SECTION L
A. QUOTE SUBMISSION GENERAL GUIDELINES
1. Offerors should be registered in the System for Award Management (http://www.sam.gov) upon submission of quote. The System for Award Management (SAM) is a Federal Government owned and operated free web site that consolidates the capabilities in the Central Contractor Registration (CCR) FedReg, ORCA, and EPLS.
2. Joint Ventures or A.T.I. (Associazione Temporanea d'Imprese, Temporary Association of Firms) are not allowed.
B. GENERAL INSTRUCTIONS
1. Offerors shall strictly adhere to the requirements in this Section when preparing the quote to be submitted in response to this Request for Quote (RFQ). All proposals shall be in English. The Government will not reimburse any Offeror any cost incurred in response to this RFQ. Quotes that fail to comply with the quote submittal requirements addressed in this section of the solicitation may be determined unacceptable. To assure timely and equitable evaluation of quotes, Offerors must follow the instructions contained herein.
2. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The Offeror shall submit in the quote all requested information specified in this section of the Request for Quote (RFQ) at or before the exact date and time specified. There will be no public opening of the quotes received as a result of this RFQ.
Failure to meet a requirement may result in a quote being ineligible for award.
3. All RFP documents will be posted to the Federal Business Opportunities (FedBizOpps) website (https://www.fbo.gov) and made available for viewing. All amendments will be posted to FedBizOpps and made available for viewing. It shall be the Offeror’s responsibility to check the website for any amendments and updates to the solicitation.
4. The Government will award one contract for all line items to the responsible offeror whose quote represents the best value to the Government. Awards will be based on the best value – utilizing the Lowest Price Technically Acceptable approach. This process permits no tradeoffs among cost or price and non-cost factors. Award will be made to the offeror whose offer is evaluated as “acceptable” for all technical factors and whose quote has the lowest price.
5. Quotes received by the Government after the date and time set for receipt of quotes will be handled in accordance with FAR 15.208.
C. QUOTE SUBMISSION INSTRUCTIONS:
1. Quotes may be submitted by firms formally organized as design-build entities, or by construction contractors and designers/design firms that have associated specifically for this contract. For the purpose of this solicitation, no distinction is made between formally organized design-build entities and contract-specific design-build associations.
Both are referred to as the design-build offeror (or simply “Offeror”), or the design/build contractor, (or simply, “Contractor”), after award of the contract.
2. General Requirements: The quote shall be clear, concise, and shall include sufficient detail for effective evaluation. The quote shall not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the Offeror intends to meet the requirements. Offerors shall assume that the Government has no prior knowledge of their facilities or experience, and will base its evaluation only on the information presented in the Offeror’s quote.
3. Offeror(s) shall provide quotes in English in accordance with the instructions below. Quotes shall consist of two
(2) electronic copies (documents PDF format) with the bid guarantee provided as an original. The electronic copy (PDF format on a CD or DVD) will be delivered to the following address: ATTN.: Ms. Elisa Marchetti or Ms. Dee Cavanaugh, 414th CSB, Regional Contracting Officer (RCO), Caserma Ederle, Building 3, Room 104, Viale della Pace 193, 36100 Vicenza in an envelope clearly marked with the solicitation number. Government personnel may not be available to pick up quotes at the gate. It is the contractor's responsibility to ensure delivery to the location specified.
4. BID GUARANTEE: Offerors will provide a bid guarantee in the amount and format as required under this section of the solicitation (Euro 10,000.00). The offeror shall furnish a bid guarantee in the form of a firm commitment supported by a registered bank or by a primary credit union company recognized by a bank ("istituto bancario, azienda di credito autorizzata o assicurazione autorizzata a norma di legge").
The Contracting Officer will return bid guarantees:
a. To unsuccessful offerors as soon as practicable after the award of the contract; and
b. To the successful offeror upon execution of all contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the quote as accepted. Failure to submit a valid Bid Guarantee will result in an incomplete quote which will not be evaluated.

SECTION M - EVALUATION FACTORS FOR AWARD
SECTION M
A. BASIS OF AWARD / EVALUATION
1. The Government plans to award one contract to the responsible offeror whose quote represents the best value to the Government. Awards will be based on the best value – Lowest Price Technically Acceptable approach. This process permits no tradeoffs among cost or price and non-cost factors. Award will be made to the offeror whose quote meets all “acceptable” technical factors and whose quote has the lowest price.
2. Numerical scores and other point-scoring techniques will not be used in the evaluation process. Each factor will receive an acceptable or unacceptable rating. The Government will evaluate quote in accordance with the evaluation factors described in this section.
3. The Government reserves the right to discuss aspects of quotes with Offerors in the competitive range. Offerors are advised that the Government may make award without discussions, clarifications, or any contact concerning the quotes received. Offerors shall not assume that they will be contacted or afforded an opportunity to clarify, discuss or revise their quotes.
B. EVALUATION FACTORS AND RATINGS
1. Quotes will be evaluated using the evaluation factors listed below:
FACTOR I – Technical
Subfactor 1 – Construction Experience Subfactor 2 – SOA Certification
FACTOR II – Past Performance
FACTOR III – Price
All evaluation factors other than cost or price, when combined, are approximately equal to cost or price.
2. FACTOR I: TECHNICAL
c. FACTOR I, SUBFACTOR 1: Construction Experience. The Government will evaluate this subfactor utilizing only the Construction Experience Sheets provided with the solicitation. If the offeror submits more than three (3) Construction Experience Sheets with their quote, the government will only evaluate the first three (3) Construction Experience Sheets in an offeror’s quote. Any additional projects submitted will not be evaluated. The Government will evaluate the Offeror’s construction experience on relevant and recent projects. For purposes of evaluation of this subfactor, relevant and recent projects are projects that meet the following minimum criteria as a standard of proof:
(1) Were construction projects “same or similar” in scope to the project in this solicitation.
“Same or similar” scope projects are projects which include one or more of the following: building renovation and/or construction, water tower renovation, water distribution system replacement.
(2) Had a contract value which equals or exceeds €100,000.00
(3) Were completed within five (5) years from the date of this solicitation
(4) Were completed in Italy
d. FACTOR I, SUBFACTOR 2: SOA Certification. The Government will evaluate SOA certifications to determine if the offeror possesses the mandatory certification outlined in Section L which certifies that the company satisfies all requirements pursuant to Italian law.
EVALUATION. Factor I: Technical. All offerors will receive one of the following Adjectival Ratings for Factor I:
Adjectival Rating Description
Acceptable Quote meets the requirements of the solicitation
Unacceptable Quote does not meet the requirements of the solicitation
When evaluating subfactor 1, the government evaluation team will review the project(s) submitted on the Construction Experience Sheet(s) and verify that each project, individually, meets the criteria as a standard of proof for relevant and recent. In consensus, if a project submitted for evaluation fails to meet one or more of the criteria for standard of proof, that project will not be considered relevant and recent. In order to receive an acceptable rating in this subfactor, at least one project submitted must be evaluated as relevant and recent.
When evaluating subfactor 2, the government evaluation team will review the offeror’s SOA category and classification to verify that the OG1 certification is current and classification I or higher. In order to receive an acceptable rating in this subfactor the offeror must have a current OG1 certification that is classification I or higher.
3. FACTOR II: PAST PERFORMANCE. The past performance evaluation is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance provided in the offeror’s Past Performance Questionnaires outlined in Section L. The Government will evaluate the relative merits of each Offeror’s past performance on the same relevant projects submitted and evaluated under Subactor 1, Constuction Experience. Please note that “Construction Experience” measures “what you have done” while “Past Performance” measures “how well you have done it”.
a. The Government will evaluate each offeror’s past performance to determine how well it conforms to specifications and standards of good workmanship, adheres to contract schedules including administrative aspects of the performance, exhibits reasonable and cooperative behavior and a commitment to customer satisfaction and has a businesslike concern for the interests of the customer.
b. Recent past performance is defined as projects which have been completed within five (5) years from the date of this solicitation. Since the projects that will be submitted for past performance will be the same as those projects submitted for Factor I, Past Experience, the definition of relevant is the same.
c. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror shall be determined to have unknown (or neutral) past performance.
d. Evaluators may consider any data in the above in determining the performance rating in conjunction with the completed surveys provided by past customers. Government evaluators may contact your points of contact/references for the projects submitted to verify an Offeror’s past performance on these projects. In addition, the Government may use personal knowledge or information from other sources, such as agency performance databases and Government construction administration personnel, in its evaluation of an Offeror’s past performance.
The Government may use data provided by the Offeror and data obtained from other sources. While the Government may elect to consider data obtained from other sources, the burden of providing thorough and complete past performance information rests with the Offeror.
e. In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s quote, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the offeror.
f. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
EVALUATION. Factor II: Past Performance. All offerors will receive one of the following Adjectival Ratings for Factor II:
Adjectival Rating Description
Acceptable
Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort or the offeror's performance record is unknown. (See note below)
Unacceptable
Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
To receive an “ACCEPTABLE” rating for Factor II, the Government has must have a reasonable expectation that the offeror will successfully perform the required effort or the offeror's performance record is unknown. Offerors with unknown past performance will receive a neutral evaluation, resulting in an “ACCEPTABLE” rating.
5. FACTOR III – PRICE. The lowest price technically acceptable offer will be awarded the contract for this solicitation. Only a responsible offer in accordance with FAR 9.1 will be eligible for award.
a. The price quote will be evaluated separately from the non-price factors. An assessment of the reasonableness of each proposed price will be made. In the evaluation of the price, various techniques and procedures may be used to ensure a fair and reasonable price. However, if the Contracting Officer determines that information on competitive offered prices or previous contract prices is not available or is insufficient to determine that the price is fair and reasonable, the Contracting Officer may use technique as appropriate to the circumstances applicable to this acquisition.
b. Unrealistic, unbalanced, or unreasonable pricing may cause a quote to be determined unacceptable.
Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques.
(End of Summary of Changes)
The following items are applicable to this modification:
SECTION I - CONTRACT CLAUSES
52.236-1 PERFORMANCE OF WORK BY THE CONTRACTOR (APR 1984)
The Contractor shall perform on the site, and with its own organization, work equivalent to at least 30 percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.
(End of clause)
