (QC) program to assure the requirements of the contract are provided as specified. One copy of the Contractor's basic quality control program shall be provided to the COR at the pre-work conference and an updated copy must be provided to the COR, for approval, as changes occur.

The approved copy of the QC program will become a part of contract. The program shall include, but not be limited to the following:

(a) An inspection system covering all the services stated in the contract specifications. It must specify areas to be inspected on either a scheduled or unscheduled basis and the individuals who will do the inspection. An inspection checklist covering all routine services shall be developed and submitted to the COR for approval.

(b) A method of identifying deficiencies in the quality of services performed before the level of performance is unacceptable.

(c) A file of inspections conducted by the Contractor and the corrective actions taken.

When the QC reports show a deficiency the Contractor shall state, in his next report for the area, how deficiency was corrected or steps taken to correct such deficiencies.

A copy of this documentation shall be made available to the COR. Copies of inspection checklists, signed by the inspector, shall be supplied to the COR within two days following inspection. The inspection checklist shall include the following items as a minimum:

(1) Inspector's name

(2) Park or area

(3) Date

(4) Weather

(5) Time in/out of area

(6) Items inspected

(7) Defects encountered

(8) Corrective action taken

(9) Safety violations

(10) List of damaged, inoperable or vandalized facilities

3. Quality Assurance. The government will monitor the Contractor's performance in each functional area under this contract and reserves the rights to use whatever additional surveillance procedures are deemed appropriate. If the Contractor fails to perform according to the performance standards, a Notification of Contract Deficiency-Service Contract will be issued by the COR. The Contractor shall explain in writing why the performance was less than satisfactory, and how recurrence of the problem will be prevented in the future.

F Scope of Work:

1. Janitorial work includes trash collection, disposal, and cleaning of the interior and exterior of public restrooms, picnic shelters, picnic tables, impact areas, grounds, roads, walkways, parking areas, fishing piers and surrounding areas. This contract does not include cleaning of Lock Master houses or storage buildings.

2. Grounds maintenance work includes mowing and trimming of grass, removal of trash from shoreline areas, and pesticide application.

3. The Contractor shall have sufficient numbers of properly trained and licensed personnel, vehicles, mowers, equipment and supplies to accomplish the work described.

II. Work Requirements

A. Technical Provisions

1. Work shall be performed under the supervision of the Contracting Officer’s Representative (COR). The Contractor shall assure that all services are conducted in accordance with the contract and all applicable laws, regulations, codes, or directives. Incorporation by reference shall include any and all mandatory provisions required by the Federal Acquisition Regulation (FAR).

2. The Contractor shall provide all planning, programming, administration, management supervision, maintenance of accurate and complete records and files, quality control inspection, personnel, materials, supplies, parts, tools, equipment and vehicles, except as otherwise provided for herein, necessary to perform required services.

3. The Contractor shall furnish samples of all cleaning supplies and related materials proposed for use under this contract to the COR for approval prior to use. Samples shall include but not be limited to, the following items: soaps, detergents, disinfectants, insecticides, deodorant, chrome polish, refuse container liners and toilet tissue. Cleaning supplies and related material may not be heavily scented or perfumed.

4. The Contractor shall have sufficient number of vehicles to accomplish terms of this contract.

Vehicles shall be kept clean and in good mechanical conditions and shall be painted so as to present a good appearance. Contractor shall be required to equip vehicles with approved magnetic signs indicating that vehicles are operating under contract to the U. S. Army Corps of Engineers (magnetic signs must be removed once contractor has left Government Property).

The Contracting Officer (KO) reserves the right to inspect all equipment proposed by the contractor for use in performance of custodial services and refuse collection, prior to offer acceptance, prior to commencement of work and/or during performance under the contract.

Equipment, which is not acceptable to the Contracting Officer, may not be used on job unless repaired and approved by KO.

5. The Contractor shall use reasonable care to avoid damaging buildings, equipment, roadways, structures, trails and vegetation on the Government property. Vehicles used in the performance of this contract shall be used only on designated roads or trails unless otherwise approved by the COR. If the Contractor's failure to use reasonable care causes property damage, the Contractor is liable and shall replace or repair the damage at no cost to the government. If the Contractor fails or refuses to make such repairs or replacement the cost may be deducted from the contract price.

6. The KO may require the immediate removal of any contractor employee who is objectionable, incompetent, or endangers persons (including themselves) or property, or whose physical or mental condition is such that it would impair the employee's ability to satisfactorily perform the work. Notification for removal will be in writing. However, notification may be made by telephone, and later confirmed in writing if time and circumstances warrant. The contractor shall take immediate action to replace any dismissed employee. Personnel changes, regardless of cause, will not reduce the contractor's obligation to perform work in accordance with contract specifications.

7. Herbicides Applicators: All herbicides shall be used according to manufactures specifications and in accordance will all applicable laws and restrictions. Applicators shall be licensed by the State of N.C. Department of Agriculture and work will be in accordance with all Federal, State, and Local laws.

8. Variations of Estimated Quantities: The number of facilities listed in this contract is subject to change as a result of an increase or decrease in public visitation, inundation by floodwaters, or other factors. If the addition or removal of equipment and facilities causes an increase or decrease in the cost of performance of the work, an adjustment may be made in accordance with the "Changes" articles of the Standard Service Contract Provisions.

9. Vandalism: The Contractor shall notify the COR immediately of any vandalism or damaged facilities. The contractor shall make a reasonable attempt to keep facilities open to the public but my close facilities under emergency circumstances (substantial water leak, clogged toilets, and safety hazards etc. If facilities must be closed the Contractor shall notify the COR within 2 hrs. of closure.

10. Inspection and Acceptance: The COR will make inspection of services rendered. Any work not meeting acceptable standards will be remedied to the satisfaction of the inspector prior to payment. Failure or inability to perform acceptable services will result in reduction in payment.

11. Payment: Payment will be made at the end of each calendar month. Invoices must be received by the 5th of each month.

A. Janitorial:

1. Janitorial Services Schedule:

a. Between 6:00 AM and 2:00 PM - Monday, Wednesday, and Friday of each week.

2. Janitorial Requirements

a. Restrooms: The contractor shall ensure that all facilities are clean, free of objectionable odors, and contain adequate supplies. Wet mop restroom floors, clean sinks and toilets, clean mirrors and dispose of trash. Empty trash cans and replace liners. Clean and refill soap dispensers. Clean hand dryer and test to ensure it is functioning properly. The contractor shall provide easel style “Caution Wet Floor Signs” for use in facilities during and after cleaning until the floor dries.

b. Water fountains: Clean surface (top and side) areas of fountains with (5%) calcium hypochlorite solution. Polish chrome ware. Test to ensure fountains are functioning properly.

c. Picnic Shelters/Tables: Clean tables including seats and tops. Clean concrete floor.

Remove insects, insect nests and webs. A water hose may be used to clean the picnic shelter floor and tables.

d. Grills: Use wire brush on grill cooking surface, remove cold ashes from grills and dispose of in authorized dumping areas. Fully extinguish any hot ashes prior to removal.

e. Structures: Includes restroom buildings and picnic shelters. Remove insects, insect nests and/or webs from louvers, screens, doors, windows, floors, light fixtures and covers, inside and outside walls, ceilings, recesses, and eaves for restroom buildings and picnic shelters. All interior areas subject to wet or damp conditions shall be kept free of mold, mildew, fungi or other biological formations.

f. Fishing Pier Lock & Dam #1: Keep free of trash &debris.

g. Grounds: Grounds including roads, parking lots, walkways, platforms, steps, and boating access area shall be kept clean and free of trash and debris.

h. Trash Cans: Empty and replace trash bags in each trash can if more than 1/3 full. Clean cans interior and exterior. Properly dispose of all trash offsite.

i. Graffiti: Remove any graffiti that can be removed with commercially available cleansers or paint over to match existing color (Government will supply paint).

B. Grounds Maintenance:

General Mowing and Trimming: The areas around public use facilities, office, storage and entrance roads shall be mowed to finish mowing standards. Mowers shall be designed for lawn mowing as opposed to rough ground rotary mowing. All areas including road shoulders, parking lots, ramp shoulders, ditches (ditches include back slope to elevation of road surface) shall be mowed and trimmed by the Contractor. Areas around buildings, signs, sidewalks, sign posts, barricade posts, gates, vents, manholes on sand filter sewage systems, shrubbery, planters, trees, guardrails, culverts, picnic tables, garbage cans, playgrounds, boat ramps, communication towers, fences, and cracks in sidewalks and parking lots within each designated area shall be mowed and/or trimmed to maintain a neat appearance. Mowing height will be established during the first mowing by the COR and a Contractor representative. This same height shall be maintained throughout contract unless deviation is approved by the COR. Mower blades shall be kept sharp to insure proper cutting action. Mowing intervals will be based on grass height, grass conditions and soil conditions. Mowing and trimming shall not damage any trees, shrubbery, or other ornamental plantings or endanger visitors in the area. Mowing shall be accomplished in a manner so as not to throw grass on buildings, sidewalks, under picnic tables, on paved roads, parking lots, and planters but rather away from such surfaces. If grass or gravel is thrown on these surfaces, it shall be removed by the Contractor prior to the end of the working day. Living grass and weeds shall be removed from planters, mulched areas, playgrounds, cracks in pavement, each time trimming is accomplished. String trimmers shall not be used around small (less than 4" DBH) trees or young plants. Mowing in an area shall be performed in one continual operation until completed. Trimming shall immediately follow the mowing in order to leave each area in a neatly mowed condition. Mowing will not be considered complete until trimming is completed and grass clippings removed from paved surfaces. Each mowing and trimming will be accomplished only after coordination with the COR or his designated representative. Mowing shall not be permitted when ground is so wet that mowing operations cause wheel rutting or when dry conditions will cause turf damage. Mowing will not be permitted when the grass is so wet that the grass piles or does not mow properly. Directional signs to all areas shall be mowed and trimmed at the same time as area. Mowing/trimming shall be accomplished so that signs shall have a minimum 100 foot sight distance from roadways. Mower clippings shall be evenly distributed throughout the mowing area. Before each mowing, the Contractor shall pick up litter and debris within the mowing area and place it in garbage cans or remove it from the site.

Newly seeded areas shall not be mowed until directed by the COR. With prior approval of the COR, herbicide may be used in lieu of mowing/trimming. Herbicide shall not be applied more than 12” from any structure, i.e. sign post, guardrail post etc. This may be used in areas such as around trees, guardrail, road shoulders and ditches that are difficult to mow due to steepness, obstructions or moisture. After herbicide application is complete and kill is thorough, these areas shall be mowed and/or trimmed to remove unsightly dead grass. Contractor needs to keep records of herbicide/pesticide applications.

c. Frequency: Estimate every other week depending on growth. Between 6:00 AM and 4:00

PM.

d. Grass shall be cut to a height of not more than four (4) inches or less than two and one half (2.5) inches. Work shall be performed within three (3) working days after notification by Contractor to the COR that mowing is required.

e. The total quantity of general mowing will not exceed 12 during the contract period.

2. Shoreline Rip Rap Trash Removal – Contractor shall remove trash from shoreline rip rap areas on the Park side of river from the dam/esplanade to the end of the rip rap.

a. Frequency: Once a week on Friday Between 6:00 AM and 4:00 PM.

b. Estimated length of shoreline riprap for trash removal:

Lock 1 - 450 feet Lock 2 - 700 feet Lock 3 - 675 feet

3. Herbicide Shoreline Rip Rap

a. Frequency: Two applications may be done annually during contract period. The first application shall be applied between 15 May and 30 June, and a second application, if ordered by the COR before 30 September. Modification of these application periods shall be approved by the COR.

b. Estimated rip rap herbicide application area:

Lock #1 - 0.56 acre on west bank only Lock #2 - 1.5 acres on west bank only Lock #3 - 0.77 acre total on east and west banks

c. The Contractor shall prepare a written application plan for COR approval indicating areas for treatment, application rates, personnel, method of application, date and frequency of treatment, safety precautions, measures required based on proximity to water, and any other pertinent information. All herbicides shall be used according to manufactures specifications and in accordance with all applicable laws and restrictions. Applicators shall be licensed by the State of N.C. Department of Agriculture and work shall be in accordance with all Federal, State, and Local laws.

d. The Contractor shall use spray equipment capable of providing uniform coverage of application areas. Recommended herbicide is glyphosate. Substitution may be used only after approval of COR. Commercial grass retardant may be used in appropriate areas to control unwanted vegetation, with prior approval from the COR.

e. The Contractor shall place signs warning people that pesticide application is underway.

Signs shall remain in place until the herbicide has dried.

f. The Contractor shall be required to retreat areas where vegetation is not killed.

Retreatment will be at no additional cost to the Government.

B. Period of Performance

1. Base Year –1 July – 31 Oct 2016 (Tentatively Date)

2. Option to Extend Work: The Government reserves the option to extend work under this contract up to an aggregate total four-year period. Contract payments would be negotiated to reflect increased contractor costs for labor, equipment and supplies, or modification of services.

OPTION YEARS – 1 April – 31 Oct 2017 1 April – 31 Oct 2018 1 April – 31 Oct 2019

1 April – 31 Oct 2020

C. Safety: All work accomplished under this contract shall be in accordance with the Corps of Engineers

Safety Manual EM 385-1-1, (http://www.publications.usace.army.mil/Portals/76/Publications/EngineerManuals/EM_385-1-1.pdf), and any other Federal, State or Local laws. Contractor personnel shall be equipped with the appropriate personal protection equipment, inclusive of, but not limited to safety shoes, work gloves, hearing and eye protection, etc. Additionally, the contractor personnel shall wear appropriate attire, i.e. long pants and a short sleeve collared shirt. Contractor must show proof of a valid state driver’s license.

Additionally, Contractor must complete a COR approved defensive driving course.

D. Security:

a. Contractor and associated sub-contractor employees shall comply with adjudication standards and procedures using the National Crime information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available).

b. “The Contractor must pre-screen Candidates using the E-verify Program

(http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract awarded.” *When contracts are with individuals, the individuals will be required to complete a Form I-9, employment Eligibility Verification, with the designated Government representative. This form will be provided to the Contracting Officer and shall become part of the official contract file.

E. Payment: Payment will be made at the end of each calendar month. Invoices must be received by the

5th of each month.

F. Inspection and Acceptance: The COR will make Inspection of services rendered. Any work not meeting acceptable standards will be remedied to the satisfaction of the inspector prior to payment. Failure or inability to perform acceptable services will result in reduction in payment as provided by Section 37(d)(2) of General Provisions entitled Inspection of Services.

PAST EXPERIENCE:

a) Offeror’s are required to submit prior experience of recent and relevant contracts/projects.

Contracts/Projects can be performed with Federal, State, local or private companies.

Government contracts are preferred but not required.

b) Contracts/Projects that are relevant are defined as those that are similar to the requirements of the Statement of Work (SOW). Contracts/Projects that are recent are defined as those that have been completed within the last five (5) years.

c) A minimum of two (2) contracts/projects shall be provided to include: contract number, title of project, detailed description of work performed, and Point of Contact. Please do not submit more than five (5) contracts/projects.

d) In order for an Offeror to be determined technically acceptable, the offeror must show previous experience with the type of work described in the SOW. Offeror’s must show previous experience on a minimum of two (2) contracts/projects.

Mowing and trimming shall not damage any trees, shrubbery, or other ornamental plantings or endanger visitors in the area. Mowing shall be accomplished in a manner so as not to throw grass on buildings, sidewalks, under picnic tables, on paved roads, parking lots, and planters but rather away from such surfaces. If grass or gravel is thrown on these surfaces, it shall be removed by the Contractor prior to the end of the working day

Work will be re-accomplished until deemed as meeting the requirements of the contract.

Re-performance will be at no cost to the Government.

II.C.3.c The Contractor shall prepare a written application plan for COR approval indicating areas for treatment, application rates, personnel, method of application, date and frequency of treatment, safety precautions, measures required based on proximity to water, and any other pertinent information.

II.C.3.d: The Contractor shall use spray equipment capable of providing uniform coverage of application areas. Recommended herbicide is glyphosate.

Substitution may be used only after approval of COR.

Commercial grass retardant may be used in appropriate areas to control unwanted vegetation, with prior approval from the COR.
