SECTION 00120
PROPOSAL EVALUATION AND CONTRACT AWARD
1. ELIGIBILITY FOR CONTRACT AWARD
In accordance with the FAR, no contract shall be entered into unless the contracting officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the contracting officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must meet the general standards in Part FAR 9 and any special standards set forth in the solicitation.
2. SOURCE SELECTION USING LOWEST PRICE TECHNICALLY ACCEPTABLE
(a) The Government will make award to the offeror submitting the lowest priced technically acceptable proposal. The Government will first review unpriced technical proposals to determine which proposals are acceptable to the Government. Offers that are determined to be technically “Acceptable” will be evaluated on the basis of price. Offers that are determined to be “Non- Acceptable” will not receive further consideration.
(b) Responses that the Offeror understands, or will comply with the specifications, statements paraphrasing the specifications, and general or overly broad responses such as “standard procedures will be employed” or “well known techniques will be used”, will be rated “non-acceptable”.
(c) The objective of the Government is to award a contract to the offeror who submits a proposal that when evaluated is determined to meet or exceed the acceptability levels established in the solicitation for non-price evaluation factors or sub-factor. Each non-price evaluation technical factor will receive a rating of Acceptable/Non-Acceptable. The award will be made to the technically acceptable proposal with the lowest evaluated proposed price.
3. LIST OF EVALUATION FACTORS (VOLUME II) AND SPECIFIC TECHNICAL
EVALUATION CRITERIA.
The Technical Proposal will be evaluated based on the following technical evaluation factors and standards:
FACTOR 1, EXPERIENCE ON SIMILAR PROJECTS, SPECIFICALLY ON HOSPITAL
AND/OR CLINIC ENVIRONMENT.
FACTOR 2, PAST PERFORMANCE ON SIMILAR PROJECTS, SPECIFICALLY ON
HOSPITAL AND/OR CLINIC ENVIRONMENTS:
FACTOR 3, TECHNICAL APPROACH, METHODS AND PROCEDURES
FACTOR 4, CORPORATE/MANAGEMENT STRUCTURE
In order to be considered technically acceptable, proposals must meet ALL of the following requirements listed in the factors below:
FACTOR 1: EXPERIENCE ON SIMILAR PROJECTS, SPECIFICALLY ON HOSPITAL
AND/OR CLINIC ENVIRONMENT.
Section 00120 - 2
Offeror shall identify all projects of a similar scope, magnitude and complexity it has successfully completed within the past five years. Provide a description of the project, total dollar value of the contract at the time of award and at the time of completion, and the name, address and telephone number of the owner. In the case of a federal, state or local government project, provide the name, address and telephone number of the contracting officer. Offeror may include projects completed by predecessor companies.
This factor will evaluate the offeror for its experience in successful completion of projects of similar scope, magnitude and complexity within the past within 5 years. This factor will be evaluated on the basis of demonstrated knowledge and experience performing construction activities within a functioning, operational Department of Veterans Affairs Hospital and/or Clinic, or other Hospital and/or Clinic environment. This factor will address two subfactors:
SUBFACTOR No. 1a, INFECTIOUS CONTROL PROCESSES. This subfactor will be evaluated on the basis of demonstrated knowledge and experience performing construction projects requiring strict adherence to stringent Infection Control Requirements.
SUBFACTOR No. 1b, (deleted)
SUBFACTOR No. 1c, PLUMBING AND HVAC CONTROLS EXPERIENCE – This subfactor will be evaluated on the basis of demonstrated knowledge and successful performance of construction projects.
SUBFACTOR No. 1d (deleted)
Standard for Acceptability: This standard is met when the Offeror can identify three or more completed projects meeting the criteria noted above, similar in scope, magnitude and complexity.
Such projects must have been completed in the past five years. Projects referenced may be the same projects referenced below in Factor 4, if noted so. If using projects not referenced in Factor 4 below, the Offeror must provide project information, identified in Subfactor No. 4a.
FACTOR 2: PAST PERFORMANCE ON SIMILAR CONTRACTS, SPECIFICALLY ON
HOSPITAL AND/OR CLINIC ENVIRONMENTS:
For each project identified in Tab 1, describe the scope of the work, contract price at the time of award, project cost growth during contract performance, and contract price at the time of completion. Describe the contract performance period set forth in the contract, time growth during contract performance, if any, and the number of days from the start of the project to acceptance by the owner/government agency. Identify and describe any warranty issues raised by the owner, and how the problems were resolved, if no warranty issues were raised, offerors should so state. Offerors may provide information on problems encountered on the projects and the Offeror’s corrective action. Identify and include results, if anyof litigation regarding the project.
The Government may consider any and all sources of information about the projects, including, but not limited to, contacting the owner or contracting officer of the project, and the CCASS rating system. Firms who have a less than satisfactory performance evaluation should explain from the perspective what happened, and lessons learned from the experience.
This factor will evaluate how well an Offeror has performed on projects of a similar scope, magnitude and complexity, and is an indicator of the likelihood of completion of the project in terms of time, cost and quality of work. Past performance must be demonstrated within a
Section 00120 - 3
B500 Retrofit Sewer, VAGLA Healthcare System, West Los Angeles, CA functioning, operational Department of Veterans Affairs Hospital and/or Clinic, or other Hospital and/or Clinic environment.
In addition, the Government will consider Client’s Overall Satisfaction with Project. The Offeror must provide it’s client information, as described in Subfactor No. 4A. The Offeror’s Client will be contacted. The contracts’ responses to the following questions will be considered:
